Carlton Fields Shareholder, Gregory M. Cesarano, Spoke on Volunteerism and the Act of Giving
Carlton Fields Shareholder, Gregory M. Cesarano, was asked to speak at the Atlantic Coast Conference Alumni Directors’ Conference. Cesarano spoke on Volunteerism and the Act of Giving.

A Florida Bar Board Certified Civil Trial Lawyer in 1983, Cesarano is the Products and Toxic Tort Liability Practice Group Leader. Through his practice he represents product manufacturers, insurers, and property owners. Cesarano received a B.A. from the University of Florida in 1968 and a J.D. from the University of Miami School of Law in 1976.

Carlton Fields Attorney elected President-Elect of the Florida Association of Women Lawyers
Carlton Fields Miami Shareholder Amy E. Furness has been elected President-elect of the Florida Association for Women Lawyers (FAWL). Furness previously held the position of Treasurer for FAWL and currently serves as their liaison to the National Conference of Women’s Bar Associations. Before joining FAWL’s statewide board, she was a member of the Board of Directors for the Miami-Dade Chapter and also served as their newsletter editor.

FAWL, formed in 1951, is the largest alliance of women lawyers in the State of Florida. As President-elect, Furness will work to promote FAWL’s mission of supporting the contributions of women in the legal profession, improving the administration of justice, promoting the study of law and improving relations between the Bar, judiciary and the general public. Her one-year term will begin on June 28, 2007 and she will then become President the following year.

Furness focuses her practice primarily on commercial, environmental, and products liability litigation. She defends a diverse clientele including both domestic and foreign corporations. She also serves as national coordinating counsel as well as regional counsel on a variety of complex civil matters throughout the United States.

Baker & McKenzie’s IP Cases Showcases as the Top 10 Intellectual Property Protection Cases in China
Baker & McKenzie is pleased to announce that China’s Supreme People’s Court (“SPC”), the highest judicial agency in the country, elected three intellectual property infringement cases coordinated by the firm as among the “Top Ten Cases of 2006”. The three cases involved clients Sony, Starbucks and a coalition of luxury goods and fashion companies.

The SPC selected these cases to encourage local courts to follow best practices in IP protection, as well as to demonstrate to foreign companies that they too can enjoy the same level of intellectual property protection as their Chinese counterparts in China.

Details of each case are as follows:

• Sony Corporation v Guangzhou Top Power Electronics Co., Ltd. - The Firm represented Sony and won the lawsuit against Guangzhou Top Power Electronics Co. Ltd , a Guangdong-based camcorder batteries manufacturer, for counterfeiting the SONY trademark and infringement of its patent rights. Sony sought and was granted a preliminary injunction. The Guangzhou Intermediate People’s Court at a full hearing ordered Top Power Electronics to cease infringement, destroy stocks and moulds and pay Sony RMB600,000 in compensation. The Courts also assisted Sony in executing and collecting on the judgment.

Although an appeal was later filed by the defendant, the SPC affirmed the lower court’s decision of issuing an injunction and determination of infringement. This case has been used by the higher judiciary to encourage lower courts to overcome their conservatism in reviewing and granting preliminary injunctions.

• Starbucks v Shanghai Xinbake Coffee Shop Ltd. – The Firm assisted Starbucks in suing Xinbake on the grounds of trademark infringement and unfair competition for its use of an identical Chinese trade name to Starbucks’, as well as a conspicuously similar green and white logo with a steaming cup of coffee in place of the Starbucks emblem’s wavy-haired ‘mermaid’. The Shanghai No. 2 Intermediate People’s Court awarded our client, Starbucks, a verdict of RMB500,000 (approx US$60,000) and ordered the defendant to apologize in the local newspapers. The court also declared “Starbucks” and its Chinese equivalent “Xing Ba Ke” as well-known trademarks. The ruling was upheld by the Shanghai Higher People’s Court, and the appeal was dismissed. This case was also recognised as a “Top Ten” case by the Shanghai Higher People’s Court.

• Prada, Chanel, Gucci, Burberry and Louis Vuitton v Beijing Xiushui Haosen Clothing Market (also known as “The Silk Market” case) – The Firm represented five leading luxury goods and fashion brands in an action against the landlord of the infamous “Silk Market” Shopping mall where counterfeit goods were sold. The Intermediate and Higher People’s Courts both confirmed that the landlord was jointly and severally liable for failing to stop infringements by vendors after being notified of them, making this the first time a landlord is held responsible for the illegal activities of their tenants in the judicial history of China. This case was also recognized as a “Top Ten” case by the Beijing Higher People’s Court as well as the Quality Brands Protection Committee (“QBPC”), an industry association comprised of more than 170 internationally well-known foreign companies. Since 2002, the QBPC annually gives out “Best Cases” awards to model agencies that have demonstrated initiative, efficiency, effectiveness, and innovation in combating intellectual property infringement in China.

Baker & McKenzie Act in First Claim for Judicial Review Brought Under the Gambling Act 2005 to Regulate British Casinos
Baker & McKenzie LLP's Public Law team acted successfully for the British Amusement Catering Trades Association ("BACTA") and a number of their individual members in their intervention in the Judicial Review brought by the British Casino Association and major casino operators against the decision of the Secretary of State for Culture, Media and Sport.

The Secretary of State's decision concerned the entitlement of current casinos to operate gaming machines with prizes of up to £4,000. Mr Justice Langstaff delivered Judgment on 11 June dismissing the claim. This is the first claim for Judicial Review brought under the Gambling Act 2005, which provides a new scheme to regulate gambling in the UK covering gaming, betting and lotteries.

The case was handled by Tom Cassels, Head of the Public Law Group and senior associate Len Murray and associate Francesca Richmond. Counsel were Dinah Rose QC and Brian Kennelly of Blackstone Chambers. The Public Law Team has considerable experience of high profile Judicial Reviews and has seen a growth of work in the gaming sector of the leisure industry since the introduction of the Gambling Act 2005.

Baker & McKenzie's Warsaw Office Appoints New Managing Partner
Baker & McKenzie Gruszczynski & Partners Attorneys at Law LP has appointed Marek Rosinski as its new managing partner.

Baker & McKenzie is the second largest and most dynamically expanding international law firm in Poland, according to Rzeczpospolita, one of the country's national newspapers.

Commenting on his appointment, Marek said: ''My appointment as managing partner at Baker & McKenzie is a true honor and at the same time a great challenge, especially as the number of lawyers in our office has just passed a hundred.''

Marek has been a qualified legal advisor since 1992 and heads the 14-strong intellectual property and IT practice group. He has advised on the largest IT and outsourcing projects in Poland. He is also highly experienced in intellectual property law issues, in particular copyright and trademarks.

The Warsaw Office's intellectual property and new technologies practice group topped the prestigious Chambers Europe 2007 and Marek has been recommended in his area of expertise by the Legal 500 legal directory.

Linda Rigsby Joins Williams Mullen as Of Counsel, Director of Client Relations for Financial Services Industry
Williams Mullen announced today that Linda F. Rigsby has joined the firm as of counsel and director of client relations for the financial services industry. In this role, Ms. Rigsby works with banks, other financial institutions and attorney teams to address legal issues in the financial services arena. She brings more than 25 years of experience to the position as both a banking insider and corporate attorney.

Ms. Rigsby began her career in 1981 as a trusts and estates attorney. In 1985, she joined Crestar Financial Corporation as deputy general counsel and corporate secretary. Ms. Rigsby stayed with the organization following its acquisition by SunTrust Banks, Inc., rising to the position of senior vice-president and deputy general counsel until her retirement in 2006. She was responsible for the fiduciary and real estate legal teams for SunTrust in its nine-state footprint. She also managed the SunTrust Mid-Atlantic Legal Department, which handles retail and commercial bank matters in North Carolina, Maryland, Virginia and Washington, D.C. Her responsibilities included management of outside counsel relationships, major defendant litigation, and a multi-million dollar annual legal budget for SunTrust Mid-Atlantic.

Ms. Rigsby is licensed to practice in Virginia and the District of Columbia. She regularly holds leadership roles in legal, community and business organizations. She received her J.D. degree from the University of Richmond School of Law and her B.M. degree from Virginia Commonwealth University.
