Fried Frank Represents Forest City Ratner Companies In Winning Dismissal of Eminent Domain Lawsuit Against Atlantic Yards Development in Brooklyn
Fried Frank represented Forest City Ratner Companies in winning the dismissal of the most significant lawsuit against the $4 billion Atlantic Yards development in Brooklyn. The lawsuit stemmed from the potential condemnation of about a dozen businesses and homes to make way for the 22-acre project, which state officials approved late last year. The owners of the homes and businesses claimed that their constitutional rights were violated by the planned condemnation of their property, arguing that there was no real public benefit to Atlantic Yards, only a personal benefit to the developer, Forest City Ratner. The United States District Court for the Eastern District of New York dismissed the constitutional claims, finding that Atlantic Yards meets the public use standard for eminent domain as a matter of law and that plaintiffs' allegations that the condemnation was approved solely to benefit Forest City Ratner were so conclusory and baseless that they did not meet even the liberal pleading requirements of the Federal Rules of Civil Proceedure.

Real estate partner Richard G. Leland (NY) was co-counsel for Forest City in the litigation.
