The Standard Quotes Pfundstein on Amended NH Insurance Bill
Attorney Donald Pfundstein was asked to comment on the amended New Hampshire Senate Bill 188 by insurance industry weekly newsletter, The Standard.

The news item: Amended N.H. Bill Accepted by Insurers, Agents covers progress of Senate Bill 188 which boltsers department authority to fine and retains the consumer protection exemption. The entire article is available as a downloadable reprint.

Pfundstein, who was asked to comment on the bill's amendments said that the "original bill is not about the consumer; it's about money and leverage." The amended bill provides the Insurance Department with the ability to help consumers, "instead of encouraging litigation." Pfundstein added, that the amended bill is "focused on the consumer as opposed to the trial bar."

Van Buskirk Presents on Green Card and Immigration Issues at ARDA New England Meeting
Attorney Laurel Van Buskirk, an employment attorney at Gallagher, Callahan & Gartrell, presented this week at the American Resort Development Association's (ARDA) regional meeting in Providence, Rhode Island. Van Buskirk was a speaker and panel member for the informational session, Green Card-what?! Proper Hiring and Compliance in the Workplace.

According to Van Buskirk, “As employers seek new ways to fill hiring needs, it is important that they remain vigilant to ensure compliance with the multitude of laws and rules that affect all aspects of the hiring process, including those governing immigration.”

Greenberg Elected New Castle County VP of Delaware State Bar Association
Matthew M. Greenberg of Connolly Bove Lodge & Hutz LLP was elected to the Executive Committee of the Delaware State Bar Association as Vice President of New Castle County on June 6, 2007 at the DSBA’s annual meeting.

Mr. Greenberg, a partner in the firm’s Business Law Group, has been a dedicated member of the Delaware Bar Association since 1997, having served recently on the Alternative Entity Subcommittee of the Corporation Law Council, the Governance Committee and the Community Service Committee.

Since 2001, Mr. Greenberg has served in various capacities on the Executive Committee, including terms as Treasurer, Secretary, Assistant Treasurer and Assistant Secretary. As Co-Chair of the Community Service Committee, Mr. Greenberg has helped to organize several successful events, including the Race Judicata, which has raised over $50,000 to benefit The Delaware Law Related Education Center, Inc., Make-A-Wish Foundation, Child, Inc., and other worthy charitable causes since 2002.

ITC Bans Importation Of Phones With Qualcomm Chips
A conflicted federal trade agency on Thursday banned the importation of mobile phones, personal digital assistants and other handheld devices which contain Qualcomm Inc. chips into the U.S. but limited the ban to new models which had not previously been introduced for sale in the country.

Smith Brittingham of Finnegan Henderson said the order will likely withstand any appeal. “It’s unlikely the order will be disapproved by the President. It happens so rarely and the Commission has insulated this decision in some ways by allowing so many people to present evidence and coming up with this compromise that tries to balance the needs of the patent holder and public interest,” Brittingham said. “It’s difficult to criticize the Commission for what it has done from the overall policy standpoint.” He said unless a stay is granted, an appeal would not be effective because it would be a two year process, and at the end, the phones would likely be off the market or obsolete.

“Qualcomm seems to suffered a blow. The ball is starting to roll downhill in Broadcom’s favor,” Brittingham said. “It’s a lot to overcome and might precipitate a settlement.

ITC Imposes Partial Import Ban On Qualcomm Chips
The International Trade Commission on Thursday imposed a partial ban on the imports of third-generation, or 3G, cellular phones using Qualcomm Inc.’s microchips in a ruling over a patent dispute between the company and rival Broadcom Corp. The decision means that all major cellular phone handset makers using Qualcomm’s microchips in their 3G phones will no longer be able to import new models of their phones into the U.S. after June 7. New phones that are of the same model as those manufactured before June 7 will still be allowed into the country.

Smith Brittingham of Finnegan Henderson said he was surprised by the decision, since neither party or the staff attorney at the ITC had proposed a grandfather clause. “The ruling suggests that if a handset maker shoves in a new memory chip or camera into an existing model, it essentially becomes a different model and is banned from importation,” Brittingham said. Also, the ban on chips used for testing will interrupt the development and testing of new phones. He said the ruling may force Qualcomm’s hand and compel it to seek a settlement with its rival chip maker.

Previously she was a founding partner of Winkler & Worthen in Marblehead, Massachusetts, where she focused her practice on estate planning and estate & trust administration for clients in Massachusetts and New Hampshire.
