Ford & Harrison Chicago Partner Named One of the Top 100 Labor Attorneys in the United States
Ford & Harrison LLP, a national labor and employment law firm, is pleased to announce that Chicago Partner James F. Hendricks, Jr. has been named one of the Top 100 Labor Attorneys in the United States for 2007 by the Labor Relations Institute.

Over 8,600 attorneys were evaluated by the Labor Relations Institute in order to compile the list. Selection is determined by the number of NLRB elections in which each attorney provided representation and the outcome of those elections. Inclusion on the list puts Hendricks in the top one percent of labor attorneys in the U.S.

Jim Hendricks focuses his practice on assisting management with labor matters before the National Labor Relations Board involving collective bargaining and arbitrations. He also defends employers in charges before the Equal Employment Opportunity Commission, the U.S. Department of Labor and other various government agencies. A large portion of his work is devoted to assisting clients in maintaining a union-free atmosphere and positive employee relations programs and training. Jim received his J.D. from the Loyola School of Law.

“To be included in the Top One Hundred is a tremendous honor,” said Donald P. Wilson, President of the Labor Relations Institute. “It acknowledges these attorneys’ professionalism and long-term dedication to their clients.”

Price-Gouging Controls Hurt Consumers, Miller Says
Blackwell Sanders’ Jim Miller spoke with nationally syndicated Premiere Radio Network host Mike McConnell Monday regarding gasoline price-gouging controls, currently being considered in Congress. These controls would punish gas station owners that charge “unconscionably excessive” prices with jail terms. From his viewpoint as former Federal Trade Commissioner chairman, Miller discusses with McConnell why these price controls would only hurt consumers.

McConnell’s show originally aired on 700WLW, Cincinnati, Ohio. His show is also syndicated on stations in Alabama, Florida, Georgia, Indiana, Iowa, Kansas, Kentucky, Minnesota, Missouri, Mississippi, North Carolina, Ohio, Pennsylvania and Washington, along with XM Satellite Radio.

Court of Appeals Agrees With Hogan & Hartson to Limit Courts’ Jurisdiction Over Internet Publication in Libel Case
In an important decision for Web-based speech, the U.S. Court of Appeals for the 2nd Circuit in New York agreed with attorneys from Hogan & Hartson LLP that an out-of-state Web site operator cannot be sued in a New York court based solely on the posting of allegedly libelous material on a Web site.

In the case of Best Van Lines Inc v. Tim Walker, Mr. Walker, an Iowa resident who runs the Web site www.movingscam.com, was sued for libel in New York by Best Van Lines. The moving company alleged that it was defamed on Walker’s Web site. A district court judge dismissed the suit, holding that a New York court did not have jurisdiction over Walker.

Best Van Lines appealed that decision to the 2nd Circuit, and the appeals court asked Hogan & Hartson to file a “Friend of the Court” brief on Walker’s behalf because he was unrepresented. In the brief, Hogan & Hartson attorneys wrote that the district court judge was correct in dismissing the original suit because mere publication of content on a Web site that was accessible in New York did not provide a basis for a New York court to exercise jurisdiction over Walker. The 2nd Circuit agreed with Hogan & Hartson’s position and expressed its gratitude for the firm’s pro bono assistance.

Hogan & Hartson attorneys Slade R. Metcalf and Katherine M. Bolger, partners in the firm’s New York office, worked on this matter.
