King & Spalding Secures Reversal for The Home Depot, Inc.
King & Spalding, a leading international law firm, earned a significant appellate victory for its client The Home Depot, Inc., dismissing a putative nationwide consumer class action on the grounds of forum non conveniens and improper venue.

The decision of the Illinois Fifth District Court of Appeals on June 26, 2007, reversed an earlier Madison County Circuit Court’s denial of a motion for dismissal. If not overruled the trial court’s decision would have allowed a claim under the Missouri consumer protection law to have been tried in an Illinois state court. In its lengthy opinion, the Court of Appeals noted that this was a question of first impression under Illinois law before ruling in favor of Home Depot.

The case is but the most recent appellate ruling restricting the jurisdiction of the southern Illinois courts which have for years been the favorite of the plaintiffs bar.

The Home Depot Inc. is the world’s largest home improvement specialty retailer with stores in all 50 states, the District of Columbia, Puerto Rico, U.S. Virgin Islands, 10 Canadian provinces, Mexico and China.

The King & Spalding legal team representing The Home Depot, Inc. was led by litigation business partners Dwight Davis and Stewart Haskins, both of the Atlanta office.
