Krieg DeVault LLP Announces John R. Kirkwood Appointed to Advisory Board of Richard G. Lugar Center for Renewable Energy
The law firm of Krieg DeVault LLP, Indianapolis, Indiana, is pleased to announce that partner John R. Kirkwood has been appointed to the Advisory Board of the Richard G. Lugar Center for Renewable Energy at Indiana University-Purdue University Indianapolis.

The Richard G. Lugar Center for Renewable Energy was established to address the societal needs for clean, affordable and renewable energy sources, improve the nation's energy security, and reduce global warming. Its primary mission is to promote research excellence in the area of renewable energy through collaborative efforts among faculty in the disciplines of engineering, chemistry, physics, biology, and environmental affairs. The center promotes renewable energy applications through teaching, learning, civic engagement, and synergistic partnerships with industry, government labs and local communities.

A graduate of Indiana University and the Indiana University School of Law, Mr. Kirkwood provides tax and securities advice to clients including cities, towns, colleges and universities, school and fire districts, investment banks, commercial banks, nonprofit organizations, real estate development firms and manufacturers. Additionally, Mr. Kirkwood represents various nationally recognized energy companies in the renewable fuels industry, as well as senior lenders, junior lenders and equity providers for project finance transactions in the renewable fuels industry. Mr. Kirkwood is a member of the National Association of Bond Lawyers, the Indianapolis Bar Association and the Indiana State Bar Association and is the past Indiana chairperson for the American Bar Association Forum Committee on Affordable Housing and Community Development Law.

Mr. Kirkwood resides in Carmel, Indiana.

Corporate Finance and Securities Partners Speak at Alternative Public Strategies Conference
Partners M. Ridgway Barker and Patricia Lee, of the firm's Corporate Finance and Securities Practice, presented at Belmont Partner's Alternative Public Strategies Conference in Washington, DC. Ms. Lee was part of a panel discussion regarding corporate governance. The panel covered topics including investor expectations of a board of directors and its policies and enforcement of those policies. Mr. Barker spoke on special purpose acquisition companies, also known as SPACs, which have become an increasingly popular investment vehicle with investors.

Gray Plant Mooty Named “Go-To Law Firm®”
Gray Plant Mooty has been named a “Go-To Law Firm” by several of its clients, as determined by a recent American Lawyer Media (ALM) survey.

GPM will be recognized in In-House Law Departments at Leading Financial Services Companies—a new reference guide, published by ALM’s Corporate Counsel magazine, which includes detailed profiles of general counsel and in-house attorneys at corporations across the U.S., as well as listings of their current outside “Go-To Law Firms” in practice areas such as litigation, labor & employment, securities, transactions, compliance, and intellectual property.

The guide was developed in response to a research study of Corporate Counsel readers, which revealed that in-house counsel at top financial services companies wanted a vertical industry reference guide featuring in-depth coverage of the leading players in their field, including profiles of general counsel and mention of the respective law firms they use for legal matters, defined by practice area. The guide will be distributed this summer to over 10,000 general counsel at financial services companies and will also be available at www.law.com.

ALM identifies “Go-To Law Firms” by surveying general counsel at leading financial services companies to determine which outside law firms they turn to for assistance. ALM’s research department also investigates and gathers data on financial services companies’ “Go-To Law Firms” from various public records resources such as court dockets and securities filings, as well as legal and business publications, including The American Lawyer.

New US corporate law partner for Freshfields Bruckhaus Deringer in Asia
Freshfields Bruckhaus Deringer continues to build its Asia practice by announcing the arrival to Hong Kong of US corporate law partner Stuart Grider from London. This follows Freshfields' recent relocations of corporate partner James Woods and Ed Cole from London to Tokyo and the promotion of five new partners across the Asia region: corporate partners Jack Wang in Beijing and Alan Wang in Shanghai, finance partner Paul Ng and dispute resolution partner Peter Yuen in Hong Kong and corporate partner Junzaburo Kiuchi in Tokyo.

'We are delighted to welcome Stuart to our Asia corporate practice,' says Teresa Ko, the firm's China managing partner. 'As one of the leading securities law firms in the region, Stuart's arrival will further drive the growth of our US securities practice in Asia and in particular China. His background and solid experience in London and New York is an asset and will certainly strengthen our practice here. We are very excited - he is already on the ground and working as a core member of our integrated corporate team.'

Stuart has practiced in the Freshfields London office since he joined the firm in 2002. His primary focus is on US-registered offerings and Rule 144A and other private securities offerings, advising issuers, sellers and underwriters. He has also advised on mergers and joint ventures throughout Europe and Latin America and in Russia and Kazakhstan. Recent notable transactions include advising on the IPO on the London Stock Exchange of a Latin American silver and gold mining concern, and the demerger of two major retailers from GUS, plus their subsequent listings on the London Stock Exchange.

Freshfields crowned Competition Team of the Year at The Lawyer Awards
International law firm Freshfields Bruckhaus Deringer was this week awarded Competition/Regulatory Team of the Year at The Lawyer Awards 2007 in London.

The award was for the firm’s work for Visa Europe/UK on its decisive intervention in MasterCard’s appeal to the Competition Appeal Tribunal (CAT) of the Office of Fair Trading’s (OFT) high-profile probe into credit card arrangements. Visa was an intervener in these proceedings and therefore did not benefit from the broader rights of defence available to the appellants themselves. However, the case put forward by the team from Visa and Freshfields, and specifically its individual application for ‘strike-out’ – in the face of significant opposition by the main appellants and the OFT – was so strong as to result in the OFT’s decision being set aside.

This was the first time that an application by an intervener has brought about the setting aside of a regulator’s decision in the UK. Exceptionally, an award of costs was also secured for Visa, even though the CAT does not generally award intervener’s costs.

In its commentary on the award, The Lawyer stated: ‘Freshfields Bruckhaus Deringer, with a team led by partners Deirdre Trapp and Vanessa Turner, rolled up its sleeves for client Visa to pull off a coup that was regarded, even by its competitors, as an astonishingly good performance. Freshfields’ strength of argument over the OFT’s lack of consistency with previous European Commission decisions has important ramifications for how competition authorities interact on national and supra-national levels.’

The Lawyer Awards are the result of a long process of research by the publication’s editorial team, during which hundreds of private practice lawyers and in-house counsel are interviewed. The Lawyer explains that this is followed by the scrutiny of an independent panel of judges comprising the biggest names in London, and that this makes The Lawyer Awards ‘the most comprehensive and incisive reflection of the legal market’.

Rod Carlton, managing partner of our London antitrust, competition and trade (ACT) practice group, commented: ‘We are delighted to have been recognised as the leading competition team of the year. Our work for Visa is just one example of how our international network of antitrust lawyers deals constructively, yet firmly, with regulators, tribunals and Courts to safeguard our clients’ interests.’

Freshfields Bruckhaus Deringer have advised Visa in connection with investigations into interchange fees by competition regulators across the Community, including the OFT, Bundeskartellamt (Germany), the OPCC (Poland), the TDC (Spain) and the European Commission.

RREEF Infrastructure acquires 50 per cent of Tank & Rast from Terra Firma
RREEF Infrastructure, the infrastructure division of Deutsche Bank, has acquired a 50 per cent stake in German motorway service station operator Tank & Rast from Terra Firma. International law firm Freshfields Bruckhaus Deringer advised RREEF Infrastructure on the transaction. RREEF Infrastructure and Terra Firma have committed to investing around €400m over the next five years to develop the business.

The Freshfields team was led by London corporate partner David Higgins with partners Neil Falconer (finance, London), Anselm Raddatz and Christoph Nawroth (both Corporate, Düsseldorf), Stephan Eilers (Tax , Cologne) and Frank Laudenklos (Finance, Frankfurt), plus senior associates Simon Weller (corporate) and Diane Richardson (finance).

David Higgins comments: 'This transaction is a good example of two different types of financial investor - one private equity and one infrastructure - coming together to jointly own an asset. The issues raised by a transaction such as this are very different from an outright 100 per cent acquisition and it has required significant work from our lawyers in both London and Germany. This is a very interesting deal for RREEF Infrastructure and we were delighted to be working with them on it.'

Corporate Board Member partners with FTI Consulting to prepare an annual ranking of the top five corporate law firms in 25 metropolitan areas, according to directors serving on boards of publicly traded companies listed with the NASDAQ, New York Stock Exchange, or American Stock Exchange.
