Dykema Attorneys Receive Distinguished Brief Award
Dykema attorneys Richard D. McLellan, Kristine N. Tuma, R. Lance Boldrey and Shaun M. Johnson were recently awarded the Distinguished Brief Award from Thomas Cooley Law School for a brief they submitted to the Michigan Supreme Court in connection with Taxpayers of MI Against Casinos v. The State of MI. The Dykema team represented intervening defendant Little Traverse Bay Band of Odawa Indians and were successful in winning the case.

"Professional recognition for the quality of our hard work on the brief was almost as satisfying as winning the case for the Tribe. This case creates new law and a new framework for government-to-government relations between the State of Michigan and its Indian tribes," said Richard McLellan.

The Distinguished Brief Award is given in recognition of the most scholarly briefs filed before the Michigan Supreme Court, as determined by a panel of eminent jurists. These briefs are evaluated in seven categories: the question presented, point headings, statement of the case, argument and analysis, style, mechanics, and best overall brief.

Dykema is one of a handful of law firms that has been involved in every aspect of the development of casino gaming in Michigan, including the development of gaming on Native American land, implementation of Proposal E (voter approval of casino gaming in the state), license procurement and comprehensive business representation for both casino owners and suppliers.

The firm’s Indian-related activities include: (1) negotiating contracts between tribes and state and local governments, management companies, and businesses providing services to tribes; (2) appearing on behalf of tribes and tribal interests in federal and state courts and before regulatory agencies; (3) advocating on behalf of tribes and tribal interests before Congress and Executive official’s; (4) lobbying state legislators, governors, and other state government officials; and (5) handling administrative law matters such as applications to take land into trust and for federal recognition.

Chambers USA Names Bracewell's Oil & Gas Energy Practice Top-Ranked
According to Chambers USA Guide 2007, Bracewell & Giuliani LLP's Oil & Gas Energy practice was ranked among the top nationally, noted as a "trusted name for oil and gas.” Bracewell’s Native American practice, hailed as a vanguard of Indian law expertise and led by Nancy J. Appleby, also achieved high national marks.

Regionally, several Bracewell practices received high rankings including Banking & Finance, Environment, Tax, Corporate/M&A, Energy & Natural Resources, Energy & Natural Resources: Dispute Resolution, Intellectual Property, Real Estate, Technology: Corporate & Commercial, Bankruptcy/Restructuring, Labor & Employment, Litigation: General Commercial Projects and Electricity.

Additionally, many individual Bracewell attorneys also received high rankings.

Smith Moore Continues Growth with Wilmington Office Expansion
Three of Wilmington's best-regarded business lawyers are moving their practices to the Wilmington office of Smith Moore LLP. David Barefoot, Frank Martin and David Martin, formerly with Manning Fulton & Skinner in Wilmington, are joining Smith Moore, the firm announced today. In addition, Jill Raspet is joining Smith Moore's Wilmington office, moving her practice from Schell Bray Aycock Abel & Livingston in Greensboro.

Barefoot, David Martin, and Raspet have joined Smith Moore effective immediately, while Frank Martin will begin work with his new firm later this month.

"These experienced and knowledgeable attorneys elevate our practice capabilities in Wilmington to a new level," said Steve Earp, the firm's managing partner. "We can't think of a better way to affirm our commitment to the Wilmington community than joining forces with such quality colleagues."

The expansion of Smith Moore's office in Wilmington is the third growth move the firm has made in the past three months. Since March 1, Smith Moore has opened a new office in Charlotte and more than doubled the size of its Atlanta office, in addition to its expansion in Wilmington. The firm also has offices in Raleigh and Greensboro.

David Barefoot's practice focuses on real estate. His career as one of Wilmington's leading real estate attorneys has included work on development projects that have helped set the standard for development throughout the Wilmington-Cape Fear area.

Frank Martin is one of the most highly respected business lawyers in the Wilmington community. His practice includes estate planning and wealth transfer, real estate and small business.

David Martin, who is Frank's son and a Wilmington native, has a dynamic real estate development practice, primarily representing large residential developers.

Jill Raspet like Frank Martin, will work in Smith Moore's rapidly growing estate planning and wealth management practice.

Eric Schultz Joins Hiscock & Barclay Law Firm

Former Government Attorney John Chapman Joins Duane Morris in Boston
Duane Morris LLP is pleased to welcome John Chapman, a former undersecretary in the Massachusetts Executive Office of Economic Development. John, who is also former senior counsel for the U.S. Securities and Exchange Commission, joins the Corporate Practice Group.

John brings to the firm a unique background; in addition to his state and federal government experience, he was an in-house legal counsel. His practice focuses on representing corporate and securities clients with major regulatory enforcement and compliance needs, as well as assisting federal and state regulators and agencies in the formation and implementation of regulations and policymaking.

John was an energy policymaker for the commonwealth during Governor Mitt Romney's administration, authoring a plan entitled "Next-Gen Energy" that provides for significant conservation and efficiency measures and other reforms. In that position, he oversaw the filing of regulatory petitions and was the lead negotiator on behalf of the commonwealth in the decision process for two proposed off-shore liquefied natural gas (LNG) terminals. Prior to that, John was the commissioner of the Department of Industrial Accidents, which is responsible for overseeing the Workers' Compensation system in Massachusetts. During that time, he was responsible for major reforms at the department. John also served as the regional field director of southeastern Massachusetts for Romney for Governor Committee, where he managed a volunteer work force of more than 700 people and supervised more than 50 town captains throughout the region.

Prior to his work for the state, John was vice president and assistant general counsel of Tucker Anthony Inc., a full-service brokerage firm and investment bank. At Tucker, John provided legal advice on general corporate and regulatory matters, including drafting policies and procedures, drafting and negotiating contracts, reviewing and drafting regulatory filings, and managing all corporate insurance matters for the firm.

At the SEC, John investigated violations of the federal securities laws, with particular emphasis on complex financial fraud, insider trading, stock manipulation and other misconduct.

John, while attending law school, served as a law clerk in the Office of Counsel to the President at the White House.

In 1992 John earned his J.D. from Suffolk University Law School. He graduated from Kenyon College in Gambier, Ohio, in 1986.

Fraser Stryker Awards Two New Diversity Scholarships
Fraser Stryker law firm presented Diversity Scholarships to two high school students last Wednesday in the inaugural ceremony of the firm’s new program. The program provides college tuition assistance and paid internships at the firm for students of African-American, Asian, Latino and Native-American origins from low-income families in the Omaha metro area. Each annually renewable scholarship is for $2,500 per academic year, and goes to students interested in a career in law.

The first two recipients are Divine W. Shelton, son of Pamela Alston and Clifton Shelton, and Yvonnda Summers, daughter of Monique and Otis Cooper.

Shelton was senior class president at Northwest High School and a member of the National Honor Society, the honor roll and Who’s Who Among High School Students. He will major in pre-law and political science at Creighton University.

Summers was senior class board member at Millard South High School, and a member of the National Honor Society, the Silver and Bronze honor roll and placed first in Forensics Speech. She will also major in pre-law and political science at Creighton.

A reception was held at the OPPD Atrium, and was attended by Nebraska Supreme Court Justice John Gerard and Douglas County Juvenile Court Judge Vernon Daniels.

El Paso Corporation Senior Notes Offering
Davis Polk & Wardwell advised Deutsche Bank Securities Inc., Citigroup Global Markets Inc., Morgan Stanley & Co. Incorporated and Greenwich Capital Markets, Inc. as joint book-running managers on an offering by El Paso Corporation of $1.275 billion aggregate principal amount of its senior notes, which consisted of $375 million aggregate principal amount of 6.875% senior notes due 2014 and $900 million aggregate principal amount of 7% senior notes due 2017.

El Paso Corporation is an energy company that primarily operates in the regulated natural gas transmission and exploration and production sectors of the energy industry.

The Davis Polk corporate team included partner Alan Dean and associates Alejandro Maher and Pheabe S. Morris (not yet admitted). The tax team included partner Samuel Dimon and associate Arie Rubenstein (not yet admitted). Partner Gail A. Flesher and associate Hayden Baker provided environmental advice. Sarah E. Park was the legal assistant on the transaction. All members of the Davis Polk team work in the New York office.
