Thirteen Rogers Towers' Attorneys Named Among Top Lawyers in Florida Jacksonville
Law & Politics has named thirteen attorneys from Rogers Towers as members of the “2007 Florida Super Lawyers” list. Only five percent of the lawyers in the state are named by Super Lawyers magazine.

Super Lawyers is an annual listing of lawyers who have attained a high degree of peer recognition and professional achievement. More than 60 practice areas are included. Super Lawyers is distributed as a special supplement in leading newspapers and is also published in leading city and regional magazines across the country. The companion “Super Lawyers” magazine is distributed to all attorneys in a state.

Law & Politics uses a multi-step selection process that takes approximately nine months. A survey is sent to all lawyers in the state that have practiced for at least 5 years. In addition, Law & Politics researches credentials of nominees, assembles a blue ribbon review panel of leading attorneys from each practice area, directly contacts lawyers and law firm representatives, verifies data and conducts a good-standing review of candidates.

MBJ Victory: Federal Court Dismisses Claim of Disability Discrimination
The United States District Court for the District of Massachusetts recently granted summary judgment for the defendant employer on claims of disability and gender discrimination, retaliation, and infliction of emotional distress filed by an employee. Morgan, Brown & Joy’s representation of the employer in this case was successful – the Court dismissed all of the employee’s claims.

The Plaintiff, an employee of Home Depot U.S.A., Inc., claimed Home Depot discriminated against him because of his alleged disability (anxiety and depression) and gender (male) when it failed to allow his schedule to be changed (starting an hour earlier and ending an hour earlier). Plaintiff sought this change to accommodate his daughter’s new bus schedule. Home Depot denied each of Plaintiff’s claims and produced evidence that his alleged disability did not substantially impair any of his major life activities, and, even if it did, the requested schedule change was to accommodate his daughter’s schedule, not his disability. Home Depot argued Plaintiff’s gender and retaliation claims failed because he did not suffer from an adverse employment action, and, with regard to the gender claim, he could point to no female employees in the same position who were allowed the type of schedule change that he was denied.

The United States District Court allowed summary judgment, dismissing each of Plaintiff’s claims. The Court found that the Plaintiff was not substantially limited in any of his major life activities by his anxiety and depression and that, even if he had been, it was not unreasonable for Home Depot to refuse to change his schedule. The Court also found the Plaintiff had no evidence that he suffered the adverse employment action vital to his claims of gender discrimination and retaliation. Finally, Plaintiff’s claim of intentional infliction of emotional distress was barred by law.

Alabama’s Hand Arendall Expands Muni Practice by Adding Two Vets
Hand Arendall LLC recently expanded its municipal bond practice in the law firm’s Birmingham, Ala., office with the addition of two veteran lawyers who have a combined total of more than 65 years in public finance.

P. Nicholas Greenwood and A. Lee Martin, who are both experienced as bond counsel to issuers, underwriters, and trustees, bring to five the total number of bond attorneys at Hand Arendall, making it one of the largest municipal bond practices in the state, a spokesperson for the firm said.

“The addition of experienced public finance lawyers in our Birmingham office gives us a true statewide presence, but more importantly Nick and Lee add tremendous depth and experience in many different aspects of state and local financings,” said Preston Bolt, managing lawyer of the firm and chairman of the public finance and economic development practice group.

Greenwood was formerly a partner at Bradley Arant Rose & White LLP. His 35 years in public finance also includes serving as underwriters’ counsel, counsel to providers of credit enhancement, and counsel to bond purchasers in public financings. His clients have included state universities, hospitals, airports, industrial development boards, utility systems, public schools, municipalities and counties, and other issuers of public securities.

A member of the National Association of Bond Lawyers, Greenwood also is a Regular Fellow of the American College of Bond Counsel. He received a bachelor’s degree from the University of North Carolina at Chapel Hill and his law degree from Vanderbilt University.

Martin most recently worked at Miller, Hamilton, Snider & Odom LLC. His 30 years in public finance also includes serving as disclosure counsel. Although he has practiced in all areas of traditional public finance, his major areas of emphasis are in financings to construct or repair affordable and low-income housing, construction or refinancing of health care facilities, refunding issues, and swap transactions.

A member of the National Association of Bond Lawyers, Martin received a bachelor’s degree from Vanderbilt University and obtained his law degree from the University of Chicago.

In 2006, Hand Arendall ranked 100 on the top 100 bond counsel firms, representing 12 clients selling $576.7 million in debt. In 2005, the firm ranked 331 with nine clients selling $62.2 million in debt, according to The Bond Buyer/Thomson Financial 2007 Yearbook.
