An Analysis of the Effects of Medimmune, Inc. v. Genentech, Inc.
In Medimmune, Inc. v. Genentech, Inc., the Supreme Court rejected the Federal Circuit’s longstanding interpretations of federal declaratory judgment law in patent cases. In so doing, the Court has not only changed how courts must deal with patent challenges, but also radically altered the strategic and tactical landscape facing all patent owners, licensees, and those accused of infringement. The sweeping nature of the changes wrought by Medimmune and its recent progeny from the Federal Circuit makes it one of the most significant Supreme Court patent cases in recent years, and its likely commercial impact should not be underestimated.

New Supreme Court Decision Discusses Obviousness in KSR International Co. v. Teleflex, Inc.
The United States Supreme Court weighed in on the question of what constitutes obviousness. Specifically, the Supreme Court analyzed the Federal Circuit’s teaching, suggestion, motivation (“TSM”) test for obviousness. The Supreme Court indicated that while the TSM test is helpful, the purpose or motivation behind a patent claim is not controlling, but rather, “what matters is the objective reach of the claim.

New Patent Reform Act 2007 is being considered by Congress
The existing Patent System of the United States of America (U.S.) is set for some significant changes in light of a recent bill being considered by the U.S. Congress. The Patent Reform Bill (H.R. 1908), referred to as the Patent Reform Act of 2007 (hereinafter “the Act”), was introduced in the House of Representatives and the Senate on April 18, 2007. The Act is an update to the earlier version of this bill filed in August 2006.

Susan J. Link Named Chair of Estate Planning Practice Group
The law firm of Maslon Edelman Borman & Brand, LLP, is pleased to announce that Susan J. Link was recently named Chair of the Estate Planning Practice Group.

Susan J. Link practices in the areas of estate planning, probate and trust administration. She works with families to plan the disposition of their assets, both during lifetime and at death, and to accomplish the optimal estate and transfer tax planning. Susan is a fellow of the American College of Trust and Estate Counsel, and has taught Wills, Estates & Trusts and Estate Planning as an adjunct professor at the University of St. Thomas School of Law. Susan is currently a member of the Probate and Trust Section Council of the Minnesota State Bar Association, and Co-chairs the Section’s Wills for Heroes Committee.

Three New Attorneys Join Kennedy Covington
Kennedy Covington, one of the largest law firms in the Carolinas, is pleased to announce that three new attorneys have joined the Firm.

Gina Collias has joined the Firm as an Associate in the Development Section of the Real Estate Department. Located in Kennedy Covington's Charlotte office, Collias will focus her practice on real estate development and leasing. Collias received her J.D. from the Walter F. George School of Law at Mercer University and her B.A. from the University of North Carolina. Prior to joining Kennedy Covington, she worked as an Arbitrator, handling Mandatory Court Arbitrations. She is a member of the City of Kings Mountain Downtown Development Committee and Land Use Planning Committee.

Mayelin Prieto-Gonzalez has joined the Firm as an Associate in the Health Law Section of the Business Law Department. Located in Kennedy Covington's RTP office, she will focus her practice on healthcare issues including regulatory and transactional matters. Prieto-Gonzalez received her J.D. from the Harvard Law School and her B.A. in Psychology from Cornell University. Prior to joining Kennedy Covington, she was an Associate with Smith Anderson in Raleigh, and formerly, she was a Health Care Associate at Mintz Levin in Boston.

Jack Wiggen has joined Kennedy Covington as an Associate in the Development Section of the Real Estate Department. Located in the RTP office, he will focus on real estate development. Wiggen has experience in commercial real estate and real estate financing, including drafting and negotiating lease agreements. Wiggen received his J.D. from the University of North Carolina School of Law and his B.S. in Business Administration from East Carolina University. Prior to joining Kennedy Covington, he was an Associate with Pinna, Johnston & Burwell in Raleigh.

Godfrey & Kahn, S.C. is pleased to announce that attorney Thomas N. Shorter has been appointed Vice-Chair of the American Health Lawyers Association's (AHLA) Labor and Employment Practice Group. AHLA’s Labor and Employment Practice Group addresses concerns related to healthcare employment law, employment discrimination, immigration, union-management disputes and other areas.

Shorter, a shareholder in Godfrey & Kahn’s Labor & Employment and Health Care Practice Groups in the firm’s Madison office, represents health care and educational institutions by providing counsel in labor and employment and regulatory matters such as collective bargaining, FMLA compliance, HIPAA Privacy, and discrimination issues. His health care practice includes working with hospitals, physicians’ groups, research institutions and other health care organizations.

Shorter is an active member in the American College of Healthcare Executives, the American Society for Healthcare Human Resources Administration and the Wisconsin Society for Healthcare Risk Management. He received his bachelor’s degree from the University of Wisconsin – Madison and his law degree from the Northeastern University School of Law.
