Briggs and Morgan Obtains Jury Verdict in Medical Malpractice Suit
"Briggs and Morgan, Professional Association, announces its success in obtaining jury verdict on behalf of an emergency physician in a medical malpractice lawsuit brought in Minnesota district court. After an eight-day trial, the jury found no negligence on the part of the defendants.

“We are very pleased that the jury responded to questions as we thought they should,” says attorney John M. Degnan, who represented the defendants in the case. “This decision only serves to validate the fine medical care provided by our clients.”

Degnan, an experienced trial attorney, has been involved in defending medical malpractice and other professional liability suits for more than 30 years."

Greenberg Traurig Continues Expansion of Silicon Valley Corporate and Securities Practice with Addition of Garth Gartrell
The international law firm of Greenberg Traurig, LLP today welcomed P. Garth Gartrell. Previously with Heller Ehrman LLP, where he was a member of the executive compensation group, Gartrell joins the firm’s corporate and securities practice as a shareholder. With more than 25 years of legal experience, Gartrell marks the firm’s third Silicon Valley addition to the practice group this year.

“Garth has built an impressive practice. He both expands and deepens the firm’s capabilities in executive compensation, especially with regard to the public securities and mergers and acquisitions aspects of our practice.” Following the recent additions of Bill Zisko and Tim Tomlinson, Garth’s experience further supplements our menu of critical business services to Silicon Valley companies,” said Todd Rumberger, co-managing shareholder of the Silicon Valley office. “As we continue to grow this office, we are committed to bringing aboard attorneys, such as Garth, that provide the depth of knowledge, experience and reputation to establish GT as a leader among bay area law firms.”

Gartrell focuses on all aspects of equity compensation, including securities, tax, corporate, accounting, labor aspects of equity compensation plans, and Employee Retirement Income Security Act (ERISA). He represents private and public companies and senior executives regarding the full range of employment compensation issues associated with fast growth, technology businesses, frequently being called on to counsel compensation committees, boards and individual boards members on not only technical rules, but their practical application.

Gartrell has extensive experience in Securities and Exchange Commission reporting and disclosure, insider transactions and reporting, and international plan coordination. His practice also encompasses equity compensation aspects in mergers and acquisitions, public and private company equity consulting and compliance. Gartrell also advises clients regarding accounting issues and compensation design and compliance when forming corporate technology company formation and IPOs, as well as when developing substantial international option and stock purchase plans.

A certified accountant, Gartrell is a former chair of the California Bar Association Section on Taxation and a founding editor of California Tax Lawyer. He also has directed the San Diego School of Law Graduate Tax Program and was a director and visiting professor of the Graduate Tax Program at the University of San Diego School of Law. Gartrell is a trustee of the San Diego County Employees Retirement Association and a member of the Federal Securities Committee, ABA Business Law Section.

Gartrell earned his J.D., magna cum laude, from the Ohio State University Moritz College of Law (1981), where he graduated Order of the Coif. He earned his LL.M. from Harvard Law School (1992) and his B.A., magna cum laude, in accounting from Capital University (1976).

Shearman & Sterling Represents Aegean Airlines in its International IPO and Listing on the Athens Exchange
Shearman & Sterling represented Aegean Airlines S.A. in its international initial public offering and listing of its shares of common stock on the Athens Exchange. The transaction closed on July 9, and trading in the shares will commence on July 11.

Aegean Airlines is a major regional carrier in Europe and has twice been voted the best European airline by the European Regional Airlines Association. Despite its short operating history, it now enjoys the leading domestic market position in Greece and a growing market position internationally in routes connecting Greece to major European destinations. The proceeds of the IPO, which involved 25% of the airline’s share capital, will be approximately €125 million and will be used to finance a portion of the airline’s €1 billion fleet renewal program that will replace the entire Boeing fleet with brand new Airbus A-320 aircraft.

The Aegean Airlines IPO was the most significant initial public offering out of Greece recently and the first ever securities offering of a Greek issuer that was structured as a combined public offering in Greece under the local rules implementing the EU Prospectus Directive and an international offering to institutional investors pursuant to Rule 144A and Regulation S under the U.S. Securities Act of 1933.

DLA Piper adds Severn Trent man Clive as Utilities Legal Director
DLA Piper has secured the services of former Severn Trent Water General Counsel and company secretary Clive Mottram.

Clive, aged 48, has joined DLA Piper's Finance & Projects division as a Legal Director, working within the specialist energy and utilities team headed by Neil Upton, Head of Power and Water at DLA Piper. Clive will lead the firm's water practise, focussing initially on the water sector in the UK.

"Clive brings to DLA Piper not only an in-depth knowledge of the water industry but also practical experience of the way it works within its regulatory and statutory framework," said Neil.

DLA Piper has a market leading utility practice with a network of over 200 dedicated lawyers in offices around the world, each of whom has experience of advising governments, sponsors, lenders and consortia on all aspects of the utility sector including power, water and waste water infrastructure development. The utility practice is multi-disciplinary teams of lawyers, drawn from areas such as Finance & Projects, Real Estate, Environmental, Corporate, and other departments.

Over the next five years, DLA Piper will continue to develop its utility practice in Birmingham in line with its global strategy, to create one of the largest specialist teams of its kind in the world. The utilities team will work with its clients to help shape their energy and water policies around the world over the coming decades.

Neil commented: "To those whose first reaction is that it may seem strange to base a world class team in Birmingham, I would point out that here in the Midlands we sit very neatly in an area that is home to organisations like Severn Trent, Ofwat, National Grid, e.on and npower so there is a vast amount of both interest and expertise relatively close to hand."
