Squire Sanders Builds Advocacy Strength from Coast to Coast
Squire, Sanders & Dempsey L.L.P., which recently added litigation lawyers to its Los Angeles office, is increasing its litigation and international dispute resolution (IDR) ranks. The firm today announced that New York litigators Richard L. Mattiaccio, Steven Skulnik and Victor Genecin have joined its New York office.

“Richard, Steven and Victor have a sophisticated practice in federal and state courts in New York and in arbitration at the American Arbitration Association (AAA), with particular experience in contract and business tort litigation, and trademark and anticounterfeiting litigation,” said Howard J.C. Nicols, who coordinates the Squire Sanders advocacy practice. “Squire Sanders’ litigation and IDR practices have broad reach across multiple offices and are built to serve clients’ needs nationwide and globally, and these lawyers will help us build on our strong practices.” The lawyers join Squire Sanders from Pavia & Harcourt LLP. Nicols added that in May Squire Sanders announced that Douglas J. Rovens and Steven A. Lamb had joined the firm’s Los Angeles office.

Mattiaccio, who was chair of the litigation and arbitration practice at his previous firm, is experienced in international and commercial arbitration and in litigating complex civil cases involving commercial, licensing, distribution and franchise disputes; trademark litigation; unfair competition claims; shareholder and partnership arbitrations; product liability defense; and media, entertainment and executive employment disputes. He is a member of the AAA Panel of Arbitrators and ICDR under International and Commercial Rules. He has represented the AAA as an Observer at the Working Group III for the UNIDROIT Principles of International Commercial Contracts.

Skulnik has trial and appellate experience in several areas including commercial contracts, art and antiquities law, banking, franchise, employment, real estate, trade secret, trademark, information technology and unfair competition law. He is an official mediator for the New York State Supreme Court’s commercial division and a member of the AAA Panel of Arbitrators.

Genecin’s practice includes trial and appellate practice in securities litigation and arbitration, trademark litigation, commercial contract disputes and estates and employment litigation. He is a former assistant attorney general for the state of New York, where he tried complex fraud cases and represented the state on appeal. He is also a former public defender with the criminal defense division of the Legal Aid Society, where he was defense counsel in numerous felony trials.

Simpson Thacher Represents KKR in $227 million Investment in Yageo Corporatio
The Firm represented KKR in its acquisition of $227,000,000 of Zero Coupon Convertible Instruments Due 2014 of Yageo Corporation. Yageo, a Taiwanese company, is a leading manufacturer of passive components used in consumer electronics. The Instruments are convertible into newly issued common shares of Yageo or into global depositary receipts representing the common shares. Assuming the complete conversion of the Instruments based on Yageo's current share capital, KKR would become the largest foreign shareholder of Yageo representing a 16.1% stake. Yageo's shares trade on the Taiwan Stock Exchange and the GDRs trade on the Luxembourg Stock Exchange.

The attorneys working on this deal included: Chris Lin, Patrick Naughton, Daniel Fertig, Rob Mason and Maggie Zheng in Hong Kong, Steve Todrys in New York and Katharine Moir in Palo Alto.

Proskauer Rose Partner Anthony Oncidi Named Fellow of College of Labor & Employment Lawyers
Proskauer Rose LLP, an international law firm with over 700 lawyers worldwide, is pleased to announce that Anthony J. Oncidi, partner in the firm's Labor and Employment Law Department and chair of its Los Angeles-based practice, has been elected as a Fellow of the College of Labor and Employment Lawyers. Proskauer Rose has one of the nation's deepest and most well-regarded labor and employment law departments; Mr. Oncidi is the latest in a long line of firm attorneys to be named to the College.

The College of Labor and Employment Lawyers is a non-profit professional association that honors leading lawyers in the practice of labor and employment law and strives to promote achievement, advancement and excellence in the practice while providing a forum for discussion and collegiality among its Fellows. Attorneys must be nominated by two current Fellows in good standing, followed by an evaluation by the College's Board of Governors.

"This is a high honor for Tony and the firm and we offer our sincere congratulations," said Allen I. Fagin, Chairman of Proskauer and himself a Fellow of the College of Labor and Employment Lawyers. "His induction is a distinguished affirmation of the experience and knowledge he brings to the practice and to its continued growth in Los Angeles and firmwide."

Mr. Oncidi represents employers in all aspects of labor relations and employment law, including litigation and preventive counseling, wrongful termination, employee discipline, Title VII and the California Fair Employment and Housing Act, wage and hour matters, including class actions, executive employment contract disputes, sexual harassment training and investigations, workplace violence, drug testing and privacy issues, confidential information, Sarbanes-Oxley claims, employee raiding and trade secret protection. A substantial portion of his practice involves the defense of employers in large class actions, employment discrimination, harassment, and wrongful termination litigation in state and federal court as well as arbitration proceedings.

Other Proskauer attorneys who have been named Fellows of the College of Labor and Employment Lawyers include Mr. Fagin, Paul Salvatore, Lawrence Sandak, Howard Ganz, Lawrence Lorber, Kathleen McKenna, Bettina Plevan, Howard Shapiro, Arthur Silbergeld and Allan Weitzman.

Lader Receives Rotary International Foundation's Top Honor
Philip Lader, a Charleston partner of the Nelson Mullins Riley & Scarborough law firm, has received the Rotary International Foundation's 2007 Global Alumni Service to Humanity Award.

The honor is awarded each year to one person who has made significant contributions to addressing human and their country's needs and to world peace, among the 110,000 individuals worldwide who have received Rotary scholarships as students or young professionals.

The presentation was made last week at Rotary International's annual convention with 20,000 attending in Salt Lake City.

Mr. Lader, the former U.S. Ambassador to the Court of St. James's and member of President Clinton's Cabinet, is also Chairman of WPP Group, the worldwide communications/media company that includes J. Walter Thompson, Ogilvy & Mather, and Young & Rubicam, with 98,000 employees in 106 countries. He is Senior Adviser to Morgan Stanley and a director of Lloyd's of London and four global corporations.

The South Carolinian's public service activities over 30 years include White House Deputy Chief of Staff, Administrator of the U.S. Small Business Administration, Deputy Director of the U.S. Office of Management & Budget, trustee of the Smithsonian American History and the British Museums, St. Paul's Cathedral, and the College of Charleston, Lander and Francis Marion Colleges, a director of the South Carolina Chamber of Commerce, and a vestryman of his church.

The first member of his family to attend college, Mr. Lader was educated at Duke, Michigan, Oxford and Harvard Universities, made possible in part by a Rotary scholarship, and he has received honorary doctorates from 14 universities.

Accepting the award, Mr. Lader said, "Rotary's scholarship helped changed my life, but this honor is particularly humbling because I know of enormous contributions of many others who are more deserving." He was nominated for the award by the Charleston Rotary Club and sponsored by the combined Rotary Clubs of South Carolina.

McDermott Attorneys Involved in Two First Amendment U.S. Supreme Court Victories
Today, the U.S. Supreme Court issued favorable decisions on behalf of McDermott Will & Emery clients in both Federal Election Commission v. Wisconsin Right to Life (FEC) and Morse v. Frederick (Morse), two First Amendment cases.

On April 25, 2007, trial partner M. Miller Baker of the Washington, D.C. office appeared at counsel table in FEC, representing appellee Wisconsin Right to Life (WRTL). Also present at WRTL's counsel table was Kathleen Sullivan, former dean of the Stanford Law School, and Richard Coleson of Bopp, Coleson, and Bostrom. Prominent First Amendment lawyer James Bopp, Jr., of Bopp, Coleson, and Bostrom argued on behalf of WRTL.

Today, the U.S. Supreme Court ruled 5-4 that as applied to WRTL's broadcast ads exhorting Wisconsin voters to urge Senators Kohl and Feingold to oppose the filibuster of judicial nominees, the Bipartisan Campaign Reform Act of 2002 (commonly known as the McCain-Feingold law) violated the First Amendment. The issue in the case is whether the McCain-Feingold law's ban on corporate and labor union funded broadcast advertisements that merely mention a candidate's name within 60 days of a general election or within 30 days of a primary election violates the First Amendment. In this case, WRTL could not run its proposed broadcast ads in Wisconsin in September 2004 because Senator Feingold’s name was on the primary ballot, even though the issue of the filibuster of judicial nominees was a live issue about to be voted on by the Senate. A wide array of groups across the political spectrum, including the ACLU, the AFL-CIO and the U.S. Chamber of Commerce, filed amicus briefs in support of WRTL. Washington, D.C. partner Michael Nadel and Washington, D.C. associate Jeff Mikoni assisted on the briefing.

In Morse, the closely-watched First Amendment student speech case also known as the “Bong Hits 4 Jesus” case, new McDermott partner Eric Hagen of the Los Angeles office represented petitioners Deborah Morse and the Juneau School Board while at his previous firm, Kirkland & Ellis. On March 19, 2007, Mr. Hagen second-chaired the oral argument at the Court. Former U.S. Solicitor General Kenneth W. Starr, of counsel with Kirkland, served as petitioners’ counsel of record. Mr. Hagen joined McDermott on June 8, 2007, and he continues to represent the petitioners.

At issue in Morse, was whether public high school students have a First Amendment right to promote illegal drugs in the school setting and, if so, whether a public high school principal could be held personally liable for damages when she disciplined the student for violating a school district rule against promoting drugs. In January 2002, shortly before the Winter Olympic Games in Salt Lake City, the Juneau-Douglas High School celebrated the arrival of the Olympic Torch Relay in Alaska. With the student body assembled in front of the school during school hours, then high school senior Joseph Frederick unfurled a 14-foot banner that read “Bong Hits 4 Jesus.” Principal Deborah Morse asked Frederick to remove the banner. When he refused to cooperate and violated other student conduct rules, she suspended him. Frederick responded by filing a federal lawsuit against the principal and the school board, asserting that his free speech rights were violated and seeking compensatory and punitive damages.

Chief Judge John Sedwick of the District of Alaska dismissed the lawsuit in 2003. But in 2006, the Ninth Circuit Court of Appeals reversed. The Ninth Circuit held that the student’s rights were violated and that the principal had no immunity from being sued personally for damages.

Today, the U.S. Supreme Court reversed the Ninth Circuit. The Court unanimously decided that Principal Morse should face no personal liability on the student’s damages claim, and, in a majority decision authored by Chief Justice Roberts and joined by four other Justices, the Court held that the student’s First Amendment rights were not violated because public schools may restrict speech that is “reasonably viewed as promoting illegal drug use.”

These two decisions by the U.S. Supreme Court follow on the heels of the unanimous decision by the U.S. Supreme Court on June 11, 2007, for McDermott client Jeffrey H. Beck in Beck v. PACE International Union (05-1448), an ERISA case. Mr. Baker argued before the Court on behalf of Beck.
