FIRM DEFEATS WRONGFUL TERMINATION CLAIM!
The U.S. Department of Labor Administrative Review Board recently rendered a favorable decision on behalf of a Firm large business transportation company client which had been accused of wrongful termination by a former employee.

In this case, an employee claimed he had been wrongfully terminated from his position under the employee protection provisions of the Surface Transportation Assistance Act (STAA) of 1982. The employee alleged the Firm's transportation company client violated the STAA by terminating his employment for engaging in the "protected activity" of voicing safety concerns and filing a complaint with OSHA re same. [Upon investigation, OSHA determined no safety violations had occurred].

After hearing argument on the employee's Complaint, an Administrative Law Judge at the DOL agreed with Firm Partner Byron Ames and issued a Recommended Decision and Order concluding that the employee was not terminated as a result of the protected acts, and that the employer did not violate the STAA. This Decision was later affirmed by the Administrative Review Board.

SOOJIN KANG: A FOUR TIME HONOREE!
Congratulations to Associate Soojin Kang of the Firm's Sherman Oaks office for her designation as a civil litigation "rising star" by the Southern California Super Lawyers Rising Star Edition. Although less than 3% of all lawyers in Southern California earn this recognition, Ms. Kang has now received this honor four years in a row! Ms. Kang is a member of the Firm's Employment Practice and Insurance Claims Practice Groups, specializing in the defense of employers against employee claims and insurance carriers accused of bad-faith claims handling practices. Way to go Soojin!

Harris Receives Award for Commitment to Diversity
SHB Director of Strategic Diversity Initiatives Tina L. Harris has received the 2007 J. Michael Brown Award for her public commitment to diversity in the legal profession. Presented last week by DuPont Legal at its Ninth Annual Minority Counsel Conference in Miami, Florida, the award honors a Minority Counsel Network member who has achieved success in efforts to recruit and promote law firm diversity. Tina is the fifth recipient of the award, which also recognizes personal dedication to the goals of the Minority Counsel Network.

Buford Epps Recognized as Diversity Advocate
Kansas City Partner Mischa Buford Epps (Business Law) has been recognized in the 2007 edition of MultiCultural Law Magazine as a Diversity Advocate, while the firm was named to the publication's lists of top 100 firms that champion the diversity cause, one of the top 100 firms for women and one of the top 25 law firms for Hispanics. Mischa, who has been with SHB for more than 12 years, has proved an exception to a disturbing trend that sees minority female attorneys leaving firms at high rates five to eight years after being hired. She credits her longevity to "a great mentor like Lisa White Hardwick," a former SHB partner currently serving on the Missouri Court of Appeals, and she is dedicated to serving as a role model in her own right. Mischa helped found the firm's Diversity Committee and once served as its chair. She is quoted as saying, "Recruiting and retaining lawyers of color are priorities for SHB and it is one of the reasons that I am still here and doing my part."

Chambers USA Names SHB to Elite Tier
Shook, Hardy & Bacon L.L.P. has received top honors from the prestigious legal publication Chambers USA, including recognition in the publication’s elite “Band One” of National Products Liability firms. In addition, several partners and the firm have been honored with state and national distinctions. The legal directory’s ratings were released at the publication’s annual awards event in New York City this past week.

Five SHB partners received national rankings in the Products Liability category. Those honored include Kansas City Partners Harvey Kaplan, Bill Allinder, Dave Erickson, Tim Pratt, and Scott Sayler. The firm was also recognized for excellence in Environment, Litigation: General Commercial and Labor & Employment in Missouri and Environment and Litigation: General Commercial in Florida.

In addition, 15 partners were ranked as top lawyers in their respective states and practice groups. In Missouri, those singled out for distinction include Kansas City Partners Bill Martucci (Labor & Employment); Rob Adams (Litigation: General Commercial); Dave Erickson (Environment); Bill Sampson (Litigation: General Commercial); Terry Satterlee (Environment); Gene Balloun (Litigation: General Commercial); Tim Pratt (Litigation: General Commercial); Joe Rebein (Litigation: General Commercial); Gene Voigts (Litigation: General Commercial); and Paul Williams (Litigation: General Commercial). In Florida, the prestigious legal guide recognized Miami Partners John Barkett (Environment); Ed Moss (Litigation: General Commercial); Ken Reilly (Litigation: General Commercial); and Bill Geraghty (Litigation: General Commercial).

Balloun Receives KBA Distinguished Service Award
Partner Gene Balloun (Business Litigation) last week received the 2007 Kansas Bar Association’s Distinguished Service Award for his dedication to the legal profession, longstanding support of his community and commitment to public service.

Gene has practiced law for some 53 years, having appeared before the Kansas Supreme Court and Kansas Court of Appeals in more than 150 matters. He has long been dedicated to providing pro bono legal work on behalf of Children’s Benefit Services for Families, CASA and many other organizations that benefit children.

He is an American College of Trial Lawyers Fellow and has been selected as one of the outstanding business litigators in Kansas in numerous editions of The Best Lawyers in America. Gene has received the Lifetime Pro Bono Award from Shook, Hardy & Bacon; pro bono awards from both the KBA and ABA; the Justinian Award from the Johnson County Bar Association; the Whittaker Award from the Lawyers Association of Kansas City; and the Lifetime Achievement Award from the Kansas Association of Defense Counsel. He has been named a distinguished alumnus by the University of Kansas School of Law and one of 24 “Legends of Kansas City” by Ingrams magazine. Balloun is a lifetime member of the KBA and has served on the Kansas Bar Foundation Board of Trustees. Balloun earned his B.S. and his J.D. from the University of Kansas.

Semmes’ Principal, Christopher R. West Elected President of The Bar Association of Baltimore City
The installation of new officers of The Bar Association of Baltimore City was conducted during a special dinner program and reception at the association’s 127th Annual Meeting held on May 23, 2007 at the Hyatt Regency Baltimore. Semmes principal, Christopher R. West was inducted as President of The Bar Association of Baltimore City.

The Bar Association of Baltimore City was the first Bar Association formed in the State of Maryland and is one of the oldest in the Nation. Incorporated on January 15, 1880, its mission is "to aid in maintaining the honor and dignity of the profession, to promote legal science, and further the administration of justice."

Mr. West previously served The Bar Association of Baltimore City as President-Elect (2006-2007); Vice President (2005-2006); Treasurer (2004-2005); President of the Baltimore Bar Foundation (2005-2006); Chair of the Public Relations Committee (1991-1992); Chair of the Program Committee (1990-1991); Chairman of the Young Lawyers’ Section (1986-1987) and as Vice-Chairman, Secretary and Treasurer of the Young Lawyers Section, from 1983-1986.

Mr. West concentrates his practice at Semmes representing small business investment companies and lending institutions. He represents both local and national companies doing business in Maryland, assisting them with their transactional needs and in complying with all applicable state and local regulations. Mr. West also maintains an active business litigation practice.

Many attorneys from Semmes and guests attended the event, including U. S. District Court Chief Judge Benson Legg, U. S. District Court Judge J. Frederick Motz, U. S. District Court Judge William Nickerson, U. S. Bankruptcy Judge E. Stephen Derby, U. S. Bankruptcy Judge James F. Schneider, Baltimore City Circuit Court Judge Robert Kershaw and retired Baltimore City Circuit Court Judge Thomas J. S. Waxter, Jr.
