Qualcomm Hit With ITC Exclusion Order
Qualcomm is to appeal a ruling that will prevent the importation into the U.S. of new phones incorporating its chips after it was found to infringe a patent owned by rival Broadcom. Smith Brittingham of Finnegan Henderson said, “This represents an effort to balance a number of different factors that each party was presenting.” Four commissioners agreed with the decision, while two favored more limited relief, arguing that exclusion of all downstream products containing the infringing chips would adversely affect the public interest.

DLA Piper hires business law and tax defence expert professor Dr Erich Samson
The leading business law and tax defence expert Professor Dr Erich Samson joins DLA Piper as of counsel on 1 July 2007. Professor Dr Samson will help to grow the German Regulatory and Governmental Affairs practice group. He will be based at DLA Piper's Hamburg office and will continue to teach at the Bucerius Law School.

On top of his academic activities, Professor Dr Samson has developed a business law and tax defence practice, advising companies. At DLA Piper, Dr Samson will build up preventive advice in regulatory risk.

His assistant at the Bucerius Law School, Dr Marc Langrock, will also join DLA Piper at the same time.

DLA Piper advises Whelan on JJB sale
a team from DLA Piper, led by Jonathan Watkins, has advised David Whelan on the sale of his £190m stake in JJB Sports.

Mr Whelan, who still owns Wigan Athletic football club and Wigan Rugby League, owned 29 per cent of the retail chain. He and his family interests sold 68.99 million shares at 275 pence each in a deal that completed late on Friday.

Icelandic financial group Exista and Christopher Ronnie, a sports retailer who has previously worked at Umbro and Sports Direct, bought Mr Whelan's stake.

Whelan, 70, is a former professional footballer with a number of clubs, including Blackburn Rovers. He set up JJB in 1971. The sports chain now has over 430 shops in the UK.

"Retiring from the board and selling my stake in the business I founded has not been an easy decision but it has been made easier by my confidence in the senior management team," Mr Whelan said.

Christopher Ronnie will become JJB's deputy chief executive, with a focus on sourcing and product development.

Jonathan Watkins commented: "I have worked with Dave Whelan and JJB now for over 15 years. I am sure that he leaves the business in very capable hands and look forward to continuing to work with the JJB executive team."

Jonathan Watkins was assisted by Yunus Maka (associate) and Kate Greenway (trainee solicitor).

Davis Wright Tremaine LLP Relocates to New Offices in 1201 Third Avenue
The national law firm Davis Wright Tremaine LLP announced today the relocation of its 500-person Seattle office to a newly designed space at 1201 Third Avenue. With approximately 170,000 square feet and eight floors equipped with the latest technologies, the new offices provide the firm with an enhanced platform for providing great service to its clients.

Partner-in-charge of the Seattle office Susan G. Duffy and real estate partner Dennis McLean led Davis Wright’s relocation planning over the past three years. “This has been a very interesting project,” said Duffy. “It’s been fun thinking about how the delivery of legal services has changed since we last built offices and anticipating the changes that lie ahead. We have tried to be smart in our use of new technologies and to seize opportunities to support principles of sustainability. This effort has also provided a great opportunity to combine efficient use of space with an aesthetic that reflects our firm culture.”

In 2004 Davis Wright (with assistance from its real estate affiliate CenturyPacific LP) negotiated a 12-year lease term from Wright Runstad to occupy space in 1201 Third Avenue that would be vacated by Washington Mutual Bank when it moved to its new building in late 2006. As it had 21 years previously, Davis Wright turned to renowned architects NBBJ to help design its new offices. “NBBJ has a wonderful way of designing spaces that are both timely and timeless,” Duffy noted. Lydig Construction served as the general contractor for the project. “Lydig bent over backwards to work with us on a very tight construction schedule,” Duffy added. The new offices provide the physical space necessary to support planned and, potentially, unplanned growth. “We originated in Seattle,” noted Duffy, “and we plan to always have the strength in both expertise and numbers to allow us to play a significant role in the issues of major importance to the Northwest.”

Stoel Rives Adds Two Principals in Sacramento Office - Lateral Hires Add Depth in Land Use Environmental and Water Law
Stoel Rives LLP announced today the addition of two principals to its growing roster of attorneys in the firm’s Sacramento office, which has tripled in size in the last three years. Timothy M. Taylor specializes in land use and environmental law and related litigation, and Kristen T. Castaños’ practice emphasizes water law related issues, as well as land use, natural resources and environmental law. They have joined Stoel Rives from Somach, Simmons & Dunn.

“Adding these well-respected attorneys to our growing Sacramento office is reinforcing our strategy to best serve our clients’ land use, environmental and water law needs in California,” said Sean McCarthy, managing partner of Stoel Rives’ California offices. “Sacramento is the hub for the state’s environmental and natural resources regulatory agencies, and is a focal point for critical environmental and energy-related issues facing the nation.”

Taylor represents private development interests in residential, commercial and industrial matters, as well as public agency clients on issues concerning the state planning, zoning and development laws and the California Environmental Quality Act (CEQA). He has served as a visiting professor at the University of California, Davis School of Law since 1994, where he teaches land use and environmental law.

Taylor is a past member of the executive committee, executive committee chair, and advisor to the State Bar of California Environmental Law Section, and separately chaired the Sacramento County Bar Environmental Law Section. He has also served as a board member for several local and national non-profits, including the Nehemiah Corporation of America, where he advocated for affordable home ownership. Taylor currently serves as an elected member of the Joint Unified School District Board of Trustees. Taylor is a graduate of Dartmouth College, and received both his Juris Doctor and Master of Arts in Architecture and Urban Planning from the University of California, Los Angeles.

Castaños is a member of the executive committee of the California State Bar Environmental Law Section and serves on the editorial board for the California Water Law & Policy Reporter. Prior to working at Somach, Simmons & Dunn, she was an associate attorney at Hatch and Parent in Santa Barbara, where she focused on water law matters. Castaños earned her J.D. from the University of California, Davis School of Law. Prior to law school, Castaños worked for the Governor's Office of Planning and Research where she was responsible for monitoring environmental documents submitted pursuant to CEQA.

“The extensive CEQA and land use experience and knowledge of these outstanding attorneys will add tremendous depth and strength to our natural resource practice which focuses on renewable energy, water and water supply issues and land use matters throughout California,” said Michael A. Campos, head of the California natural resources group.

The firm has been successful in growing its Sacramento office, particularly in the areas of energy facility siting, natural resources and water law, and environmental regulatory compliance as well as litigation related to these areas. The capital city office has grown by eight attorneys and eight staff over the last 24 months and has expanded its office space to accommodate additional growth.

Executive Compensation Expert Gregory Schick Joins Sheppard Mullin San Francisco
Gregory C. Schick has joined the San Francisco office of Sheppard Mullin Richter & Hampton LLP as a partner in the firm's Tax/Employee Benefits/Trusts & Estates practice group. Schick most recently practiced with Orrick, Herrington & Sutcliffe LLP in San Francisco.

Schick's practice focuses primarily in the executive compensation, corporate securities laws and corporate governance areas and he advises both public and privately held companies as well as individual clients. He negotiates, prepares and reviews equity compensation and change of control plans/agreements, Rule 10b5-1 trading plans along with proxy statements, prospectuses, and other filings required by the 1933/1934 Securities Acts and the national stock exchanges. Schick also regularly represents senior level executives and companies in employment and separation agreement matters and is currently engaged in the preparation of a new portfolio for the Bureau of National Affairs (BNA) on executive employment agreements.

Schick has developed numerous quantitative models to analyze, among other things, golden parachutes, personal aircraft use and other executive compensation arrangements. He has also developed automated tools for complying with the SEC's executive compensation disclosure rules.

Schick is the second Hastings graduate to join Sheppard Mullin's San Francisco office as a partner in as many months. Scott Hennigh, who received his J.D. in 1996 from Hastings, joined the firm on May 25 from Thelen Reid Brown Raysman & Steiner LLP.

Schiff Hardin LLP Honors Distinguished UCLA Law Professor Samuel C. Thompson in Conjunction with The HistoryMakers Program
Noted UCLA law professor Samuel C. Thompson Jr. will receive the first annual Wayne A. McCoy Memorial Award for distinguished African American leaders from the law firm of Schiff Hardin LLP in conjunction with The HistoryMakers African American history program. Thompson will receive the honor during a reception June 14 at Chicago’s Sears Tower.

The HistoryMakers (http://www.thehistorymakers.com/) is a national, nonprofit educational institution that produces an internationally recognized archival collection of thousands of video and oral histories of African-American leaders and luminaries.

The author of numerous books and articles on tax planning and mergers and acquisitions, Thompson is a Professor of Law and Director of the UCLA Law Center for the Study of Mergers & Acquisitions, a position he has held since 2003. He was a professor at University of Miami School of Law from 1994 to 2002, serving four years as dean. From 1991 to 2000 he served as Partner-in-Charge of the tax department at Schiff Hardin LLP in Chicago, then named Schiff Hardin & Waite.

A Vietnam veteran, Thompson served in the U.S. Marine Corps. rising to captain and earning the Navy Commendation Medal with Combat “V” for service in Vietnam. He received his law degree from The University of Pennsylvania in 1971, and his L.L.M. in Taxation from New York University in 1973. A native of Pennsylvania, he received a Masters in Business and Applied Economics from The University of Pennsylvania in 1969 and a B.S. in 1968 from West Chester University, where he played varsity football.

The award is named for the late Wayne A. McCoy, one of Schiff Hardin’s most respected partners and attorneys, who was recognized as one of the most senior African Americans in leadership positions among major law firms when he headed Schiff Hardin’s Public Law and Finance Group. A graduate of the University of Michigan School of Law, McCoy joined the firm in 1972 and died in 2000.
