Murray and Hoying "ice the cake," recover $1.7 million in attorneys fees and costs for environmental engineering company
After recently defeating a $31 million professional negligence claim brought by a real estate investment trust (REIT) against Johnson & Bell's client, an international environmental engineering company (see 7th Circuit Court of Appeals affirms judgment secured by Murray and Mueller..., below), Attorneys Dan Murray and Kathryn R. Hoying pursued an affiliate of the REIT to recover the attorneys fees and costs their client incurred in defending against the REIT's negligence claim.

Advancing a claim for contractual indemnity in a seven-day federal court trial before U.S. District Judge Ronald Guzman, a Chicago jury of 12 women returned a swift verdict for Johnson & Bell's client and against the REIT affiliate, awarding $1.7 million in attorneys fees and costs. Mr. Murray will next pursue further recovery of the attorneys fees and costs incurred by his client in the successful prosecution of the indemnity action.

Mr. Murray concentrates his practice in complex federal civil, criminal, and administrative litigation. He has won multi-million dollar judgments/settlements for clients in environmental cases, as well as defeated enforcement actions brought by the U.S. Environmental Protection Agency.

Jackson Kelly Names Mike Foster and Gretchen Callas as New Management Team
Mike Foster and Gretchen Callas assumed their responsibilities as Managing Member and Assistant Managing Member of Jackson Kelly PLLC, the two senior management positions in the Firm.

Mr. Foster was elected Managing Member after serving as Assistant Managing Member for five years, from 2002 to 2007. In addition to his role as Assistant Managing Member, he has held management positions in Jackson Kelly for years, twice serving on the Firm’s Executive Committee. In 1989, he established, along with West Virginia’s current Secretary of State, Betty Ireland, the Firm’s Employee Benefits Group, which provides consulting and benefits administration for tax qualified retirement plans. Mr. Foster has led that group since that time.
Ms. Callas joined the Firm in 1996. She is a litigator, representing clients in the aviation, pharmaceutical and heavy equipment industries. After six years of service as an officer of the Kanawha County Bar Association, Ms. Callas was elected as the organization’s President. She served in that position from 2005 to 2006.

Ms. Callas is the first woman to serve in one of the senior-most management positions in Jackson Kelly’s 185 year history. Noting this, Foster said, “Gretchen is a dynamic leader in the Firm and an outstanding advocate for her clients. That she is also a professional woman merely highlights the fact that our Firm understands that it is critical we offer our clients the diversity of thought and strategy that comes from people of different age, gender, and background.”

Al Emch, who has been the Firm’s Managing Member since 2002, will return to his practice as a full-time litigator. “Serving the Firm as CEO was a great honor for me. It was challenging and remarkably rewarding,” Emch said.

He identified two aspects of his tenure that were most satisfying to him. First, was continuing Jackson Kelly’s unwavering commitment to excellence in its people and all aspects of its service to clients and others. Second, he was pleased to have been a part of the Firm’s extensive involvement in, and support of community and professional organizations, higher education, and charitable groups and causes.


Noting Emch’s accomplishments, Foster said, “During Al’s tenure, Jackson Kelly has seen steady growth, and redoubled its efforts to serve the Firm’s clients and the local communities where we have offices.” Under his leadership, Jackson Kelly:

* Dramatically improved facilities at virtually all of the Firm’s offices;
* Opened a new office in Pittsburgh and established several new practices, all aimed at better meeting the changing demands of our clients.
* Invigorated the Firm’s image and significantly upgraded its marketing, client maintenance, and client development activities;
* Overhauled the Firm’s Information Technology functions, to improve the quality and timeliness of service to clients;
* Began several programs to enhance the work environment and well-being of attorneys and staff, including establishing a Firm-wide wellness program, and expanding health benefits; and
* Created a Firm-wide Diversity Committee.

Briggs Wins Famous Culpepper Mortgage Banking Case
"In highly publicized yield spread premium (YSP) case spanning nearly 12 years, Briggs and Morgan, Professional Association, announces the 11th Circuit Court of Appeals’ affirmation of the summary judgment and class decertification granted by the U.S. District Court for the Northern District of Alabama in Culpepper v. Irwin Mortgage Corporation.

The 11th Circuit opinion, which will now be known as Culpepper IV, represents a huge victory for Irwin Mortgage and another appellate win for Briggs’ mortgage banking team.

Members of Briggs and Morgan’s mortgage banking practice group have represented Irwin Mortgage since the lawsuit was first filed in 1996. Briggs’ team was led by Robert J. Pratte and also included attorneys Mark G. Schroeder, Alan H. Maclin, Brent R. Lindahl, Patrick McDavitt and Margaret K. Savage, among numerous other skilled attorneys and paralegals over the years."

Cultural Tourism DC Honors Akin Gump, Michael Fitzpatrick
"Cultural Tourism DC has presented the 2007 Discover the Heart of Washington Award to Akin Gump Strauss Hauer & Feld LLP and partner Michael A. Fitzpatrick, the firm announced today.

The Discover the Heart of Washington Award honors individuals and organizations that have made lasting contributions to the arts, heritage and civic life of the District of Columbia and have directly supported Cultural Tourism DC’s mission of strengthening the image and economy of Washington by promoting local culture and heritage as a tool for economic development.

Douglas Miller, vice chair of Cultural Tourism DC’s board of directors, stated, “Akin Gump’s generosity has come in many forms – financial support, event sponsorship, donations, pro bono counsel and even computers. Each gift has contributed significantly to the organization’s success.”

Over the six years of Akin Gump’s philanthropic work with Cultural Tourism DC, the city has quadrupled its funding for the organization.

Mr. Fitzpatrick, Cultural Tourism DC’s board chair, focuses his practice on litigation, including white collar criminal defense, civil and criminal antitrust, complex commercial, securities, class action, and intellectual property matters, as well as congressional investigations and regulatory law and policy. Prior to joining Akin Gump, he served as an assistant U.S. attorney in Washington, D.C., and as a senior advisor and special assistant to the administrator, Office of Information & Regulatory Affairs, in the Office of Management and Budget. Mr. Fitzpatrick joined Cultural Tourism DC’s board in 2001, and was elected board chair in 2004.

Mr. Miller said of Mr. Fitzpatrick, “We were fortunate to find in Michael someone who embodies exactly what Cultural Tourism DC is about. He understands history, at its very core, and the importance of preserving it for the future.”

Cultural Tourism DC is a nonprofit coalition of 185 arts, heritage, cultural and community organizations throughout the capital. With partners in tourism, hospitality, government and business, Cultural Tourism DC promotes local culture and heritage as a tool for economic development."

LeBoeuf Lamb Advises Rexam on US$297 million Acquisition of Russian Beverage Can Maker
"LeBoeuf, Lamb, Greene & MacRae has advised Rexam, the global consumer packaging company and the world's leading beverage can maker, on its agreement to acquire Rostar, the Russian beverage can maker, from EN+ Group Limited, the partner of Rusal, the Russian aluminium group, for a total cash consideration of US$297 million, including borrowings assumed.

The acquisition, which requires regulatory approvals, including approval from the Federal Antimonopoly Service of the Russian Federation, is expected to complete during the fourth quarter of 2007.

Rostar has two manufacturing facilities: one near Moscow with an annual capacity of some 1.3 billion beverage cans, and one near St. Petersburg with an annual capacity of 1.7 billion beverage cans.

Commenting on the acquisition, Brian Zimbler, managing partner of LeBoeuf Lamb's Moscow office, said: ""It is a pleasure for us to advise Rexam, which is an experienced and committed investor in Russia, as it expands its business here.""

The LeBoeuf Lamb team advising Rexam on the deal consisted of Brian Zimbler (partner, Moscow/London), Ilia Miniaev and Dmitri Kounitsa (counsels, Moscow); Alexei Matsuev, Evgeny Sychev, and Angelina Suvorova (associates, Moscow); and Leanne Cox and Peter Davis (associates, London). Rusal was represented by Bryan Cave (London)."

Allen Selected as 30 Under 30 Award Recipient
Carla Allen has been honored in the 2007 class of St. Louis Business Journal’s 30 Under 30 award recipients. She is recognized as an outstanding young professional in the St. Louis area who has the potential of being in the next generation of "movers and shakers." Allen is a member of the firm’s Corporate Services Group where she focuses her practice primarily on general corporate law, particularly in the areas of governance and compliance, mergers and acquisitions, real estate, and tax as it relates to exempt organizations.

Daniel Levin Bolsters Corporate Defense Team in Washington
White & Case LLP announced today that Daniel Levin has joined the Firm's Global White Collar practice as a new partner in its Washington, DC office.

Levin has more than 25 years of litigation and regulatory experience both as a front-line federal prosecutor and in high-level positions at the US Department of Justice, Federal Bureau of Investigation and National Security Council.

"Dan's extensive experience in the public sector will support the evolving needs of our clients and the wide range of white collar issues they may face," said George J. Terwilliger, III, head of the White Collar practice.

"Economic globalization has added new issues and increased complexity to business regulation and enforcement," said Levin. "White & Case's unmatched global platform provides extraordinary opportunities to work with clients on the most challenging and crucial issues."
