O’Melveny Expands International Arbitration & Litigation Practice Into London
O'Melveny & Myers LLP announced today that David Kavanagh and David Foster, partners currently with Watson Farley & Williams LLP, will be joining the Firm's London office. Mr. Kavanagh, Head of International Litigation at Watson Farley, will lead O'Melveny's London arbitration and litigation practice.

"We're delighted that David Kavanagh and David Foster, with their expertise in the international arbitration field, are joining us in London," said Chris Ashworth, co-head of O'Melveny's London office. "The addition of David Kavanagh and David Foster is a great example of O'Melveny's continuing growth in London, and their experience will complement our globally recognized litigation practice."

Steven Smith, head of the Firm's International Arbitration Group, added, "Strengthening our global arbitration practice is a key priority in our firm's strategic plan. Just last year, Michael Moser, widely regarded as one of the leading international dispute resolution lawyers in China, joined our Beijing office. David Kavanagh concentrates in the area of international arbitration and cross-border litigation. He has extensive experience in investment treaty work and international finance litigation. He regularly represents investment banks, hedge funds and other financial institutions in High Court litigation. Mr. Kavanagh has handled some of the world's most significant arbitration cases, including two cited in The American Lawyer's most recent survey of the world's most significant arbitration disputes. In addition, 4 out of the 5 Watson Farley cases noted in The American Lawyer's most recent ranking for the largest arbitration cases worldwide were led by Mr. Kavanagh. He has broad experience dealing with arbitration disputes within the energy, power and offshore and oil/gas sectors. Mr. Kavanagh has been ranked as a leading lawyer by Chambers & Partners (Global and UK editions) and Legal 500. He graduated in 1989 from the College of Law, Guildford and received his B.A. from Durham University, London in 1988.

David Foster focuses on international arbitration, with a particular emphasis on large, complex cross-border commercial disputes in the financial services sector. Mr. Foster has broad experience acting in disputes in the offshore, power and energy sectors and a significant amount of his practice involves investment treaty disputes. He has been recognized by Chambers & Partners (Global and UK editions) and Legal 500. Mr. Foster graduated in 1995 from the College of Law, London and received his M.A., with honors, in 1989 from Brasenose College, University of Oxford.

Six McGuireWoods Lawyers Named “Southern California Rising Stars 2007”
Six McGuireWoods LLP lawyers were named “Southern California Rising Stars 2007” by Rising Stars magazine, a special publication of Law & Politics magazine. The findings are to be published in the magazine’s July 2007 issue.

As part of the selection process, Law & Politics mailed ballots to the most recently named “Southern California Super Lawyers.” The lawyers are asked to nominate the best up-and-coming lawyers who are 40 years of age or younger, or in practice for 10 years or less, and whom they have personally observed in action. In addition, the Law & Politics attorney-led research department reviews the nominees’ credentials based on a set of evaluation criteria, including confirmation of their license and any history of disciplinary action (which would remove them from consideration). To ensure a diverse and well-balanced list, the research staff considers factors such as firm size, practice area and geographic location.

Fulbright Senior Associate’s Book Cited by Supreme Court of Texas
Fulbright senior associate Charles Brown’s Handbook of Texas Evidence was cited by the Texas Supreme Court in the petition for review of Bay Area Healthcare Group, Ltd. v Deborah Sue McShane and James Patrick McShane.

The Court of Appeals reversed the ruling of the McShane’s medical malpractice suit against Bay Area, holding that the trial court abused discretion in admitting evidence. One issue on appeal by Bay Area was whether the court of appeals misapplied the Texas Rules of Evidence.

Texas Supreme Court cited Brown’s book to show that statements during trial were relevant since the McShane’s attorney opened the door to the plaintiff’s alcohol consumption during opening statements.

The Handbook of Texas Evidence states, “A party can make otherwise irrelevant evidence relevant by injecting collateral issues into a lawsuit. This is called ‘opening the door.’ Once a party opens the door…the opposing party may offer rebuttal evidence on the collateral issue.”

The Texas Supreme Court ruled in favor of Bay Area and held the trial court’s take-nothing judgment.

The Handbook of Texas Evidence is co-authored by W. Jeremy Counseller, professor at Baylor Law School.

Fennemore Craig Ranked Highest Overall in 2007 Chambers and Partners USA Rankings of Arizona Law Firms
With three No. 1 rankings and four No. 2 rankings, Fennemore Craig earned the highest total rankings among Arizona law firms in the 2007 Chambers and Partners USA legal guide. In addition, 21 Fennemore Craig attorneys received top rankings in the Chambers USA Directory Lawyer Rankings.

Shareholders Edith G. Osman and Patricia H. Thompson Elected to the Board of Directors of the Greater Miami Chamber of Commerce
Carlton Fields Miami Shareholder Edith G. Osman was recently elected to serve on the Board of Directors of the Greater Miami Chamber of Commerce. She will join Miami Shareholder Patricia H. Thompson, who is serving her third year on the Board.

As members of the Board of Directors, Osman and Thompson will work to attract new members to the Chamber and help the organization carry out its mission of creating economic progress in Miami-Dade County.

“Edith and Patricia are proven leaders who will bring high-level experience, energy, passion, and creativity to the Board, and they know how to get things done,” said Charles M. Rosenberg, Managing Shareholder of Carlton Fields’ Miami office. “They will be extremely effective advocates for the Chamber.”

Osman is the past president of The Florida Bar, state-wide president and the Miami-Dade chapter president of the Florida Association for Women Lawyers, and past chair of The Florida Bar’s Standing Committee on the Legal Needs of Children. She chairs Carlton Fields’ Family Law Practice Group and is also a Supreme Court Certified Civil and Family Law Mediator. Osman practices in the areas of matrimonial law, commercial litigation, and mediation. Osman received her Bachelor’s Degree from State University of New York at Stony Brook and her J.D., cum laude, from the University of Miami School of Law.

Shareholder Richard A. Denmon Elected to the Board of Directors of Florida Venture Forum
Carlton Fields is pleased to announce that Tampa Shareholder and Co-Chair of the firm’s Corporate and Securities Practice Group, Richard A. Denmon, was recently elected to the Board of Directors of the Florida Venture Forum.

Denmon practices in the areas of securities regulation, corporation finance, mergers and acquisitions, and venture capital formation. He received his B.S. from State University of New York at Binghamton in 1979 and his J.D. from State University of New York at Buffalo in 1982. Denmon also served as a staff attorney and as special counsel with the Securities and Exchange Commission in its Division of Corporation Finance in Washington D.C.

Denmon represents companies and investment banking firms in a wide variety of securities and corporate finance transactions. He has represented issuers and underwriters in numerous initial public offerings and follow-on offerings. He also represents public companies in connection with their ongoing corporate and securities compliance matters. Denmon’s merger and acquisition practice includes counsel and guidance to boards of directors and special committees of independent directors on corporate governance matters, change in control issues, and anti-takeover strategies. His venture capital experience includes representing emerging growth companies in capital raising activities and negotiation of investments by venture capital firms.
