MARISA W. HIGGINS APPOINTED TO RAINBOW CHILD DEVELOPMENT CENTER BOARD
Marisa W. Higgins, an Associate at Fletcher, Tilton & Whipple, has been appointed to the Board of Directors of the Rainbow Child Development Center.

Ms. Higgins, who joined Fletcher, Tilton & Whipple in 2005, concentrates her practice in all areas of domestic relations law including divorce, custody, child support and spousal support. She is a member of the Massachusetts and Worcester County Bar Associations. Ms. Higgins currently serves as co-chair of the Worcester County Bar Association’s New Membership Committee, which welcomes new attorneys to the area and encourages them to take advantage of community opportunities within Worcester County.

The Rainbow Child Development Center, a licensed non-profit child care agency located at 10 Edward Street in Worcester, was founded in 1972 to provide child care services to low income families in the Worcester area.

WHEELER TRIGG KENNEDY RAISES ASSOCIATE SALARIES
When nationally-recognized litigation firm Wheeler Trigg Kennedy LLP (www.wtklaw.com) opened its doors in 1998, it started a buzz in the Denver legal community and set a precedent of offering the highest salary to first-year associates of any Denver-based law firm. Less than two years after it last raised starting salaries, the firm is doing it again.

As of October 1, 2007, WTK will offer $135,000 as a first-year associate’s starting salary. “We attract some of the very best young lawyers in the country,” states Hugh Gottschalk, WTK’s Managing Partner. “Handling high caliber litigation across the country from our great location in Denver, matched with a competitive salary, makes Wheeler Trigg Kennedy an enticing place to be. We want to make sure that this continues.”

From its beginning, WTK has handled complex civil litigation and trials for some of the country’s best-known companies. The firm’s work for such companies has exploded in the last few months with the addition of several senior trial lawyers, including Kevin Kuhn and John Fitzpatrick, who has a national reputation as a “go-to” trial attorney for high exposure liability cases. By raising salaries, WTK hopes to continue to recruit and retain the high quality associates it needs to staff such cases.

While $135,000 may be tops for Denver-based firms and above the national average, it falls below the entry level salaries of $160,000 recently set by the largest firms in the major metropolitan areas on either coast.

WTK Chairman Michael O’Donnell says, “Having lower salary costs than the law firms with which we compete nationally for cases — such as the class-action lawsuit we’re handling for Ford in California in which plaintiffs are claiming multi-billion dollars in damages — keeps WTK attractive to Fortune 500 corporate counsel who are managing increasingly tight litigation budgets.”

WHEELER TRIGG KENNEDY TOPS LISTS OF PRODUCT LIABILITY DEFENSE FIRMS
Two prestigious lawyer directories, Chambers USA and The Legal 500, have ranked Wheeler Trigg Kennedy high on their lists of national product liability defense law firms.

Chambers USA ranks WTK among the top 21 product liability law firms in the country. It says, “This outfit has benefited from the vogue for setting up ‘virtual law firms,’ its undisputed quality of attorney making it a go-to destination for those putting together a dream team.” Chambers USA calls name partner Malcolm Wheeler, “[a] grand strategist and prodigious worker [who] seems to many, to have been present at the birth of products liability, and is valued as a visionary who always stays one step ahead of the game.”

The Legal 500 ranks WTK nationally among the top seven product liability and mass tort defense firms for consumer product matters, among the top 12 for automotive/transport matters, and among the top 20 for pharmaceutical and medical device matters.

Patton Boggs LLP Names Mary Kimber Chief Marketing Officer

She is a graduate of the San Francisco Art Institute, (B.F.A).

Patton Boggs Anchorage Office Honored With Top Rankings in Chambers USA Survey
Patton Boggs LLP is pleased to announce that Anchorage partner Douglas J. Serdahely and the firm’s environmental and commercial litigation practices have been recognized in the 2007 edition of Chambers USA. This well-respected survey ranks the nation’s top firms and attorneys who are considered leaders in their field.

Mr. Serdahely was honored with a number 2 ranking in both the Environment, Natural Resources & Regulated Industries (Alaska); and Litigation: General Commercial (Alaska) categories.

Lowenstein Sandler Sues New Jersey Department of Education in Pro Bono Case on Behalf of Disadvantaged Children with Disabilities
Attorneys at Lowenstein Sandler PC today filed a lawsuit in the United States District Court for the District of New Jersey against the New Jersey Department of Education to enforce laws governing the education of children with disabilities. On a pro bono basis, Lowenstein Sandler is representing plaintiffs New Jersey Protection & Advocacy, Inc., the Education Law Center, the Statewide Parent Advocacy Network of New Jersey and The Arc of New Jersey on behalf of children with disabilities across the state. Co-counsel in the case are the Education Law Center, New Jersey Protection & Advocacy, Inc. and the Hackensack law firm Loughlin & Latimer.

"Countless children with disabilities in New Jersey have been unnecessarily segregated and denied their right to an inclusive education, to the maximum extent appropriate, with children who do not have disabilities," said lead attorney David L. Harris, who chairs Lowenstein Sandler’s Litigation Department. "The State’s Performance Plan holds little promise for redressing this situation within the educational lifetime of today’s students."

Sarah W. Mitchell, Executive Director of New Jersey Protection & Advocacy, Inc. added that New Jersey has been cited repeatedly by the U.S. Department of Education for its failure to implement the Individuals with Disabilities Education Act. "This litigation is prompted by the State's failure to step up to the plate and take this issue on with the resolve and attention that it deserves," she said. "With few exceptions these deficiencies are the norm throughout New Jersey's 640 plus school districts due to lack of enforcement of the special education mandate to provide students with disabilities a 'free and appropriate public education' in the 'least restrictive environment'," said special education attorney Michaelene Loughlin of the law firm of Loughlin & Latimer.

Children with disabilities in segregated special education settings face rote and mechanical instruction and low expectations. In general education settings, these children are often denied the aids, services and accommodations needed to receive an appropriate education. They are often punished with loss of recess, points and activities, and are retained for failing grades or promoted without any educational gains.

Conversely, benefits to inclusion include improved academic skills, higher grades, higher scores on standardized tests, larger friendship networks, improved attendance and higher self-esteem.

"Including students with disabilities in the general education classroom is a win-win situation. Studies have shown that inclusion not only benefits students with disabilities, but it benefits their non-disabled peers as well," said Ruth Lowenkron of the Education Law Center. Benefits to non-disabled children include improved reading and mathematics performance and social and developmental benefits, such as improved understanding of, and relationships with, children with disabilities.
