Landlord & Tenant Issues:Resolve Them the First Time
Attorneys Carrie Mount Roelle and Rebecca Ness Rhymer will present "Landlord & Tenant Issues: Resolve Them the First Time" on Thursday, July 26, noon until 1:30 p.m. at KDDK. Topics will include legislative updates and information on how to resolve issues relating to leases, back rent, evictions, deposits and damages. The seminar will benefit rental property owners and managers and others who deal with landlord-tenant issues and court proceedings. The event is free and a box lunch will be provided.

Worthington Elected to EBA Board of Directors
Maria Worthington was recently elected to the Evansville Bar Association Board of Directors. She will serve a three year term. Worthington is a past chairman of both the Evansville Bar Association Continuing Legal Education Committee and the Family Law Section, and has served on many bar association committees and projects over the years.

The Supreme Court’s Renewed Interest in Patent Law
O'Melveny counsel Mark Davies recently authored a cover article for a special issue of Intellectual Property Today dedicated to Supreme Court decisions and analysis. In the article "The Future of Patent Law: Understanding the Supreme Court's Renewed Interest in Patent Law," Davies identifies three messages that the Court is sending to the Federal Circuit and, by extension, to all patent lawyers: avoid "jargon" or "tests"; restrict the "subject matter" of patents; and harmonize patent law with other areas of law.

"Understanding the interplay of these themes explains why the Court is at times respectful of a Federal Circuit opinion and at other times hostile," Davies writes. "The same themes also identify future cases that are likely to interest this Court."

Shareholder Earns Outstanding Achievement Award
Shareholder Phyllis B. Schunck is the recipient of the Outstanding Achievement Award for 2007 by the Travis County Women Lawyers’ Association. The award, presented on June 15, recognizes an outstanding female attorney for her service to the profession and community.

Schunck, who earned her law degree, with honors, from The University of Texas School of Law in 1977, began her legal career as a hearing examiner for the Railroad Commission of Texas. In 1979, she joined the energy section of the office of the attorney general where she tried numerous enforcement actions and agency appeals. When she entered private practice in 1983, she began representing health care clients in addition to utility clients. In 1991, she moved her appellate and regulatory litigation practice to Clark, Thomas & Winters where she continues to work with health care industry clients and serves as the chair of the health law section.

One of Schunck’s career achievements is her 1991 supreme court victory when she successfully obtained a trial and appellate court judgment reversal at the Texas Supreme Court on behalf of Texas-New Mexico Power Company. The end result saved the company from the loss of a billion dollar power plant. Additionally, two of her appellate victories are often cited in administrative law cases as seminal authority for administrative law principals.

“A lot has changed in the practice of law over the last thirty years, especially attitudes toward females,” says Schunck. “At an interview for my first job, one of the men asked me what kind of birth control I was on and what my husband’s hobbies were. They hired four lawyers that day, including their first two female lawyers. The two women were to be paid less than the two men, until I threatened to make a stink about it, and the two women were told that they could never be promoted above the level of assistant division director.” The Travis County Women Lawyers' Association is a professional association which fosters communication among women lawyers; works toward strengthening the image and position of women lawyers in the community; works towards the elimination of gender bias; informs the public about legal issues affecting women; and works towards the enhancement of the public perception of the legal profession. Jones Day Wins Antitrust Approval For Rite Aid's Acquisitions of Brooks and Eckerd
Recently Jones Day obtained antitrust approval from the Federal Trade Commission and the attorneys general of seven states for Rite Aid Corp. to acquire from Jean Coutu Group (PJC) Inc. of Canada over 1,800 Brooks and Eckerd drug stores located in the United States. The acquisition, which is valued at $3.4 billion and gives Rite Aid over 5,000 stores, closed on June 4th.

There was considerable overlap in store locations between Rite Aid and Brooks/Eckerd. While this creates an excellent opportunity for Rite Aid to achieve synergies from the transaction, it prompted predictions that Rite Aid would have to divest a large number of stores to obtain antitrust approval. The settlement reached with the Federal Trade Commission requires the divestiture of only twenty-three stores, each in a different small community. The settlements with the states duplicate these requirements and require an additional three divestitures. As one commentator said, "[w]e view the outcome of the FTC review as a huge win for Rite Aid, as we thought the company would be required to divest 150-200 stores (many street estimates were even higher)."

Jones Day Ranks in Top Ten Nationally - Corporate Board Member Survey
Jones Day ranked #6 in Corporate Board Member magazine's annual survey of top corporate law firms. The Firm also stayed at the top of the list locally for Cleveland. This is the seventh annual survey of directors by Corporate Board Member. Jones Day has been in the top ten nationally each year, and in the top five in four of the seven years.

"Doing well in our survey has become a singular badge of honor, for the very reason that it doesn't come from the law firms' peers," said William S. Rukeyser, editorial director of Corporate Board Member.

The national ranking is based on votes received from 802 directors and 235 general of publicly traded companies by Corporate Board Member magazine and FTI Consulting, a global business advisory firm.

The Cleveland and Columbus local rankings are based on individual surveys for each market. Directors living in these areas received a questionnaire specific to their location that included a list of 20 local firms and two write-in options.

Alison Marshall and George Howard Inducted as Fellows by College of Labor & Employment Lawyers
Alison Marshall, a Partner in the Washington Office, and George Howard, a Partner in the San Diego Office, have been named newly elected Fellows by The College of Labor & Employment Lawyers. Election as a Fellow is recognition by one's colleagues of sustained outstanding performance in the profession, exemplifying integrity, dedication, and excellence.

The College was established through an initiative of the Council of The Section of Labor and Employment Law of The American Bar Association to operate as a free standing organization recognizing those who have distinguished themselves as leaders in the field.

The twelfth installation of Fellows will be held November 10, 2007 in Philadelphia, PA. Alison and George join other Jones Day College of Labor & Employment Lawyer Fellows Larry DiNardo, Sam Estreicher, Roger King, Andy Kramer, Deborah Saxe, and Willis Goldsmith.
