Foley DC Office Supports the Institute for Responsible Citizenship (IRC)
Foley Washington, D.C. attorneys will spend three evenings discussing a range of legal topics with students from the Institute for Responsible Citizenship, an organization that provides fellowships to outstanding African-American males in their sophomore and junior years in colleges nationwide.

Partner Jim Bierman and Senior Counsel Ed Polk are leading Foley's initiative. Men from the program will come to the office for dinner and seminars on topics such as intellectual property rights, government regulation, laws affecting international business, and litigation trends. Foley "faculty" will include Norm Rich, Ric Henschel, Sharie Brown, Steve Lambert, Paul Monsees, Irwin Raij and Jack Lahr.

The institute, which began in 2003, will bring 34 men this summer to Washington, D.C., for a rigorous eight-week program. The men will take courses for college credit at Georgetown University and serve internships for government agencies and professional service organizations.

Foley Receives Outstanding Achievement Award for Pro Bono Efforts
The Washington Lawyers' Committee for Civil Rights and Urban Affairs will present an Outstanding Achievement Award to Foley for its pro bono efforts on behalf of the Committee's Public Accommodations Project. The award recognizes the firm's work representing plaintiffs in four civil actions against the Waffle House restaurant chain and its franchisees. (The suits alleged that the eatery engaged in race-based discrimination in its provision of services in violation of public accommodations laws. The cases have now been settled.)

Efforts on these matters were led by Jack Lahr, Ken Krosin, Larry Shatzer, Brian McNamara and Gary Zinkgraf, and more than 20 individuals across Foley offices and departments worked on the cases.

Jack Lahr and Steve Lambert will accept the award on the firm's behalf at the Committee's Wiley A. Branton Awards Luncheon taking place at the Grand Hyatt Washington Hotel. The event is expected to draw approximately 800 attendees.

The Washington Lawyer's Committee for Civil Rights and Urban Affairs is one of the premier providers of pro bono legal services in the Washington, D.C. area. Foley Partner Jim Bierman previously served as co-chair of the organization.

T&K Ranks Among Top Law Firms
In a new study, the international law firm of Thompson & Knight LLP is named as one of the top 40 firms in the U.S. based on growth in three key financial performance measures.

Applying similar principles to those used to evaluate the performance of public corporations, The American Lawyer's editorial staff tracked law firms' growth in financial returns and earnings during the past four years based on three categories: revenue per lawyer; profits per partner, and compensation for all partners. The study computed the average growth in each category for the time period of 2002-2006 for each of the nation's largest 200 firms and arrived at a comprehensive numerical score, which was then ranked on the "Growth Index" chart published in the June issue.

"We're pleased to be recognized for our consistent performance in recent years based on this type of objective criteria," said Pete Riley, managing partner of the Firm. "Continued growth is important in attracting and retaining the very best attorneys, and as a result providing high-quality and value-oriented service to our clients.

Simpson Thacher Achieves Significant Trial Victory for MasterCard
The firm recently achieved a significant trial victory for MasterCard International, Inc. in its challenge to a Visa U.S.A., Inc. by-law that prevented large Visa debit card issuing banks from switching from Visa to the MasterCard network. MasterCard's action against Visa came in the form of a motion to enforce the Final Judgment entered in the Department of Justice's antitrust enforcement case against Visa and MasterCard. In that underlying litigation, Southern District of New York Judge Barbara S. Jones ordered that Visa and MasterCard may not pass any rule or engage in any practice that would prohibit a bank from issuing debit or credit cards on a competing general purpose card network. Shortly after Visa's $2 billion settlement of the Wal-Mart antitrust class action litigation in 2003, Visa passed its "Settlement Service Fee" by-law, which imposed a hefty penalty fee on Visa's top 100 debit issuing banks if any of those banks switched their issuance to a competing network such as MasterCard.

In a decision handed down on June 7, Judge Jones found in MasterCard's favor in every respect. The Court found that Visa's by-law is a violation of the Final Judgment and ordered Visa not only to repeal the exclusionary by-law, but also to grant all banks subject to Visa's by-law a right to terminate their debit issuance agreements if they desire to switch to MasterCard. The decision follows extensive proceedings over the past four years, including a trial before Special Master Paul Shechtman in late 2006 and post-trial briefing before the Special Master and Judge Jones through 2006.

Peter Thomas, Joe Tringali, Arman Oruc, Juan Arteaga, Andy Lacy, and Scott Bulcao represented MasterCard, with invaluable assistance from litigation assistants Bill van Opstal and Anne Alfano.

Dean Franklin, Tim Krieger Win National Writing Award
An article by Dean Franklin, partner, and Tim Krieger, associate, both of whom practice in the Firm’s Intellectual Property area, won a Burton Award for Legal Achievement, as bestowed by the Burton Foundation in association with the Library of Congress. The award-winning article is titled "Liability of Computer Maintenance Providers Under Copyright Law: Storage Tech. Corp. v. Custom Hardware Eng’g & Consulting, Inc."

The Burton Awards honor attorneys "who use plain, clear and concise language and avoid archaic, stilted legalese." Thirty partners in the top 1,000 firms in the nation will receive the award this year. Tim and Dean will accept the award during a black-tie banquet held in the Great Hall of the Library of Congress in Washington, D.C. on June 4, 2007.

David Straus Wins ABM Tom Tully Award
David Straus, partner in charge of the Firm's Washington, D.C. office and Washington Counsel for American Business Media (ABM), was presented a Thomas W. Tully Award by ABM at its Spring Meeting on May 7, 2007, in Naples, Florida. This honor, named for a long-time employee of McGraw-Hill, recognizes "outstanding service to the business information industry." David was acknowledged for "his continued insights, correspondence, and legal prowess." He won the inaugural award in 2000. Last year's award was given to Postmaster General John Potter.
