Four Attorneys Join Woodcock Washburn’s Atlanta Office
Woodcock Washburn LLP is pleased to announce the addition of three partners, Lance Reich, Andrea Bates and Michelle Tyde, and associate Carmen Lyles-Irving, significantly expanding its Atlanta presence. All previously were with Carlton Fields

. “We are delighted to welcome this group of talented IP professionals,” said Wendy Choi, managing partner of the Firm’s Atlanta Office, which opened May 2005. “Their national patent prosecution, trademark, copyright and transactional skills are a perfect fit for the Firm’s strategic plan, by further enhancing our expertise in the business aspects of intellectual property. We are targeting our expansion in Atlanta in response to the increased demand for full-service intellectual property counsel in the Southeast.” The Firm’s prominent client base includes AT&T Mobility (formerly Cingular Wireless), DuPont, Johnson & Johnson, Microsoft and the University of Pennsylvania.

She added that the Firm leases nearly 7,000 square feet office space in Atlanta, and she has plans for future hires to continue expanding the Firm’s southern presence.

Lance Reich specializes in complex patent prosecution and litigation, with a particular emphasis in the electronics, computer software, and business methods areas. He is often called on as an expert in patent litigation matters. Reich was selected as one of Atlanta Magazine’s 2005 Georgia Rising Stars, and as a 2005 Georgia Legal Elite by Georgia Trend Magazine. He is admitted to practice in Georgia and Florida, and before the U.S. Patent and Trademark Office. He earned his J.D. from the University of Florida, an M.S. in Computer Science from Southern Polytechnic State University, and his B.A., cum laude, from University of Tampa. Andrea Bates is a transactional attorney with significant experience in the development, structure, prosecution, licensing, defense, utilization, and monetization of intellectual property. Bates also assists clients in leveraging brand and patent portfolios by structuring internal monitoring and development policies, IP mapping, revenue, and corporate strategies. Formerly the Chief IP Counsel for CheckFree Corporation, Bates is admitted to practice in Georgia and California, and before the U.S. Patent and Trademark Office. She received her J.D. from The John Marshall Law School Chicago, and her B.A. from University of North Carolina at Wilmington

Michelle Tyde specializes in intellectual property strategy and management, and assists companies in acquiring, protecting and monetizing their IP assets. She has structured and negotiated a diverse range of complex deals involving electronic entertainment, publishing, telecommunications, outsourcing, data protection, electronic financial transactions, and biotechnology. Tyde has also worked with publicly-traded and private companies on offensive and defensive strategies to combat patent trolls and infringers. . A former senior commercial attorney for Qwest Communications, she is admitted to practice law in Georgia. Tyde received her J.D., magna cum laude, from Mercer University Walter F. George School of Law, and her B.A., summa cum laude, from Mercer University.

Carmen Lyles-Irving is a former USPTO examiner in the Chemical and Materials group, and a registered patent attorney with extensive experience in the chemical arts. She has patent application experience specifically in the areas of tobacco, glass manufacturing, and non-metallic processes (ceramics), as well as engineering experience in the chemical and mechanical industries. Admitted to practice in Georgia, the Supreme Court of Georgia, and before the U.S. Patent and Trademark Office, Lyles-Irving earned her J.D. from University of Georgia, an M.B.A. from University of Georgia, and a B.S., magna cum laude, from Florida A& M Univercity.

Employee Retaliation Claims Are on the Rise, But Rules Are in Flux, NYU Conference Told
Sullivan & Cromwell LLP special counsel John Fullerton was quoted in an article on the proceedings of the 60th Annual New York University Conference on Labor, at which the topic was retaliation and whistleblower claims. Mr. Fullerton's presentation on the scope of protection for whisteblowers under the Sarbanes-Oxley Act was summarized in some detail, including his explanation that whistleblowing generally will not be protected under the Act unless it relates in some manner to fraud against the shareholders of a public company; that the fraud must be occurring or imminent — an employee complaint about conduct that might some day become fraud, or concern about preventing future misconduct, is not enough to trigger SOX's protections; that concealment of a single employment-related complaint or lawsuit likely would not be sufficient to establish the required fraud against investors, and that "a compelling argument can be made that activity within the scope of an employee's normal job duties should not qualify as protected activity under SOX."

Salans received the eCopy Best Practices Award on May 15th in Miami, Florida
Salans received the eCopy Best Practices Award on May 15th in Miami, Florida. The prize recognized the firm for the successful implementation of the eCopy technology and for the proper use of this new system of scanning. The firm was also acknowledged for all of its technological efforts in terms of the successful implementation and control over these tools.

In its second year, the eCopy Best Practices Award program honors select companies who best demonstrate innovation in using office copiers and scanning to capture paper-based information into electronic business processes. These companies have harnessed the capabilities of eCopy technology to achieve outstanding business productivity improvements and return on technology investments.

In front of an audience of 400 people, Marcel Henri , Global IT Director, accepted the eCopy Best Practices Award on behalf of the firm. He then participated in the debate, "the virtualization of information and document management."

Robert Gault to Speak on Mass Health Care Reform and Employer Requirements and Responsibilities
Mintz Levin attorney, Robert Gault, will discuss employer requirements and responsibilities under the law, the status of regulatory guidance, how employers are reacting, and steps employers need to take now. Bob is a member in the firm's Boston office and practices in the Employment, Labor and Benefits Section. He regularly counsels employers on all facets of employment law including hiring, disciplinary and termination issues, employment policies, handbooks, disability and leave issues, and also negotiates executive employment agreements on behalf of both employers and senior executives. He serves as the firm's advisor for selecting EPLI insurance. Bob has frequently represented employers in planning and implementing reductions in force, severance arrangements, wrongful termination and discrimination suits, union organizing campaigns, arbitrations, and litigation arising from employment disputes. Bob also has considerable experience advising clients on their internal and external response to the crises generated by employee misconduct. He works closely with colleagues at ML Strategies on client matters which involve government relations, media relations and crisis communications. He has represented businesses of all sizes, including small entrepreneurs and Fortune 500 companies. He has taught seminars for attorneys and human relations personnel and has lectured on employment law to business groups.

U.S. Attorney's Office Veteran Joins Washington, D.C. Office
"The international law firm of McDermott Will & Emery is pleased to announce that Roy L. Austin, Jr., a veteran of the U.S. Attorney’s Office for the District of Columbia, will be joining the Firm’s Trial Department as a partner. Mr. Austin focuses his practice on investigating and prosecuting civil and white-collar criminal cases.

As a Senior Assistant U.S. Attorney, Mr. Austin prosecuted cases involving federal program theft, money laundering, health care fraud, identity theft, mail and wire fraud and tax offenses as well as homicide, sexual abuse and child prostitution.

“Roy will be a great asset to the Washington, D.C. office,” commented Jeffrey E. Stone, head of the Firm’s Trial Department. “Mr. Austin joins an array of former senior prosecutors from U.S. Attorney’s Offices across our practice. He is a significant attribute to our practice specifically in regard to government-related investigations.”

From 1995-2000, Mr. Austin was a senior trial attorney with the U.S. Department of Justice, Civil Rights Division, Criminal Section where he investigated and prosecuted violations of the federal criminal civil rights statutes in federal courts across the country. While with the Criminal Section, he conducted numerous jury trials and approximately 15 grand jury investigations. He also spent two years as an associate with a San Francisco law firm where he worked on civil and white-collar criminal cases.

Mr. Austin has been the recipient of several awards and honors from the U.S. Attorney’s Office for the District of Columbia and the U.S. Department of Justice, Civil Rights Division, Criminal Section. He graduated from the University of Chicago, where he was honored with the Hinton Moot Court Competition Finalist’s Prize. He is an adjunct trial advocacy professor at George Washington University Law School and Washington College of Law at American University. Mr. Austin is admitted to practice in Illinois and California.
