James E. Dunstan Appointed to Virginia's Joint Commission on Technology and Science Aerospace Advisory Committee
Garvey Schubert Barer attorney James E. Dunstan, an Owner in the firm's Washington, D.C. office, was appointed to a one-year term on Virginia's Joint Commission on Technology and Science Aerospace Advisory Committee. Mr. Dunstan is the only practicing attorney who was appointed to the Committee.

Mr. Dunstan concentrates on issues of high technology, communications, and space law. He represents a significant number of burgeoning outer space companies, and brings his experience with entrepreneurial space companies to the Committee. During his nearly 25 year career, he has drafted and negotiated the first commercial lease for the Russian Mir space station on behalf of his client MirCorp, assisted in securing clearances for the first television commercial to be shot aboard the International Space Station (ISS), and helped coordinate the ceremonial throwing out of the first pitch at the 2002 World Series from the ISS.

Mr. Dunstan obtained his J.D. from Georgetown University Law Center in 1983 (where he was the founding chairman of the Georgetown Space Law Group) and his B.A., cum laude, in 1980 from Claremont Men's College (now Claremont McKenna College). He is the 1978 Harry S Truman Scholar from the state of Arizona.

The Committee's first meeting was held in Richmond on June 6, 2007. The second meeting will be held adjacent to the NewSpace 2007 conference at 1:30 p.m. on July 19, 2007, at the Doubletree Hotel, Crystal City, Virginia, and is open to the public. The Joint Commission on Technology and Science (JCOTS) was created by the 1997 Virginia General Assembly as a permanent legislative commission. The Commission is charged to generally study all aspects of technology and science and to promote the development of technology and science in the Commonwealth of Virginia through sound public policies. The role of the JCOTS Aerospace Advisory Committee is to advise the Virginia legislature on legislation and other measures they should consider to attract aerospace business into the Commonwealth, specifically regarding use of the Mid-Atlantic Regional Spaceport at Wallops Island, VA.

Attorney Kenneth R. Gilberg Named as One of Top 100 Labor Attorneys in the U.S.
Kenneth R. Gilberg, a shareholder at Flaster/Greenberg in its Philadelphia office, has recently been named to the list of Top One Hundred Labor Attorneys in the United States for 2007, as compiled by Labor Relations Institute, Inc.

A recipient of this honor in 2006 as well, Gilberg is a member of the firm's Labor and Employment Practice Group. He represents employers in a broad range of employment, labor, and human resources issues and assists companies in negotiating favorable contracts and sustain effective relationships with union and non-union employees.
A Penn Valley, Pennsylvania resident, Gilberg is a member of the American, Pennsylvania, and Philadelphia Bar Associations.

Fitzpatrick Prevails in Patent Infringement Suit
Leading intellectual property firm Fitzpatrick, Cella, Harper & Scinto announced its victory on behalf of clients Bristol-Myers Squibb Co. and Sanofi-Aventis SA in their patent infringement suit against Apotex Inc. concerning Apotex’s attempts to market a generic version of Plavix®, one of the world’s largest-selling pharmaceutical products. Plavix® prevents heart attacks by keeping blood platelets from sticking together.

U.S. District Judge Sidney Stein in New York ruled that Apotex failed to prove by clear and convincing evidence that the patent covering the active ingredient in Plavix® is invalid or unenforceable, and granted plaintiffs’ request for a permanent injunction.

Fitzpatrick Cella attorneys involved in the case include partners Robert Baechtold, John Murnane and William Solander.

Six CLL Partners are named in the 2007 International Who's Who of Trademark Lawyers.
The 2007 edition of The International Who's Who of Business Lawyers, published by Law Business Research Limited, of London, UK, has named CLL as one of two firms that it found to be "Big Cheeses in the Big Apple."

In the editorial section, it said "Six members of the firm's 'distinguished' trademark are included in the book. William Borchard - 'part of a generation of really great lawyers' - was mentioned for his experience in handling the trademark aspects of complex transactions. The 'excellent' Authur Greenbaum is also 'hugely experienced in all aspects of trademark law', and Baila Celedonia is 'very highly thought of'. Albert Robin, who joined the firm from Robin, Blecker & Daley in 2004, was rated highly by respondents ('very, very good'), as were Jeffrey Epstein and Mary Kevlin."

This list was compiled from recommendations from general counsel and private practice lawyers of international standing in the practice area. Then it was refined with information gleaned from responses to questionnaires, and the legal and financial media, as well as face-to-face and telephone interviews.

Weil Gotshal Partner Martin Bienenstock Honored as Outstanding Restructuring Lawyer
Martin Bienenstock, co-chair of Weil, Gotshal & Manges LLP’s Business Finance & Restructuring department, is part of a select group of honorees being awarded the Conway Mackenzie & Dunleavy Award. The award is presented to Outstanding Restructuring Lawyers of 2006.

Mr. Bienenstock, who has practiced with the firm for 29 years, is being recognized for some his exceptional achievements in 2006, including leading the firm’s representation of General Motors in the Delphi Chapter 11 and procuring the reversal of a substantive consolidation order in the Owens Corning Chapter 11 case to increase the firm's clients' recovery from $600 million to approximately $2.25 billion.

Mr. Bienenstock’s practice focuses on areas requiring governance advice for healthy or troubled companies, crisis management and restructuring, and international restructuring, including his initial drafting of what became Ireland’s reorganization statute. He has provided legal and strategic advice to directors, management, investors, and creditors and has represented clients in complex trials and in appeals.

The honors banquet will take place on Thursday, June 21, 2007 at the Tenth Annual Conference on Corporate Reorganizations. The event will be held at the Millennium Knickerbocker Hotel in Chicago.

Venable to Relocate Baltimore Offices to Inner Harbor
Venable LLP today announced that the firm's Baltimore offices will relocate from the Mercantile Building at 2 Hopkins Plaza, to 750 East Pratt Street during the spring of 2008.

Several factors drove the firm's decision to relocate its Baltimore offices after more than 37 years. Venable's new offices will expand the firm's square footage to approximately 150,000 square feet and enable the firm to continue to add attorneys and staff to its 460 employees in the Baltimore area.

"After almost four decades in our Hopkins Plaza location, it was time for a change," said Mike Baader, partner in charge of Venable’s Baltimore office. Baader further stated "We are strong and we are growing. Our new location places us in the center of Baltimore's vibrant Inner Harbor business corridor, and will provide a great platform from which to serve our clients throughout the mid-Atlantic region."

Jim Shea, Venable's Chairman added "The firm's roots are in Baltimore. The continued success and growth of the Baltimore office is an integral part of our strategic plan. We have a great team of lawyers in Baltimore, and our new location will enhance their ability to serve the business community and charitable organizations in the region."

Davis Carter Scott of Vienna, Va., a firm specializing in office design for law firms, will design the firm's new space. K&G Project Management of Washington, D.C. will be the firm's project manager, and Whiting-Turner will be lead contractor.

T&K Attorney Elected President of Inter-American Bar Association for 2008
The international law firm of Thompson & Knight LLP is pleased to congratulate Jorge G. De Presno on his election as President-Elect of the Inter-American Bar Association ("IABA") for the 2007-2008 term. He will assume his role as President of the organization at the IABA Annual Conference in Lima, Peru, in 2008. De Presno is currently a member of the IABA Executive Committee and served as Chairman of the 2007 Annual Conference held in Mexico City.

De Presno is a Partner in the Labor and Employment Practice Group in the Firm's Mexico City office. His practice focuses on labor, employment, and social security law, and he advises numerous corporations on their initial planning, with particular focus on labor law issues. De Presno also has experience in collective bargaining negotiations and strike procedures, labor litigation, and counseling at both the state and federal levels. In addition, De Presno is a professor of Social Security and Collective Labor Law at the Universidad Iberoamericana and a professor of Collective Labor and Labor Procedural Law at the Universidad Panamericana.
