Pennington Firm Congratulates
We congratulate our partners Mark K. Delegal, Carl R. Pennington, Cynthia S. Tunnicliff, and Julius J. Zschau who were recently awarded the status of "Super Lawyer " by Law & Politics magazine.

A special supplement to the New York Times, Tampa Tribune, and Miami Herald, was issued June 18, 2007 and listed this year's selections for Super Lawyers. The Super Lawyers magazine is also published as a monthly periodical. Selections are originally researched by reviewing databases, online sources, national and local periodicals, and trade journals, as well as contacting law firms for their choice of qualified candidates. Nominated attorneys are then narrowed down to those chosen as "Super Lawyers " by surveying 44,000 attorneys whose criteria is to choose the best lawyer they've personally observed in action. In the final selection only 5% of Florida attorneys are selected as Florida Super Lawyers.

We congratulate our partners and applaud them for their hard work and devotion to their clients' issues.

Morris, Manning & Martin Adds “Web 2.0” Group Focusing on Consumer-Generated Media
The changing face of the Web and new ways people share information online has ushered in a new crop of legal issues. Attorneys with Morris, Manning & Martin, LLP are responding to that by starting a new “Web 2.0” legal group. The team focuses on the legal implications of the growing business uses of social networking and content provided by those who are not controlled by the business.

Partners Paul Arne and Sandra Gardiner will provide a workshop for clients and invited friends at the firm on Wednesday, July 11. They’ve already delivered several lectures on the topic, including earlier this month at the 17th Annual Seminar on Computer and Cyberspace Law in Dayton, Ohio.

“Legal life gets more complicated when a business starts to use content received from sources it doesn’t control,” Arne says. “Viacom is suing YouTube for $1 billion dollars, and Craigslist was sued because its users posted classified ads that allegedly violated the Fair Craigslist was sued because its users posted classified ads that allegedly violated the Fair Housing Act. Last month Digg.com removed information may have violated the law only to have it re-posted multiple times by users.”

The attorneys say they hope to ease the strain on companies by empowering them with up-todate information that helps them stay ahead of rapidly evolving issues. “Identifying legal issues in a ‘Web 2.0’ world requires more than knowledge of applicable law from normally disparate legal disciplines.” adds Gardiner. “It depends on a clear understanding about how the technology is, and may be, used.” Arne, who co-chairs Morris, Manning & Martin’s Technology group, has extensive background assisting companies with technology issues involving international transactions, open source software, privacy, outsourcing and Internet law. He is a respected writer and a prolific speaker.

Gardiner co-chairs the firm’s Green Business group and is also a member of the Privacy and Security group. Her groundbreaking work includes helping one of the nation’s largest Internet providers negotiate deals with several cities for municipal Wi-Fi services. She also counsels companies on new media, clean energy, intellectual property, electronic commerce, telecommunications, payment processing, joint ventures and strategic alliances. She is also a contributor to the book The Law of the Internet.

THE SCALES OF JUSTICE: A. THOMAS LEVIN "CHIEF JUDGE" OF MOCK APPEAL PANEL
A. Thomas Levin, a member of Meyer, Suozzi, English & Klein, P.C. and Chair of the firm's Municipal Law, Land Use and Environmental Compliance practice will be a part of the distinguished bench participating in a re-argument of the appeal in the case of Palsgraf v LIRR at the Nassau County Bar Association on June 26, 2007.

Palsgraf v LIRR - On April 25, 1924, a man was fighting his way onto a crowded car of the Long Island Railroad at the East New York Station. A railroad guard attempted to help the passenger board and caused the passenger to drop his package. Unbeknownst to the guard, the package contained fireworks. The fireworks exploded, reportedly knocking down scales at the other end of the platform, which injured Helen Palsgraf. Mrs. Palsgraf sued the railroad claiming her injury resulted from the negligent acts of the railroad employee. The jury found for Mrs. Palsgraf. The Court of Appeals dismissed the complaint, deciding, in an opinion written by Benjamin Cardozo, that the relationship of the employee’s actions to Mrs. Palsgraf’s injury was too indirect to make him liable. The three-judge dissent, by contrast, saw the case as a matter of proximate cause - Mrs. Palsgraf’s injury could be traced to the wrong done by the guard in pushing the passenger holding the package.

This program will present a re-argument of the appeal. The distinguished bench will then conduct an open consultation and render a decision.

Distinguished Bench: Nassau County Executive Thomas R. Suozzi • Hon. Susan T. Kluewer, District Court Judge, Nassau Hon. Ute Lally, Supreme Court Justice, Nassau • A. Thomas Levin, Esq., Garden City Jonathan A. Dachs, Esq., Mineola

JMBM Ranks No. 1 Among California's Full Service Firms in Registering Federal Trademarks in 2006
Further demonstrating its expertise in intellectual property law, Jeffer, Mangels, Butler & Marmaro LLP (JMBM), one of California’s foremost full-service law firms, today announced that it registered more trademarks during 2006 than any other full-service California law firm.

"This distinction conveys the trust and respect our clients place in us to handle their trademark needs," said Rod S. Berman, chairperson of JMBM's Intellectual Property Group. "Whether managing a complex portfolio for a large, sophisticated technology client, or assisting an entrepreneur with a trademark application, we have the experience, resources, infrastructure, and legal prowess required to successfully handle a wide range of IP matters."

Intellectual Property Today, a source for legal issues on patent, trademark and copyright law, publishes an annual listing of the nation's top trademark firms based on the number of U.S. trademark registrations issued in a given year. According to their data, among all full-service California law firms, JMBM ranks number one for having registered the most trademarks with the United States Patent and Trademark Office in 2006.

"We take a multidisciplinary approach to our practice," said Berman. "Operating a national and international IP practice alongside partners who specialize in other areas of the law exposes us to a variety of clients, in a number of industries, who have the need for sophisticated trademark lawyers."

In addition, when litigation is required, JMBM's Intellectual Property Group draws upon the depth of experience of the Firm's trial lawyers in mounting appropriate technical and legal presentations that have persuaded judges and juries in courtrooms across the country.
