Minnesota Thrive Initiative Announces Robins, Kaplan, Miller & Ciresi L.L.P. Foundation Support
When Minnesotans concerned about early childhood education and health issues get together, big things begin to happen. The Minnesota Early Childhood Initiative is encouraging action in the area of Early Childhood mental health; many are now taking note and joining in with Greater Minnesota coalitions.

The Robins, Kaplan, Miller & Ciresi L.L.P. Foundation for Education, Public Health and Social Justice has added its support for the Minnesota Thrive Initiative with a grant of $100,000.

The overarching goal of the Thrive Initiative is to create seamless systems or networks of local services that support the healthy social and emotional development of Minnesota's youngest children ages 0-5, with a special emphasis on the 0-3 population.

The Robins, Kaplan, Miller & Ciresi L.L.P. Foundation grant will advance the implementation of the strategic action plans of the six pilot communities. Resources from the Robins, Kaplan, Miller & Ciresi L.L.P. Foundation will be used for local activities focused on the social and emotional development of young children and their families. The Minnesota Thrive Initiative is a project of the Minnesota Initiative Foundations (MIFs).

"We are pleased to be able to offer support to the Minnesota Thrive Initiative. The Robins, Kaplan, Miller & Ciresi L.L.P. Foundation for Education, Public Health and Social Justice places a strong emphasis on education and health issues and we recognize that we need to do what we can to make a difference. These children are our future," states Michael V. Ciresi, board president and chairman of the Foundation and chairman of the executive board for the law firm.

An urgent and compelling need has emerged through data collected over the past four years by coalitions in the Minnesota Early Childhood Initiative, also funded in part by Robins, Kaplan, Miller & Ciresi L.L.P. Communities across Greater Minnesota voiced a need for stronger resources in support of early childhood mental health, which is synonymous with the social and emotional well-being of infants, toddlers, preschoolers, and their families. Communities all over the state made it known that young children and their families need more and better resources for the prevention of behavioral and emotional problems and appropriate therapeutic intervention when problems occur.

The Minnesota Thrive Initiative - a statewide effort promoting the healthy social and emotional development of our youngest children, was designed to address this need. One pilot site in each of the six MIF regions has initiated an Action Team made up of local individuals caring for and caring about young children and their families. Each team's work is to develop local networks of services that support the healthy social and emotional development of young children. The planning and development stage has been funded by a generous grant from the Bush Foundation.

According to Lin Backstrom, the early childhood development specialist with the Northwest Minnesota Foundation, Robins, Kaplan, Miller & Ciresi L.L.P. has been a powerful partner in the MIFs Early Childhood Initiative.

Backstrom said, "Now, we welcome their presence in our work with the Minnesota Thrive Initiative. Robins, Kaplan, Miller & Ciresi L.L.P. funds are directed to the strategic action plans of each unique pilot site." She added, "As communities develop a particular continuum of care for their young children, Robins, Kaplan, Miller & Ciresi L.L.P. will be there with them."

In addition to the local teams, a statewide network made up of representatives from the six pilot site teams, the MIF Central Coordination Team and a group of statewide early childhood mental health agency partners are being developed. This Statewide Learning Community will share best practices, provide training and contribute to early childhood mental health system-building efforts in Minnesota.

Through the Thrive Initiative, communities across Greater Minnesota will become better equipped to nurture the social and emotional well-being of their youngest citizens. This effort will involve a broad array of local citizens, representing organizations that serve young children and their families, in creating a local network of community support and services focused on social and emotional well-being of young children

Firm Attorney Kathleen Flynn Peterson Recognized as a "Most Influential Woman Lawyer"`
Robins, Kaplan, Miller & Ciresi L.L.P. is pleased to announce that Kathleen Flynn Peterson has been recognized by the National Law Journal as one of the ‘Most Influential Women Lawyers.'

Flynn Peterson is a partner whose practice focuses on representing individuals and families who have experienced injury or death as a result of medical negligence.

"Kathleen is completely dedicated to making a difference by helping protect her clients' rights. She is one of the outstanding trial lawyers in the nation and a role model for other women in the profession to emulate," said Michael V. Ciresi, the firm's chairman. "We are very pleased and proud that she is among this list of outstanding women lawyers."

Flynn Peterson has had a long involvement with the American Association of Justice (formerly ATLA). Currently she serves on the Executive Committee as president-elect, and her term as president begins July 2007. A member for more than 20 years, she is on the Board of Trustees of AAJ's National College of Advocacy and has served in numerous leadership capacities on various committees. In 1999, she was honored with the Association's prestigious Lifetime Achievement Award.

She began her career and patient advocacy as a registered nurse and was one of the firm's first dual-profession attorneys when she joined in 1981 as an associate. She has since secured millions of dollars on behalf of her clients, helping them achieve a measure of justice for their malpractice and negligence claims.

Many prestigious and invitation-only trial lawyer organizations have commended her professional achievements. She has been inducted as a fellow to the American College of Trial Lawyers, International Academy of Trial Lawyers, and the International Society of Barristers. In addition, she is an Officer and Member of the Executive Committee, and past president (1995), of the Minnesota Trial Lawyers Association. She also is a former Minnesota Chapter President (2005) of the American Board of Trial Advocates and is certified as a Civil Trial Specialist by the Civil Litigation Section of the Minnesota State Bar Association. In addition, Ms. Flynn Peterson is past chair of the firm's medical malpractice and personal injury national practice sections. She also has served multiple terms on the firm's executive board.

Attorney Marla Butler Honored with One Child, One Lawyer Volunteer of the Year Award
Robins, Kaplan, Miller & Ciresi L.L.P. is pleased to announce that Marla Butler, a partner in the firm's Atlanta office, is the recipient of the annual "One Child, One Lawyer Volunteer of the Year" Award, which honors the attorney who has provided outstanding pro bono legal services and advocacy for abused and neglected children in foster care. Butler received the honor from the Atlanta Volunteer Lawyers Foundation during the annual Atlanta Bar Association's Awards Luncheon meeting on May 22.

"We are so pleased that Marla is being honored as this year's recipient of this deserving award," says Lisa Heller, managing partner of the firm's Atlanta office. "Marla chairs our office's Pro Bono efforts, and she has done a great job getting everyone involved in this project. She has a strong and determined passion to help protect children's rights, particularly for adolescents. Our firm is the only one reaching out to teenagers, a greatly underrepresented group in the region, and this is due to Marla's advocacy. We are very proud of her."

Robins, Kaplan, Miller & Ciresi L.L.P. adopted the Youth Law Initiative in 2005 as a firm-wide pro bono project devoted to safeguarding the legal rights of children and teens. Each office has a YLI representative to coordinate these youth-oriented pro bono cases, tailored to meet the needs of the local community. Butler selected this program for the firm's YLI project in Atlanta as a way to help local teens in foster care, a group she identified as particularly needing legal representation. Directed by Atlanta Volunteer Lawyers Foundation, the One Child, One Lawyer Program provides volunteer advocate attorneys for children who are victims of abuse or neglect and currently living in foster care.

Butler has facilitated the program in the Atlanta office since late 2005, working with the attorneys to get involved. As examples of the kind of work done on behalf of these adolescents, the Atlanta office has taken on cases involving teen mothers in the foster care system regarding their infants, and foster teens' rights regarding their education, foster home placements and other legal needs.

Butler focuses her practice on intellectual property. In addition to patent litigation experience, she has been the lead lawyer in matters that have been resolved by trial, mediation and arbitration. She is on the Board of Directors for Atlanta Volunteer Lawyers Foundation. She received her B.A. from Cleveland State University and her J.D., cum laude, from Florida State University College of Law.

Alaskan Honors for Jones Day Pro Bono Work
The Alaska Legal Services Corporation awarded Jones Day a Certificate of Merit last month in recognition of the firm's hundreds of pro bono hours spent on a case involving Alaska's treatment of Native American children in the State's foster care system. The plaintiffs in this lawsuit – the Native Village of Curyung and other Alaskan Tribes – contend that Alaska's Office of Childrens' Services violates numerous federal laws relating to foster care, including the Indian Child Welfare Act and the Adoption Assistance Act. Plantiffs seek broad institutional changes in the way Alaska treats native children who are entrusted to State care.

The State filed two separate motions to dismiss. A team comprised of DC partners Ted Bilich and Jonathan Berman, Shanghai partner Peter Wang, and DC associate Chris Farrell worked on the plaintiffs' opposition papers. After Bilich successfully defended the Tribes' complaint in the trial court, the Alaska Supreme Court granted interlocutory review. Bilich then argued for the Tribes in the Alaska Supreme Court. In December 2006, the Alaska Supreme Court unanimously ruled that the Tribes' claims can proceed to trial. The case is now in discovery in superior court in Anchorage.

Bob Klonoff Becomes Dean of Lewis & Clark Law School
Robert H. Klonoff will become the new dean of Lewis & Clark Law School. Founded in 1884, Lewis & Clark Law School is a private, ABA-accredited school located in Portland, Oregon. The law school has several programs that are nationally recognized, including its top-ranked environmental law and legal writing programs.

Bob was a Partner at Jones Day for approximately 15 years before becoming the Douglas Stripp/Missouri endowed professor of law at the University of Missouri-Kansas City School of Law. He continued as Of Counsel to the Firm during his tenure at University of Missouri-Kansas City School of Law, but his new responsibilities as Dean of the Lewis & Clark Law School will, unfortunately, not permit him to remain in private practice. Bob is a nationally recognized expert on class actions, having literally "written the books" on the subject, including Class Actions and Other Multi-Party Litigation in a Nutshell (Thomson West, 3d ed., 2006) and Class Actions and Other Multi-Party Litigation: Cases and Materials (Thomson West, 2d ed., 2006), which he coauthored with Jones Day partner Ted Bilich and Catholic University professor Suzette Malveaux.

Jones Day Obtains Antitrust Win in Refining Industry Merger
In a rare litigated merger case, Jones Day obtained clearance for its client, Giant Industries, Inc., to proceed with its merger with Western Refining, Inc. Both Giant and Western operate petroleum refineries in the Southwest United States that serve, among other areas, Albuquerque, New Mexico. The transaction, which is valued at approximately $1.4 billion, originally was announced in August 2006. After an extensive investigation under the Hart-Scott-Rodino Act, the Federal Trade Commission sought to enjoin the transaction in the U.S. District Court in New Mexico in April 2007. Following a one-week hearing, Judge James Browning denied the FTC's request for a preliminary injunction on May 29, 2007. With the 10th Circuit denying an injunction pending appeal on May 31st, Giant and Western have now been able to complete their transaction. Jones Day represented Giant throughout the merger review process and litigation.

Judge Browning's decision directly refutes the FTC's theory of harm, which was that absent the merger Giant would cause gasoline prices to decline substantially in the Albuquerque area as a result of expected modest increases in gasoline supply from Giant's refineries in the Four Corners area of New Mexico and that with the merger the combined company would prevent the price decrease (and possibly even cause a price increase) in the Albuquerque area. Although the court found that Giant and Western were competitors in the supply of gasoline to Albuquerque, the court concluded that, based on the evidence brought forth by Giant and Western, the companies did not have the ability to affect market prices (either up or down) in the manner the FTC claimed. Therefore, Judge Browning concluded that the transaction was not likely to harm competition and that a preliminary injunction to block the transaction was not warranted.

The Jones Day team on this case included Tom Smith, Hugh Whiting, James Teater, Peter Love, Jonathan Berman, Bruce McDonald, Rebecca Egeland, Hugh Hollman, Jack Edwards, Patrick Hubbard, and Dara Lutz.

Mitz who was assisted by Angela Bernardi, Richard Meamber, and Jessica Belskis. Phil Proger, assisted by Peggy Ward and Bill Kearney, and Thomas Jestaedt assisted by Markus Brune helped obtain antitrust clearance in the U.S. and Germany.
