Henry I. Reder Named as a Leading Construction Law Attorney in the 2007 Edition of Chambers USA

Mr. Reder is also a former Professor in the College of Architecture at Kent State University, including Co-Director of the Florence Italy Program (1982).

Lawrence G. Almeda Elected to Washtenaw County Bar Association Board of Directors
Brinks Hofer Gilson & Lione, one of the largest intellectual property law firms in the U.S., is pleased to announce that Lawrence G. Almeda, a shareholder in the firm’s Ann Arbor office, has recently been elected to the Board of Directors of the Washtenaw County Bar Association (WCBA).

The WCBA strives to meet the highest standards of civility and ethical integrity of all participants in the legal process, to improve public understanding of the legal system and to advance professional development and excellence through educational programs and services for its members.

Mr. Almeda is also the chair of the Business Law Section of the WCBA, the president of the Michigan Asian Pacific American Bar Association, an alumnus of Leadership Detroit 2006-2007 and a member of the Governor’s Advisory Council on Asian Pacific American Affairs.

Mr. Almeda focuses his practice on patent opinions and prosecution in the medical, chemical, mechanical and nanotechnological arts. He received his LL.M. in intellectual property from The John Marshall Law School (Chicago), his J.D. from the University of Detroit Mercy School of Law, where he was a published member of Law Review, and received his B.S. in chemical engineering from Purdue University.

Baker & Daniels Receives Top Chambers USA Rankings
Baker & Daniels LLP has received the highest ranking in a report of U.S. lawyers and law firms for four practice areas.

In the fifth annual edition of Chambers USA: A Guide to America’s Leading Business Lawyers, Baker & Daniels’ labor & employment, litigation, real estate and corporate/mergers & acquisitions practices ranked first among Indiana law firms. In addition, 21 Baker & Daniels lawyers were recognized in the 2007 report, 10 of whom earned first-place rankings in their respective practice areas.

The guide, published by London-based Chambers and Partners, ranks lawyers and law firms based on the results of in-depth interviews with leading private practice attorneys and key in-house counsel. Rankings factor the strengths and reputations of U.S. lawyers by firm.

Energy Projects Lawyer Sean Korney Joins Baker Botts in Dubai
Sean Korney, who has built a substantial international energy practice during his 13-year legal career, joined Baker Botts L.L.P. today as a partner in the Firm’s Dubai office.

Korney has worked on major oil and gas and other energy projects and acquisitions and divestitures in the Middle East, Africa, Asia and the Americas during the past two decades. He joins Baker Botts from Denton Wilde Sapte where he led the energy practice group for that firm’s Middle East offices.“I am very happy to be joining one of the premier energy law firms in the world,” said Korney. “It is an exciting time in the energy industry and in this region.”

“Sean joins Baker Botts in Dubai at an important time in the development of our office there,” said Walt Smith, Managing Partner of Baker Botts. “He will provide a strong presence in the Middle East for our clients with business interests in the region. Sean will be a key resource for our clients.”

Stuart Schaffer, chair of Baker Botts’ Global Projects Group, said: “With Sean joining the Firm, we will accomplish one of our key strategic goals: growing our Middle East ‘hub’ office in Dubai to include an energy projects lawyer with particular upstream capability. Dubai is experiencing unprecedented growth, both as a business and financial center and as a legal market. Sean will provide our clients the necessary legal support to develop exploration and production and other energy projects.”

Korney is the second lateral hire in the past two months for the Dubai office of Baker Botts. Nigel Thompson joined the Firm in April from Shearman & Sterling. Thompson also specializes in the development of energy projects, in particular electric power, petrochemical and LNG projects, as well as infrastructure projects.

“We expect to make additional announcements regarding the continued strengthening of the Dubai office before the year is out,” Schaffer said. “One of our Firm’s goals has been to build the preeminent energy practice on the ground in the Gulf region, and with the additions of Sean and Nigel, we believe we have done just that.”

Korney received his Bachelor of Laws from the University of Calgary in 1993. He was admitted to the bar in Canada in 1994. He practiced law in Canada for seven years with Macleod Dixon and Donahue Ernst & Young. He joined Denton Wilde in 2001 in its Singapore office and relocated to that firm’s Dubai office in 2004. In 2005-06 he led the multi-jurisdictional team for ONGC Videsh, which successfully completed the acquisition (through a joint venture with Sinopec) of nearly $1 billion of oil and pipeline assets in Colombia.

He is the regional director of the Association of International Petroleum Negotiators Middle East Chapter and has been recognized in a number of publications as a leading energy and oil and gas lawyer.

Alenia Aeronautica in Russian-European Aircraft Joint Venture
Cleary Gottlieb is representing Alenia Aeronautica, a subsidiary of long-time client Finmeccanica, in its joint venture with Sukhoi Civil Aircraft Corp., a subsidiary of Sukhoi Aviation Holding, for the development of the Superjet 100, a new mid-range civilian aircraft with 75- and 95- passenger capacities. Alenia and Sukoi will use a dual joint venture structure. Alenia will acquire 25% plus one share in SCAC, a Russian company that will design, engineer and manufacture the jets. Alenia and Sukhoi Aviation will create a new Italian company with 51% and 49% shareholdings, respectively. The Italian company will be responsible for certifying, marketing, selling and delivering the Superjet 100 in western markets and for post-sales assistance worldwide. This collaboration is an important industrial partnership between European and Russian companies in the civil aviation sector. The Superjet project is expected to rejuvenate the Russian civil aviation industry. The deal was signed on June 17.

The Superjet 100 is the first civilian aircraft project of Sukhoi, a company famous for its fighter jets. Orders for at least 71 Superjets have been confirmed.

Moberg Elected to Co-Chair Family Law Section of HCBA
Joani Moberg, associate in the family law practice group, will serve as co-chair of the Family Law Section of the Hennepin County Bar Association (HCBA) for the 2007-2008 fiscal year. Her term will begin this September.

Moberg's practice concentrates on legal matters relating to marital dissolution, child custody, child support and spousal maintenance, pre-marital agreements, property division, settlement negotiations, litigation and appeals.

The HCBA Family Law Section contributes to the positive evolution of family law in Hennepin County in order to enhance the quality of justice and service available to clients.

MINNESOTA COURT OF APPEALS OPINES ON TWO COMMON AUTOMOBILE LIABILITY ISSUES
In Auto Owners Ins. Co. v. Perry, 730 N.W.2d 282 and Schossow v. First Nat. Ins. Co. of America, 730 N.W.2d 556, the Minnesota Court of Appeals offered two opinions on commonly disputed and factually-dependent issues related to automobile cases: a claimant’s qualification as a “dependant” and as a “resident.” Significant Other Is Not a Dependent Under the No-Fault Act

In Auto Owners Ins. Co. v. Perry, 730 N.W.2d 282, the Minnesota Court of Appeals held a person who is the live-in significant other of an insured and who does not meet the definition of “dependent” under the insured’s automobile insurance policy, may not receive Survivor’s Economic Loss Benefits from the insurer upon the death of the insured in an automobile accident.

In Perry, Appellant Chong Suk Perry made a claim to Auto Owners for Survivor’s Economic Loss Benefits after her significant other was killed in a December 2004 automobile accident. Auto Owners denied Perry’s request on the basis she did not meet the definition of a dependent within the meaning of the insurance policy. At the time of the insured’s death, Perry and the insured had lived together for seven years. The couple shared some expenses and a joint bank account and Perry was financially dependent on the insured due to her inadequate income. Perry sought
arbitration, which the district court stayed after Auto Owners filed a complaint in district court seeking a declaratory judgment to determine whether Perry qualified as a dependent. The district court granted Auto Owners’ motion for summary judgment, concluding Perry did not qualify as a dependent under the insurance policy, and the policy met the minimal coverage provisions required by the Minnesota No-Fault Act. Perry appealed.

The Minnesota Court of Appeals held the district court properly ruled Perry was not entitled to Survivor’s Economic Loss Benefits, because she did not meet the definition of dependent under the policy or the Minnesota No-Fault Act.The policy defined a dependent as either a surviving spouse or child of the deceased. As a significant other or live-in girlfriend, Perry did not qualify. Under the No-Fault Act, a dependent is a spouse of the deceased, or any child of a deceased parent. Minn. Stat. § 65B.44, subd. 6. Perry argued that the last sentence of the § 65B.44, subd. 6 definition, which states “[q]uestions of the existence and the extent of dependency shall be questions of fact, considering the support regularly received from the deceased” creates a broader class of dependents. The Minnesota Court of Appeals rejected the argument, concluding that absent a clear mandate in the language of an insurance policy, the No-Fault Act does not offer a broader classification of dependent. Accordingly, the district court was proper in granting summary judgment for Auto Owners.
