Roetzel & Andress Adds Five Attorneys; Relocates Washington, D.C. Office
The law firm of Roetzel & Andress is pleased to announce the addition of five attorneys to its Washington, D.C. office. New partners to the firm are Gary Adler, Steven Cundra, Donald Dinan, and John Stackhouse. Amy Epstein Gluck joins the firm as an associate.

The firm also has relocated its Washington, D.C. office to larger quarters at 1300 Eye Street, NW, Suite 400 East, Washington, D.C. 20005. The phone number remains the same (202.625.0600).

Gary Adler counsels clients on litigation matters and has experience in a broad range of civil litigation at both the trial court and appellate levels. Mr. Adler also acts as general counsel to various corporations, partnerships and trade associations, offering counsel on a wide range of issues including structuring organizations, handling business transactions and negotiating contracts. Additionally, Mr. Adler represents professional athletes.

Steven Cundra focuses his practice in administrative law, corporate and business services, government contracts and relations, government audits and investigations, government grants, litigation and professional malpractice. Through his 32 years in practice, he has gained a national reputation in defending federal OIG audits and investigations, particularly by the U.S. Departments of Labor, Treasury, and Health and Human Services, and in prosecuting non-selection actions and appeals. He has also represented foreign governments and entities involved in international disputes. Additionally, Mr. Cundra has appeared and argued before the United State Supreme Court.

Donald Dinan concentrates on import and export licensing matters, customs enforcement, and business transactions with foreign companies or foreign nations, primarily in Europe and China. He has experience in antidumping cases and Section 337 cases. Mr. Dinan also focuses on Federal Court litigation and trans-national litigation and international arbitration. Prior to entering private practice, he served as an attorney in the United States International Trade Commission, holding the positions of Director of the Unfair Imports Investigation Division and Chief of the Patent Branch of the Division, among others.

John Stackhouse focuses his practice in the areas of commercial and construction litigation. He also has experience in Telecommunications Law, Government Audits & Investigations, Employment Law, Bankruptcy, Personal Injury Litigation and Real Estate Litigation. He has represented a variety of clients including builders, developers, general contractors, subcontractors, building owners, landlords, lending institutions, and Fortune 500 companies.

Amy Epstein Gluck concentrates her practice on litigation including general civil, commercial, civil rights, consumer fraud, wrongful death, legal malpractice, personal injury defense, lender liability, and corporate/securities litigation; and administrative law and government contracts and grants concerning audits, terminations for cause, non-selection, and debarment proceedings. She has represented individuals and corporate clients in various Federal and state district courts in Washington, D.C. and Virginia, before federal tribunals, and in mediation.

Media Advisory: House of Representatives Expected to Vote for CFIUS Reform Legislation Noted Pillsbury International Trade Lawyer Comments on Impact of Reform on Foreign Investment in the U.S.
Washington, DC: A year after Congress blocked Dubai Ports World’s (DPW) acquisition of a company managing U.S. port facilities and stoked fierce debate over the appropriate balance between U.S. security interests and open foreign investment markets, the U.S. House of Representatives tomorrow is expected to adopt the U.S. Senate’s legislation reforming the Committee on Foreign Investment in the United States (CFIUS), the inter-agency body that vets foreign acquisitions of U.S. companies. “Passage of the legislation should bring to a close a controversial period for foreign investors,” says Christopher Wall, a noted international trade attorney in the Washington, DC office of Pillsbury Winthrop Shaw Pittman LLP. “After DPW, the foreign investment review process became highly politicized and Congress’ frequent and vocal criticism of the Administration’s handling of national security reviews scared foreign investors, who feared they might become the target of the next uproar.”

While Congress has been working on the new legislation, CFIUS has already tightened its procedures. Wall notes that these changes have anticipated the requirements of the new law and the further procedural changes required by the legislation will be incremental. “Most importantly, however,” Wall says, “the new law will give Congress greater confidence in the CFIUS review process, so future reviews will not be as political.”

Still, foreign investors will find that the new law will have a significant impact on transactions. It greatly expands the concept of national security to include critical infrastructure, homeland security and energy security. Consequently, many more types of transactions are potentially subject to review, such as acquisitions of ports and power plants, LNG terminals, toll roads and tunnels. Also, the new law provides for the more frequent use of so-called “mitigation agreements” to address perceived national security risks. Wall points out that such agreements can impose requirement that go beyond existing regulations and potentially discriminate against foreign investors.

Even with the new law, Wall observes that the United States remains among the most open markets for foreign investment in the world, but the DPW transaction and the controversy over CFIUS reform have had a cost. As Wall says, “The reality is that there are other countries that welcome foreign investment with the jobs and increased trade such investment brings.” In part because of concerns that foreign capital would go elsewhere, the Administration recently issued a statement encouraging foreign investment in the United Sates. “But other countries have been watching how the United States treats foreign investment and are tightening their review procedures too, making it more difficult for U.S. companies to invest abroad.”

OFP Attorneys to Speak at 2007 VA State SHRM Conference
Misti Mukherjee and Timothy McEvoy, principals with law firm Odin, Feldman & Pittleman, will speak at the 2007 Virginia Society for Human Resource Management (SHRM) conference in October.

The Virginia State SHRM Conference offers world-renowned keynote speakers, an extensive schedule of professional development and educational sessions, and networking opportunities. Mukherjee and McEvoy will present their session, Conducting Investigations and Detecting Deception, on Thursday, Oct. 4 at 10:45 a.m. The conference will be held at the Hyatt Regency Crystal City at Reagan National Airport.

Mukherjee, co-chair of the firm’s Labor & Employment group, is a human resources community leader and frequent speaker on employment law issues. Her practice is management-oriented, and she counsels and trains businesses, non-profit organizations and trade associations to anticipate and avoid labor and employment problems. McEvoy, a member of the firm’s Litigation practice group, represents clients in many types of complex matters including employment law compliance and litigation.
