G&K Bolsters Land Use Practice
"Phoenix-based Gallagher & Kennedy, P.A., a full service business law firm, today announced the addition of a highly-specialized real estate legal team to the Phoenix office.

The new entitlement management team bolsters Gallagher & Kennedy’s land use practice and enhances its governmental affairs, real estate, environmental and litigation practices. The team, which came to the firm from Buchalter Nemer in Phoenix, includes shareholder Shelly McTee, associate David J. Ward, land planners Kurt Jones and Sarah Bongiovanni, and secretary Clare Kepple.

“We are pleased to announce the addition of such an experienced and well-versed entitlement management team to Gallagher & Kennedy,” said Dana Belknap, shareholder and head of the firm’s governmental affairs practice. “Their presence at the firm is significant due to the scope of work and overlapping practice areas that are involved in entitlement processes.”

The group is uniquely qualified to manage entitlement projects from the beginning of due diligence through completion, and help coordinate architects, engineers and other professionals involved in the entitlement process. Currently, the new team is working on projects in Arizona, Washington and Oregon. Their clients include the prominent real estate investment and development firm DMB Associates, Inc., Donahue Schriver and LGE Corporation.

Ms. McTee joins Gallagher & Kennedy as a shareholder, practicing real estate law with an emphasis on land use, entitlements and zoning. She represents developers as well as single- and multi-family homebuilders in connection with zoning, permitting processes, community and government relations, and entitlements. Ms. McTee also provides coordination of professional consultants such as land planners, engineers, neighborhood consultants and architects. A member of the Arizona Planning Association, Ms. McTee earned her juris doctor from St. Mary’s University in 1990. She completed her bachelor’s degree at the University of Texas in 1982.

Joining the firm as an associate, Mr. Ward practices real estate law with an emphasis on land use, entitlements and zoning. He represents homebuilders, commercial developers, real estate investors and business owners in acquisition/disposition, zoning entitlements and permitting processes, as well as community and government relations for commercial, residential and mixed-use real estate projects. Mr. Ward completed his juris doctor at Williamette University in 2000 and received his bachelor’s degree from San Diego State University in 1996.

The addition of two land planners, Mr. Jones and Ms. Bongiovanni, bolsters the firms existing resources. Ms. Kepple’s presence also adds new depth to Gallagher & Kennedy’s land use practice."

Stephen S. Walters Joins The San Francisco Office Of Allen Matkins
"Allen Matkins Leck Gamble Mallory & Natsis LLP, a leading California business and real estate law firm, announced today that Stephen S. Walters has joined the Firm as a partner in the San Francisco office.

Steve practices exclusively in the area of complex business and commercial litigation, and joins Allen Matkins from Stoel Rives LLP.

Steve has handled almost every type of complex civil case, including securities, consumer, and wage and hour class actions; breach of contract and business tort cases; environmental lawsuits; partnership and corporate disputes; creditors’ rights and bankruptcy matters; products liability and group tort actions; and civil rights and other actions involving government pension plans, federal agencies, and municipal corporations. He has particular expertise in complex energy cases, having been lead trial counsel for utilities, independent power producers, and fuel suppliers in many energy disputes involving tens to hundreds of millions of dollars in damages.

Steve is a Fellow of the American College of Trial Lawyers. He has been listed repeatedly in Best Lawyers in America and in Chambers USA: America’s Leading Lawyers for Business, and was selected as one of Oregon’s Top 50 SuperLawyers.

Steve received his J.D. from Stanford University Law School in 1972 and his B.S. from Stanford University in 1967. After graduating from law school, he was a law clerk to Chief Justice Warren E. Burger of the U.S. Supreme Court."

Debevoise Advises Clayton, Dubilier & Rice In Its Agreement To Sell Brakes To Funds Affiliated With Bain Capital
Debevoise & Plimpton LLP advised Clayton, Dubilier & Rice, Inc. ("CD&R") in its definitive agreement to sell Brakes to funds affiliated with Bain Capital. The transaction is expected to be completed within approximately two months, subject to customary regulatory approvals.

Brakes (www.brake.co.uk) is a leading supplier of food to the catering industry in the UK and France, which CD&R acquired in 2002. CD&R is a leading private equity investment firm with portfolio investments including Rexel Group, the world's leading distribution network of electrical supplies and The Hertz Corporation, among other market leaders. The firm is based in New York and London.

The Debevoise team was led by London partner James A. Kiernan with partners Richard Ward advising on tax and Alan J. Davies on finance, supported by associate Joel Wheeler. In Paris the team was led by corporate partner Antoine Kirry with associates Erwan Le Meur and Judith Beckhard-Cardoso.

Cooley Godward Kronish Named Top IP Firm by IP Law & Business; Ranked #2 for Plaintiff’s Representation
Cooley Godward Kronish LLP announced today it has been ranked the #2 Intellectual Property law firm in the country by IP Law & Business based on its representation of plaintiffs in patent litigation matters. The publication’s annual patent litigation survey ranks IP groups across the county by the volume of their plaintiffs, defense and total patent cases filed.

This is the second significant recognition Cooley's intellectual property practice has earned recently. Court of Appeals Upholds Dismissal of Fourth Class Action Lawsuit against Coors and Other Major American Beer and Spirits Manufacturers
The District of Columbia Court of Appeals has upheld a lower court’s ruling, dismissing “with prejudice” a class action lawsuit brought against Wiley Rein client Molson Coors in a lawsuit alleging alcoholic beverage industry ads were to blame for underage drinking. In affirming the decision of the Superior Court of the District of Columbia, the court found that the plaintiff did not have standing to bring the suit in his own right or as the representative of his putative classes and further that he failed to state any claim on which relief could be granted.

This decision is the first in several pending appeals of similar district court decisions in state and federal courts across the country. In all but one of these nearly identical cases, all claims against Coors and the other defendant American manufacturers of alcoholic beverages have been dismissed on the grounds of lack of standing and failure to state a claim. (A motion to dismiss currently is pending in North Carolina.) Each case has been brought by the same group of lawyers on behalf of plaintiffs claiming to represent a broad group of parents and guardians. These plaintiffs accused the defendants of false and misleading advertising, unfair trade practices in violation of consumer protection laws, unjust enrichment and negligence.

Sutherland Represents Morgan Stanley in Joint Ventures Totaling $2 Billion
Sutherland Asbill & Brennan LLP represented Morgan Stanley Real Estate Advisor, Inc. and one of its major pension fund clients in two joint ventures totaling approximately $2 billion.

Morgan Stanley’s pension fund client has entered into a joint venture agreement with publicly traded Nationwide Health Properties, Inc. (NYSE: NHP), a publicly traded real estate investment trust (REIT). The purpose of the venture is to acquire and develop assisted living, independent living and skilled nursing facilities. Subject to third-party approvals and other closing conditions, the ultimate value of the properties to be acquired is approximately $1 billion.

The second joint venture agreement is with REIT Inland Western Real Estate Trust, Inc. The purpose of this venture, valued at an estimated $1 billion, is to acquire and manage targeted retail properties in major metro areas of the country. The first portfolio of properties to be acquired by the venture has recently closed.

The cross-practice Sutherland team representing Morgan Stanley was led by Real Estate Partners H. Edward Hales, Jr. and R. Robinson Plowden and Associate Jennifer R. Van Ness; Partner M. Celeste Pickron and Counsel Robert B. Smith of the Tax Practice Group; and Partner Eric R. Fenichel of the Corporate Practice Group. The team also included Partners Lester M. Bliwise and William G. Rothschild and Associates Jason C. Kirkham, David F. Reid, Trent S. Shuping and Haley A. Sinclair, all of the Real Estate Practice Group.

Perkins Coie Names Bob Maynard Boise Office Managing Partner
Perkins Coie announced today that its Executive Committee has appointed Robert A. Maynard to succeed Richard Boardman as managing partner of its Boise office.

Maynard has been with the firm for a decade. He has nearly 30 years' experience advising and representing clients on a wide range of environmental, energy and natural resources, government contracting, land use, real estate, and water law matters.
