Wiley Rein Secures Settlement in Class Action Suit to Improve MetroAccess Service
On behalf of The Equal Rights Center, Wiley Rein LLP and the Washington Lawyers’ Committee for Civil Rights and Urban Affairs have secured a multi-million dollar tentative settlement of a class action lawsuit brought against MetroAccess, alleging that Metro had violated the Americans with Disabilities Act and the Rehabilitation Act by failing to provide adequate service to customers with disabilities. Under the settlement’s terms, MetroAccess will hire expert consultants to assist in its ongoing oversight of MetroAccess performance and enhance service by increasing the paratransit budget by $4 million a year over a three-year period. In addition, every MetroAccess patron will receive 10 free rides, valued at almost half a million dollars, and those who actively participated in the class action lawsuit will be compensated—the 14 named plaintiffs each will receive $5,000; riders who gave sworn testimony will receive $1,000; and the Equal Rights Center will receive $65,000 to advance its mission to promote civil rights, plus an additional $250,000 to be paid to it over the next three years to cover its costs of monitoring and advancing MetroAccess progress

Wiley Rein partner Thomas W. Brunner, lead plaintiffs’ counsel commented, “We are pleased that, after almost 3 years of extensive litigation, we have found common ground that will afford the disabled community the level of service they both require and deserve. This settlement will provide extensive service improvements for MetroAccess riders and eliminate the inadequate service that existed under the former MetroAccess contractor."

Wiley Rein attorneys Thomas W. Brunner, Todd A. Bromberg, M. Evan Corcoran, Hugh Latimer and Keith Watson led a large team that worked with Elaine Gardner of the Washington Lawyers’ Committee for Civil Rights and Urban Affairs. The firm, which prides itself on its pro bono work and service to the local community, has pledged its recovery of attorneys’ fees to the Washington Lawyers’ Committee.

WCM Wins Summary Judgment in Suffolk County Personal Injury Case
Senior partner Paul Clark and associate Cheryl Fuchs were awarded summary judgment in a Suffolk County, personal injury case. In the case of C.P., an infant v. The Morris Center School, the plaintiff, a student, alleged that she was sexually assaulted by a fellow kindergarten student after a teacher inadvertently brought her to an after school gymnastics program for which she had not been registered. Plaintiff alleged that the sexual assault was the result of the school’s (our client) negligence in failing to verify that plaintiff was enrolled in the program and in failing to provide adequate supervision.

At the close of discovery, we moved for summary judgment. We argued that the school had no actual or constructive notice of any prior similar conduct on part of the students involved, nor was the school’s alleged negligence the proximate cause of plaintiff’s injuries. In opposition, plaintiff argued that there were numerous issues of fact concerning whether the school ignored its own security procedures with respect to verifying enrollment and whether the teacher left the students unattended, thus failing to provide adequate supervision. In reply we argued that plaintiff could not rely on the contradictory testimony of the infant plaintiff without certifying her competency to testify. In addition, even if the teacher was in the bathroom at the time of the incident, the school could not be held liable for the unanticipated acts of fellow students absent proof of prior similar conduct. The trial court agreed with our analysis and dismissed the plaintiff's lawsuit.

Steven R. Director Speaks at Trust Presentation
Steven R. Director, a director at The Bayard Firm, was a speaker at a trust presentation on June 28, 2007 at the Newark Senior Center in Newark, Delaware. Steve described the overall estate planning process, and then explained a number of different trusts and the benefits of each type. He also spoke briefly about the federal estate taxes and the effect of the marital deduction and the applicable credit amount. The presentation was hosted by Delaware Sterling Bank & Trust Company.

Stroock is Recognized by the Annual Chambers USA Law Firm Rankings

Patterson Belknap Again in Top 10 of The American Lawyer’s "A-List"
Patterson Belknap ranked fifth on The American Lawyer’s "A-List" of leading law firms in the United States. The firm is one of just five firms to be in the top 10 every year in which the "A-List" has been published. The "A-List" is based on four criteria: pro bono performance, associate satisfaction, diversity of lawyers and financial performance.
