Thacher Proffitt Elected Four New Partners and Added Two New Counsel

Thacher Proffitt was included in the "Newswatch" section for electing four attorneys to the partnership - Aimée Cummo, Jerome Dano, Sam Lee, Tom Majewski - and hiring two new counsel - Lou Evans and Trisha Smith - who will compose the environmental practice.

Simpson Thacher Advises Blackstone in its Acquisition of a Stake in Alliant Insurance Services
The firm is representing Blackstone Capital Partners in its announced acquisition of an ownership stake in Alliant Insurance Services, Inc., one of the nation’s largest insurance brokerage firms. In partnership with Alliant’s management and employees, Blackstone Capital Partners has reached an agreement to acquire the Company from its current owners comprised of the investment firm Lindsay Goldberg and Alliant’s management and employees. The terms of the transaction were not released.

The transaction is expected to close within the next 75 days.

The Simpson Thacher team who worked on the transaction includes: Wilson Neely, Andrew Chvatal, Peter Martelli and Felton Booker (M&A); Steve DeLott (Corporate/Insurance); Gary Mandel and Jennifer J. Marsh (Tax); Greg Grogan and Andrew O’Brien (Benefits); Jay Ptashek (Credit); Kirstie Howard (IP); Bryan Gordon (Real Estate); and Brendan Derr (Paralegal). Summer Associate Ravi Purushotham also provided invaluable assistance.

Simpson Thacher Achieves NY Appellate Division Victory for Kramer, Dillof, Livingston & Moore
The Firm was successful in the Appellate Division, Second Department on behalf of the law firm Kramer, Dillof, Livingston & Moore in securing a unanimous affirmance of an Order of the Supreme Court, Orange County dismissing the complaint against the firm at the end of the trial of the entire case. The case arose out of an underlying medical malpractice action in which Kramer Dillof represented the plaintiff. During the trial of the medical malpractice case, the plaintiff rejected a settlement offer of $1 million. The jury subsequently returned a verdict in the client's favor for one-third that amount. Months later, claiming she had never been informed of the $1 million settlement offer, the client brought a legal malpractice action against Kramer Dillof seeking compensatory and punitive damages.

On May 15, a panel of the Appellate Division unanimously affirmed the trial court's order. The Appellate Division held that the plaintiffs failed to show that they would have accepted the settlement offer they claimed had not been conveyed to them. Further, the court held, a judicial order awarding fees to Kramer Dillof following the medical malpractice trial -- an order to which the plaintiffs consented -- barred the legal malpractice claim under res judicata principles. The Appellate Division also found that plaintiffs' fraud claim was duplicative of their legal malpractice claim and it had been properly dismissed.

Ten from Thelen Listed Among California's Leading Lawyers
Ten of Thelen Reid Brown Raysman & Steiner LLP’s California partners have been highlighted in Who's Who Legal: California 2007 as being among the state’s leading lawyers.

UK-based Who’s Who Legal, the official research partner of the International Bar Association, has begun producing a series of U.S. State-specific books “honoring the very best practitioners within the world's largest legal marketplace.” Drawing on more than ten years of independent research, the 2007 California guide identifies 725 attorneys in 25 practice areas as the state's preeminent lawyers.

The 2007 California guide lists 25 attorneys as leaders in Construction, including Thelen Co-Chair Stephen V. O’Neal, Construction and Government Contracts department chair John R. Heisse, II, and partners David Buoncristiani, John W. Ralls, and Robert B. Thum.

The guide also lists 11 attorneys as leaders in Project Finance, including Thelen partners Robert L. Nelson, Jr., David C. Spielberg, and Mark P. Weitzel.

Additionally, partners Robert B. Pringle and Veronica Colby Devitt have been listed for Competition and Trademarks, respectively.

In April, Who’s Who Legal named Thelen the 2007 "Global Construction Law Firm of the Year." This annual award, based on client and colleague nominations, is given to the law firm with the most exceptional performance in each of 27 practice areas.

Jessum Receives ABA Committee Outstanding Service Award
Stradley Ronon attorney Kim R. Jessum recently received an outstanding service award from the American Bar Association’s (ABA) Technology for the Litigator Committee at the ABA’s annual Section of Litigation meeting in San Antonio, Texas. Jessum currently serves as a Web site editor for the committee.

As a member of Stradley Ronon’s intellectual property group, Jessum focuses her practice in patent, trademark, copyright and trade secret matters. She represents chemical, pharmaceutical and biotechnology clients in both intellectual property litigation and transactional matters.

Rumberger, Kirk & Caldwell Partner Greg Palmer Wins Case for American Airlines.
Gregory M. Palmer, a partner in the Miami office of Rumberger, Kirk & Caldwell, and Shannon Campbell Fitzpatrick, an associate with the firm, won a defense verdict in Miami Circuit Court for American Airlines.

American Airlines was sued by the driver of a postal truck who claimed that an American Airlines lavatory truck backed into his vehicle on the tarmac at Miami International Airport. The Plaintiff sued for medical bills related to multiple herniated discs requiring cervical fusion surgery, pain and suffering, lost wages in the past and lost future earning capacity.

Palmer argued that there was no proof that an accident even occurred. He also argued there was no damage to the postal truck as a result of the alleged accident. Palmer further argued that American Airlines did not receive notice of the alleged accident until the Plaintiff made a claim for damages against American Airlines. Palmer also argued that the Plaintiff’s alleged injuries and medical bills were the result of a pre-existing, degenerative condition. At trial, Palmer emphasized the fact the Plaintiff failed to disclose prior back and neck pain as well as prior physician care and magnetic resonance imaging (MRI) related to the pre-existing condition.

As a result of Palmer's arguments, the jury returned a defense verdict, finding no negligence on the part of American Airlines which was a legal cause of the Plaintiff's damages.
