Kaye Scholer Ranks in The Legal 500 US
In the 2007 edition of The Legal 500 US, Kaye Scholer is ranked in the first tier in the areas of Intellectual Property: Contentious Patent Litigation - Life Sciences/Chemical; Patent Litigation - Life Sciences/Chemical; and Product Liability and Mass Tort Defense - Pharmaceuticals and Medical Devices. The firm is also ranked for Antitrust.

Jones Walker Receives Superlative Rankings from Chambers USA – America’s Leading Lawyers for Business
Jones Walker is ranked in the first band in each of the eight areas of practice Chambers USA covers for Louisiana. The firm has received top-tier rankings in the practice areas of Banking & Finance, Corporate/M&A, Energy & Natural Resources, Environment, Gaming & Licensing, Labor & Employment, General Commercial Litigation, and Real Estate.

Jones Walker was the only law firm in Louisiana to receive first band practice area rankings in every area Chambers USA covers for the state. Chambers USA rankings list law firms and attorneys in six bands, with the first band being the highest ranking a firm or attorney can receive.

In addition to being published in the Chambers USA guide, Jones Walker’s rankings are published online on the Chambers and Partners website. President George W. Bush Nominates Jones Day Partner Thomas Beck to Chair Federal Labor Relations Authority
President George W. Bush nominated Thomas M. Beck, partner, Washington DC, to chair the Federal Labor Relations Authority (FLRA). If confirmed by the Senate, Mr. Beck will oversee an independent federal agency created by Title VII of the Civil Service Reform Act of 1978 (also known as the Federal Service Labor-Management Relations Statute). The Statute allows certain non-postal federal employees to organize, bargain collectively, and to participate through labor organizations of their choice in decisions affecting their working lives.

The primary statutory responsibilities of the FLRA include: (1) resolving complaints of unfair labor practices; (2) determining the appropriateness of units for labor organization representation; (3) adjudicating exceptions to arbitrator's awards; (4) adjudicating legal issues relating to negotiability and the duty to bargain; and (5) resolving impasses during negotiations. In addition to sitting in a quasi-judicial capacity as a Member, the Chairman of the FLRA also acts as the chief executive officer of the agency and is responsible for agency-wide management, budget and other administrative activities.

Mr. Beck has practiced in Jones Day's Washington office since graduating from the University of Virginia School of Law in 1992. His primary area of practice during that time has been labor and employment law.

Steege Addresses Section 1113 and 1114 of the Bankruptcy Code at Restructuring Conference
Jenner & Block Partner Catherine L. Steege recently discussed some of the strategies associated with bankruptcy code sections 1113 and 1114 as well as the effect of the new accounting regulations related to bankruptcy proceedings at the Association of Insolvency and Restructuring Advisor’s 23rd Annual Bankruptcy & Restructuring Conference.

Sections 1113 and 1114 are regulations in the bankruptcy code that allow a debtor to reject a collective bargaining agreement (CBA) as part of bankruptcy proceedings, as well as limit the ability of a debtor to modify retirement benefits.

Ms. Steege, a member of the Firm’s Bankruptcy, Workout and Corporate Reorganization Practice, focused her remarks on the consequences a debtor could face when rejecting a CBA during bankruptcy proceedings. For example, she noted that when rejecting a CBA, the debtor must prove they have satisfied the pre-motion requirements and have met to negotiate with the appropriate parties. The debtor must also prove that they have attempted to reach a mutually satisfactory modification to the CBA or to retiree benefits.

Other topics of discussion included a summary of the new accounting rules, issued by the Financial Accounting Standards Board (FASB), which will mandate full recognition of the funding status of pension and other post retirement benefit plans on the debtor’s balance sheet.

Ms. Steege currently represents the Section 1114 Committee of Retirees in the Northwest Airlines Chapter 11 case and represented the Section 1114 Salaried and Management Retiree Committee in United Airlines' Chapter 11 proceedings.

Jenner & Block Represents GM in $5.6 Billion Sale of Allison Transmission
General Motors announced that it has reached a definitive agreement for the company to sell its Allison Transmission commercial and military business to The Carlyle Group and Onex Corporation for approximately $5.6 billion. The sale agreement covers substantially all of Allison Transmission, including seven manufacturing facilities in Indianapolis and its worldwide distribution network and sales offices. The transmission production facility in Baltimore, Maryland dedicated to GM's retail pick-up trucks will remain with GM. The transaction is structured to preserve GM and Allison's competitive strengths in their respective product lines and is expected to close as early as the third quarter of this year, pending union and regulatory approvals.

Godwin Pappas Announces Commercial Litigation Addition
Godwin Pappas Ronquillo, LLP is pleased to announce the addition of Associate Stefanie K. Major. Stefanie will practice in the Commercial Litigation Section. She most recently worked as an Associate in the Dallas office of Baron & Budd, P.C.

Ms. Major received a J.D. from Loyola University New Orleans School of Law in 2002, and a B.S. in Political Science from Texas A&M University in 1999. Chadbourne Represents Lenders in Financing for Three New York State Wind Farms
Chadbourne & Parke LLP is representing the lenders in a $561.5 million construction and term loan financing of three wind parks that are projected to collectively generate 282 megawatts of power in upstate New York.

The construction period debt financing totaling $485 million was jointly underwritten by Dexia Crédit Local, New York Branch as lead arranger, joint bookrunner and administrative agent, and HSH Nordbank AG, New York Branch as lead arranger and joint bookrunner. Another $76.5 million of letter of credit facilities are being provided by Dexia Crédit Local, New York Branch.

Under terms of the agreement, announced on June 27, affiliates of General Electric Co.'s GE Energy Financial Services will invest tax equity in the three wind parks upon completion of construction of the projects.

Working for Chadbourne in representing the lenders are New York project finance partner Richard Sonkin and associate Benjamin Koenigsberg. Also working on the deal are Washington DC partners Andrew Giaccia and Adam Wenner, New York partner Cindy Wenig and associates Rick Susalka and Allison Clements.

Noble Environmental Power, LLC, which through its affiliates is responsible for the construction of the wind parks, expects the wind parks to commence commercial operation during the fourth quarter of 2007.

The 100.5 MW Noble Clinton Wind Park, to be comprised of 67 GE 1.5-MW SLE wind turbines, will be located three miles south of the Canadian border in the town of Clinton. The 81 MW Noble Ellenburg Wind Park, to be comprised of 54 GE 1.5-MW SLE turbines, will be located in Ellenburg, Clinton County. The 100.5 MW Noble Bliss Wind Park, to be comprised of 67 GE 1.5-MW SLE turbines, will be located 30 miles southeast of Buffalo.

The New York State Energy Research and Development Authority will purchase 95% of the renewable energy certificates generated by the three projects under 10-year contracts. NYSERDA, a state agency, purchases the certificates to meet New York's Renewable Portfolio Standard, which requires that 25% of the state's power come from renewable sources by 2013.
