Holland & Hart Expands Construction Practice With Three Trial Lawyers
Holland & Hart LLP expands its Real Estate and Construction litigation practice and welcomes attorneys Shawn Rodda, Erik Stidham, and Manita Rawat.

Ms. Rodda is of counsel in the firm's Denver office and represents owners, general contractors, and subcontractors on construction-related issues in state and local courts, arbitrations, and mediations. She has also served as an Adjunct Professor at the University of Denver Sturm College of Law, teaching Lawyering Process. Prior to joining Holland & Hart, Ms. Rodda practiced for seven years with Kilpatrick Stockton, LLP in Atlanta, Georgia. She received her J.D. summa cum laude from Tulane University, where she was the associate editor of the Tulane Law Review, and she received her B.S. from Pennsylvania State University.

Mr. Stidham is of counsel in the firm's Boise office and represents plaintiffs and defendants in complex construction-related litigation. He has a national practice, having served as lead trial counsel in lawsuits in more than 20 states. He focuses on business disputes, construction litigation, product liability claims, and civil fraud claims. Prior to joining Holland & Hart, Mr. Stidham was a partner in a large, regional law firm and an Idaho-based litigation boutique. He earned his J.D. from the University of Virginia School of Law and his B.A. summa cum laude from Arizona State University.

Ms. Rawat is an associate in the firm's Las Vegas office and focuses her practice on construction litigation, global climate change, and environmental and natural resources. Prior to law school, she worked for California Environmental Protection Agency's Department of Toxic Substances Control where she helped develop standards and upper tolerance limits for harmful toxins on land sites and analyzed technical issues in legislative bills related to environmental compliance. She also worked as a researcher in a lab for the Biochemistry Department at the University of Nevada School of Medicine. She received her J.D. from the University of Illinois at Urbana-Champaign College of Law and her B.S. from the University of Nevada, Reno.

Former Medtronic VP Michael Ellwein Joins Fredrikson & Byron’s Medical Technology Group
Michael D. Ellwein, former Vice President and Chief Development Officer at Medtronic, Inc., has joined Fredrikson & Byron in the firm’s new Medical Technology Group. At Fredrikson, Ellwein leverages his knowledge of the medical technology industry to assist with venture financing, mergers, acquisitions, divestitures, joint ventures, strategic alliances and licensing prospects.

Positions held during his 17-year tenure at Medtronic include Vice President and Chief Development Officer, Vice President of Corporate Development, Associate General Counsel, and Assistant General Counsel. While at Medtronic, Ellwein established strong connections in the venture capital market and provided guidance to assist in the growth of the company by acquisition from a pacing company to the largest medical technology company in the world.

Ellwein has served on boards for several medical technology organizations throughout his career and continues to be actively involved with the industry. Currently, Ellwein has been nominated to serve on the board of publicly-held Northstar Neuro, and is an advisory board member for the Cleveland Clinic, a multi-specialty academic medical center that integrates clinical and hospital care with research and education. In addition to his role at Fredrikson, Ellwein is a venture partner with Three Arch Partners in Portola Valley, California, and in that capacity, is a board member of the New Hampshire-based SmoothShapes, an FDA-cleared, noninvasive laser-based system for improving the appearance of cellulite.

Dechert's Boston Office Receives Adams Pro Bono Publico Award
The Massachusetts Supreme Judicial Court's Standing Committee on Pro Bono Legal Services honored the Boston office of Dechert LLP with an Adams Pro Bono Publico Award in ceremonies held June 4 at the John Adams Courthouse in Boston.

"This is a tremendous honor for the lawyers at Dechert who, with the guidance of Bernie Bonn, have devoted so much of their time and energy to some of the most important pro bono matters in the Boston area," said Timothy C. Blank, managing partner of Dechert's Boston office, referring to Bernard J. Bonn III, a partner in Dechert's Intellectual Property Practice, who is a past president and currently a director of Greater Boston Legal Services. Bonn coordinates the firm's pro bono work in Boston.

"I have worked with Bernie for over 20 years, and he has always placed pro bono work at the very top of his professional and personal priorities," Blank continued. "His unwavering commitment to pro bono work is infectious, and the lawyers in our Boston office share his view that we have the duty and privilege to represent the neediest among us."

Established in 1999 and named in honor of John Adams and John Quincy Adams, the Adams Pro Bono Publico Awards honor individual lawyers, law firms, government attorney offices, corporate law departments, and other institutions in the legal profession in Massachusetts that have "enhanced the human dignity of others by improving or delivering volunteer legal service to our Commonwealth's poor and disadvantaged."

Dechert was recognized for numerous pro bono cases, including recent efforts on behalf of immigrants detained in a March raid on a factory in New Bedford, and for a successful class action suit against the Massachusetts Bay Transportation Authority on behalf of people with disabilities. Bonn, along with Dechert associates Kevin Blume, Matthew Lyons, and Michael Shin, received certificates of appreciation from the Committee for services representing the persons detained in the New Bedford raid. Associate Anthony Bolzan was recognized for his work in the MBTA case.

Other notable pro bono cases by Dechert's Boston office include representation of a prisoner in a civil rights action against Massachusetts prison guards and representation of the oldest death row inmate in Pennsylvania. Attorneys in Dechert's Boston office also serve on a firmwide team providing counsel to Guantanamo Bay detainees.

"As a firm, we are extremely proud of our pro bono efforts and the role we play in helping those who are denied equal access to justice because they cannot afford legal services," said Suzanne E. Chapman and Cutler Forms Public Infrastructure Working Group to Facilitate Increasing Use of Private Finance Transactions for Public Works
Responding to a growing need for private investment in public works at the local, state and federal levels, leading financial services aw firm Chapman and Cutler LLP has formed a Public Infrastructure Working Group to harness the firm’s deep pool of knowledge and experience with public-private partnerships.

Public-private partnerships (PPPs) have increased sharply during the past few years, bringing new sources of private capital to fund repairs for aging and overused infrastructure as well as helping finance and maintain new public works projects. According to a report released by the Urban Land Institute in May, the U.S. faces a $1.6 trillion deficit in needed infrastructure spending through 2010 for repairs and maintenance. Originally associated with highway construction and transportation networks – such as the Chicago Skyway and the Indiana Toll Road – PPPs are also used for overhauls of public buildings including hospitals, schools, government offices and courts, as well as water and sewage treatment facilities, the rehabilitation of brownfields, and airport improvements. They are even being considered for state-run lotteries.

Chapman and Cutler has long been known for its combined expertise in both public and private sector finance. The firm’s 220 lawyers work extensively on public finance, project finance, structured finance, lease finance, asset securitization, taxation, private equity, private placements, secured lending and corporate finance. On the public finance side, Chapman and Cutler has been recognized by Thomson Financial as the most active municipal bond counsel in the US for 26-straight years

“The creation of a formal Public Infrastructure Working Group builds on our firm’s long-standing commitment to both public and private finance. Our proficiency in complex financial structuring and our experience across the entire spectrum of public works projects, makes us especially well-suited to work on large-scale infrastructure projects,” said William Libit, a corporate and project finance partner who chairs Chapman’s new Public Infrastructure Working Group. The concept of private funding for public works has been around for hundreds of years. In 1652, a private company was formed to provide drinking water to communities in Boston. In 1863, a federal franchise was provided to the Central Pacific and Union Pacific railroads to create the country’s first transcontinental railroad. The current increase of PPPs is fueled in part by private investment capital and a growing need for financing improvements to public infrastructure assets, as well as added pressure to upgrade public facilities and highways serving major metropolitan markets with growing populations

Chapman and Cutler has recently been involved in several PPP transactions, including the Chicago Skyway Toll Bridge and the creation of a special purpose entity that developed, owns and operates an office building and parking garage built in land owned by the US Department of Veterans’ Affairs, which leases the building and parking garage. Chapman worked with an energy services company, a plant developer and a major investment bank on the structuring and Rule 144A offering of $128 million taxable revenue bonds that financed the National Interagency Biodefense Campus (NIBC) at Fort Detrick, Maryland. Other PPP projects have included an energy facility on Veterans’ Affairs land in North Chicago; an office building with adjacent parking lot in Milwaukee; a remediated industrial site in Midvale, Utah; a former defense depot in Ogden, Utah; and other PPP projects with the Departments of Energy, Defense and Veterans’ Affairs.

“State and local caps on spending as well as public sentiment against tax increases result in a hole in the funding needed for many aging roads, tunnels, bridges and other public transportation facilities and other infrastructure across the United States,” explains Mr. Libit, “In addition, the current liquidity in the private capital markets has created new financing techniques, new investors, and new revenue streams; which all contribute to a whole new way of looking at monetizing public works.”

Long established in Europe, Australia and Canada, PPP’s are catching on in a number of US regions. The Pocahontas Parkway outside Richmond, VA was recently leased to a private bidder. Pennsylvania has retained consultants to look into the feasibility of offering the turnpike linking Philadelphia with Pittsburgh for sale or lease; and New Jersey is considering leasing out the Garden State Parkway. Several states have considered turning lottery operations over to private companies in exchange for upfront payments and future guaranteed income. Overall state lotteries had $16 billion in profits in 2005 “Chapman has a distinguished record of counseling a variety of financial industry clients, all of whom have the potential for participation in PPPs, including sponsors, project companies, lenders, private commercial and investment banks placement agents, underwriters, credit rating agencies, suppliers, contractors, and off-take purchasers and advisors,” explains Richard Cosgrove, Chief Executive Partner at Chapman and Cutler. “Our work with clients in merger and acquisitions, securities offerings, and privatization strategies, along with our 90-year-old history in public and private finance has given us a unique knowledge base of the complex issues relating to the private funding of public infrastructure projects.”

Carl Rashid, Jr. honored by American Arab Professionals Network
Butzel Long attorney and shareholder Carl Rashid, Jr. was one of four individuals honored recently by the American Arab Professional Network (AAPN). Mr. Rashid received the "Arab American Professional of the Year" Award. Other honorees included: Dr. Marwan Abouljoud, Henry Ford Health System; Amal Berry-Brown, Comerica Bank; and, Marvin Al-Khafaji, Allegiance Home Health Care, Inc.

The AAPN is a group of Arab American professionals who exchange a knowledge bank, develop professional skills and share ideas on promoting professionals in the Arab American community.

Mr. Rashid is a vice president of Butzel Long and also serves on the firm's Board of Directors. He joined Butzel Long in 1980. Previously, he served as an assistant corporation counsel of the City of Detroit from 1974 to 1980 representing the Finance Department, the Detroit Board of Assessors and the City Treasurer.

His areas of practice include real estate, state and local taxes, investment related tax incentives, condemnation law and government affairs matters.

Mr. Rashid's investment-related tax incentives practice includes implementing the first Act 198 Industrial Development District in the State of Michigan. More recently, he represented Global Engine Alliance, LLC in obtaining one of the largest investment-related tax incentives in the State of Michigan for its engine manufacturing facility in Dundee. Mr. Rashid has authored property tax legislation including the Commercial Redevelopment District Act (Act 255 of 1978), and Public Act 317 of 2000, involving personal property inventory.

He has had extensive experience representing clients in Federal and State Courts, including the United States Court of Appeals for the Sixth Circuit, the Michigan Supreme Court, the Michigan Court of Appeals, the United States District Court for the Eastern District of Michigan, the Wayne, Oakland and Macomb County Circuit Courts, the Michigan Tax Tribunal and the Michigan State Tax Commission.

Mr. Rashid is a member of the State Bar of Michigan, American Bar Association and Metropolitan Detroit Bar Association's Committees on Real Property and Taxation. He is a co-author of Michigan Tax Practice and Procedure and co-editor of Michigan Real Estate Law. He has also served as co-chair and lecturer for Institute of Continuing Legal Education (ICLE) seminars on property tax and is a frequent lecturer for the Michigan Municipal League. Mr. Rashid is a past Commodore of the Grosse Pointe Yacht Club, Past Co-Chair of the American Arabic and Jewish Friends and former City Councilman of the City of Grosse Pointe.

Mr. Rashid earned his B.S. degree in Accounting in 1970 from St. Joseph's College and his J.D. in 1974 from Michigan State University College of Law. Mr. Rashid is a resident of the City of Grosse Pointe Woods.

Debbie Rosenfeld Exhibits Works at Buckingham, Doolittle & Burroughs, LLP
The law firm of Buckingham, Doolittle, & Burroughs, LLP (“BDB”) is currently featuring works by Columbus photographer Debbie Rosenfeld in the lobby on the 3rd floor of 191 West Nationwide Boulevard, Columbus. The design of the law firm’s office, which is in the Arena District, includes space that enables BDB to exhibit the work of local artists on a regular basis. Rosenfeld’s work will be on display through mid July.

Rosenfeld worked for an organization which was located in the World Trade Center. September 11, 2001 changed her world forever. She still can't make sense of the tragic events of 2001, however, she realizes that since none of us are able to change what happened, the best that any one individual can do is to accept the experience and move forward, trying to make some positive life changes.

Now that she has had time to recover and rebuild her life, she has embarked on her journey as an artist Her work is now about finding beauty in everyday life, where it remains hidden - in plain sight.

During her travels last spring to Belgium and the Netherlands, Rosenfeld took many photographs. Some of these images are included in the exhibit. She starts with full color photos and then selectively removes color from parts of the images in order to enhance the viewers’ experience.

Rosenfeld’s gallery also includes black and white, full color floral, landscape, and interesting architectural shots. Her critically acclaimed work is in corporate and private collections in the US and as far away as Korea and New Zealand. Select pieces of her work can be viewed at www.debbierphotography.com

A New Jersey native, Rosenfeld and her husband, Lee, reside in Columbus, Ohio.
