McDermott Named Among Top Intellectual Property and Tax Litigation Firms
McDermott Will & Emery was recognized by The Legal 500 United States (Volume III: Litigation) among the leading law firms in the areas of intellectual property litigation and tax controversy. The Firm’s Intellectual Property, Media & Technology Department and Tax Department were highly praised for their litigation excellence.

The Intellectual Property, Media & Technology Department was acknowledged for its excellence in patent litigation: hi-tech electronics/IT; trademarks: litigation and dispute; and trade secrets: integrated service, and advice and litigation. Top partners named for their focus in these practice areas were Raphael Lupo, Brian Ferguson, Terrence McMahon, Robert Zelnick, John Dabney, Margaret Duncan and David Larson.

McDermott’s Tax Department was noted for its excellence in tax controversy. Partners Thomas Borders, Thomas Sykes and William Goldman were recognized for their extensive tax backgrounds and their ability to resolve a majority of cases without litigation. The Legal 500 United States notes that McDermott, “…has a particular expertise in advising clients on transfer pricing issues, often in the hi-tech arena out of the firm’s Californian offices, and is further able to draw on a considerable general litigation group at the firm when additional resources are required.”

The Legal 500 series is the world’s largest legal referral guide. It provides independent, unbiased commentary on the leading law firms and lawyers in the United States and in the rest of the world. The Legal 500 United States recognizes that law firms across the globe look to U.S. firms as role models on how best to provide quality legal services to the commercial sector. McDermott Will & Emery was recognized previously in The Legal 500 United States (Volume I: Corporate and Volume II: Intellectual Property).

McDermott Recognized Among the Most Active ITC Practices
McDermott Will & Emery has been ranked by IP Law & Business as the most active “general practice firm” before the International Trade Commission (ITC) in 2006. In the article “International Savoir Faire” (June 2007) IP Law & Business recognized firms practicing before the ITC. In 2006, McDermott handled seven investigations for clients including Linear Technology, Amgen, Creative Technology and QUALCOMM. McDermott increased its ITC investigations by five cases compared to 2005.

“McDermott has a strong background acting as counsel in numerous investigations for many high-technology and drug manufacturing companies in respect to unfair competition and importation implications,” commented Mark Davis, head of the International Trade Commission Practice. “Our continued focus and commitment to this practice area is demonstrated in the increase of investigations McDermott took part in during 2006.”

IP Law & Business is a source of information on the law and business of intellectual property targeting IP practitioners. Data for this ranking was collected from the ITC website and interviews with attorneys.

McDermott Will & Emery has one of the leading section 337 practices in the United States. Since 1982, Firm members have acted as counsel in approximately 50 section 337 investigations. These investigations have involved numerous technology areas and numerous causes of action, including patent, trademark and copyright infringement. Most of these section 337 investigations involved concurrent litigation in the federal district courts where members of the Firm served in similar capacities.
