Kelley Drye Represents U.S. Honey Producers in Successful International Trade Commission Review
Commissioners at the International Trade Commission (“ITC”) voted 6-0 today to continue existing antidumping and countervailing duty orders on honey from Argentina and China. The orders have been in place since 2001 in order to offset the unfairly low prices of honey imports from those two countries. The Sioux Honey Association (“Sioux Honey”) and American Honey Producers Association (“AHPA”), represented by international trade attorneys from Kelley Drye Collier Shannon, successfully prevailed upon the ITC the importance of retaining the orders during a recent sunset review.

“In 2000 and 2001, the U.S. market was overrun with extremely low-priced honey imports from Argentina and China,” said Mark Brady, president of the AHPA. “Had the government not imposed antidumping and countervailing trade orders on those imports several years ago, the domestic honey industry would have been destroyed.”

David Allibone, President of Sioux Honey, added “Sioux Honey, a member-owned marketing cooperative, is gratified that the government found ample cause to retain the trade orders against honey imports from China and Argentina. We are especially hopeful that our government will redouble its efforts to stop the continuing, rampant and deceptive avoidance of the China antidumping order by certain Chinese exporters and their U.S. importers."

In its decision to keep in place both the antidumping and countervailing duty orders, the ITC agreed that their revocation would likely lead to material injury to U.S. businesses within a reasonably foreseeable time. A review every five years of the protection measures are required by the Uruguay Round Agreement Act of the World Trade Organization (WTO). The orders will now remain in place through at least May 2012, when a second sunset review would begin. “These orders are crucial to the continued competitiveness of American honey producers in the domestic market,” said Michael Coursey of Kelley Drye Collier Shannon, who served as lead attorney for both industry associations. “They ensure that U.S. businesses are not forced to compete with unfairly traded goods.”

Mr. Coursey, a Partner in Kelley Drye Collier Shannon’s International Trade and Customs Practice Group, specializes in representing agricultural interests in international trade investigations.

Bullivant earns recognition as a leading firm in 2007 Chambers USA survey
Bullivant Houser Bailey PC has announced that the firm and six of its shareholders have been recognized as leaders in the areas of commercial litigation and employment law in the latest edition of Chambers USA: America’s Leading Lawyers for Business (2007). The recently published survey showcases the expertise of the nation’s attorneys across a variety of practice areas. The rankings are based entirely on market research and extensive interviews of both in-house counsel and private practitioners.

Six Bullivant attorneys noted as leaders in their field include: Clay Creps (Employment), Stephen English (Commercial Litigation), David Ernst (Commercial Litigation), Douglas Houser (Commercial Litigation), Chrys Martin (Employment), and Renée Rothauge (Commercial Litigation).

Bullivant’s commercial litigation group moved up to the highest tier ranking this year and is described by Chambers as an “impressive, top-quality firm…no longer just known for its insurance defense work.” Peers view Bullivant’s commercial litigators as “some of the state’s top litigators…extremely experienced team.” Stephen English has earned his reputation amongst his peers as one of the state’s top litigators, with clients saying “he is an experienced and consistent lawyer who is impressive in front of a jury and has superb judgment.” Fellow top-tier senior shareholder Douglas Houser has been praised as a commercial litigator and enjoys a "national reputation in insurance law circles." David Ernst, who specializes in food-borne illness litigation, has been described as having “developed an impressive national reputation in food outbreak disputes.” Peers who have worked with him were impressed with his “intelligence and ability to get quickly to the heart of the matter.” Renée Rothauge continues to be recognized for her work in IP and complex commercial cases for clients such as Dow AgroSciences and Columbia Helicopter.

Clients of Bullivant’s employment group told researchers how the team “stands out for its attention to detail and business aptitude.” In his second year in Chambers Clay Creps, “enjoys an excellent reputation as a top employment litigator. He has an outstanding legal mind and is an excellent communicator to lay people.” Last year, Chrys Martin’s clients described her as an “energetic, knowledgeable and approachable lawyer,” with the ability to “see the big picture, not just the issue at hand.” This year, researchers were told Martin is an “exceptional, dedicated practitioner.”

Brinks Hofer Gilson & Lione’s Christopher Harkins Receives Prestigious 2007 Burton Award for Legal Achievement
Brinks Hofer Gilson & Lione, one of the largest intellectual property law firms in the U.S., is pleased to announce that Christopher A. Harkins, counsel in the firm’s Chicago office, is a recipient of the 2007 Burton Award for Excellence in Legal Achievement in the law firm category for his article, “Tattoos and Copyright Infringement: Celebrities, Marketeers, and Businesses Beware of the Ink” which was published in the Lewis & Clark Law Review, Volume 10, pp 313-332 (2006). The award ceremonies were held on June 4, 2007, in the Coolidge Auditorium and the Great Hall of the Library of Congress in Washington, D.C.

Although written for a scholarly legal publication, Mr. Harkins’ article has crossed over into popular culture media and has been cited as “non-lawyer friendly” and “recommended” reading for a wide range of audiences. Mr. Harkins follows in the notable footsteps of Jerome Gilson, name partner of the firm and Burton Award winner for excellence in legal writing for three consecutive years, 2004-2006.

"We are proud of Chris and congratulate him on his first Burton Award, “said Gary M. Ropski, president of Brinks. “This is a significant achievement for Chris and for our firm. We look forward to his future literary contributions to the field of intellectual property law.”

Mr. Harkins focuses on litigation and patent prosecution. He has litigated in the areas of patent, trademark, copyright, tort and contracts and has prosecuted patents in the mechanical arts and medical devices. In addition, his experience has included drafting the firm’s pro bono policy and serving on the firm’s award-winning pro bono program, as well as representing many pro bono clients.

The Burton Award program receives nominations from managing partners of the nation’s largest law firms and from professors at academic institutions, representing every geographic region in the U.S. This year, of the more than 1,000 submissions received, there were only 30 awards presented.

Now in its eighth year, this national industry award program, which is run in conjunction with the Library of Congress and its Law Library, annually acknowledges and rewards concise and effective legal writing by partners in law firms and by law students. Founded by lawyer and author, William C. Burton, the Burton Foundation, is a nonprofit, cultural and academic organization. The Foundation and The Burton Awards for Legal Achievement are devoted to further promoting the stature of the legal profession.
