JSM Indochina Enters London Stock Exchange's AIM Market
The O'Melveny offices in London and Los Angeles collaborated to advise the investment management team and company, JSM Indochina Ltd. ("JSM Indochina"), in its recent fund raising and admission to the AIM Market. JSM Indochina raised US$220 million, and it is expected that the investment manager's principal, Craig Jones, will contribute an additional US$30 million worth of real estate assets to JSM Indochina within the next six months, in exchange for JSM Indochina shares.

Southern California-based JSM Construction is a well-established real estate developer, however it is Craig Jones and his team's first venture into the capital markets to raise funds for property development. The investment manager and JSM Indochina will focus on real estate development opportunities (serviced apartments and retail centers) in urban areas of major cities in Vietnam and Cambodia. The fund raising was led by Lehman Brothers International (Europe) and Evolution Securities China, JSM Indochina's nominated adviser.

The O'Melveny team was led by partners Jack Hardy and Chris Ashworth and counsel James Mulholland and Deborah Festa, while associates Andrew Ryan, Don Melamed, and Jonathan Atha provided significant support. Partner Luc Moritz and associates Justin Bowen and Anita Choi advised on tax matters; partners Rob Plesnarski and Bill Satchell advised on US regulatory matters; counsel Summer Conley advised on ERISA matters; and further corporate assistance was provided by counsel Lewis Chong and Francisco Flores, associate Rufus Gandhi, and trainee Suzanne McNeill. Partners Seth Aronson and Steve Olson also provided invaluable assistance to the client during the transaction.

Finnegan Henderson Appoints New Leadership in Taiwan
Finnegan, Henderson, Farabow, Garrett & Dunner, LLP, one of the world’s largest intellectual property law firms, announced today that Douglas S. Weinstein has been appointed managing partner of the firm’s office in Taipei, Taiwan, which is known locally as Fei Han Foreign Legal Affairs Law Firm. Mr. Weinstein is a member of the Taipei Bar Association and has been resident in the country since July 2006.

“Over the past year I have enjoyed meeting and working with technology industry leaders throughout Greater China,“ said Mr. Weinstein. “I look forward to further developing these relationships and to leading the office through its future growth, as well as supporting the firm in its expansion in the region.” Finnegan Henderson recently applied with the Chinese Ministry of Justice for a license to open a Foreign Representative Office in Shanghai.

A graduate of Franklin Pierce Law Center, Mr. Weinstein practices all aspects of United States intellectual property law, with a particular emphasis on client counseling, patent prosecution, and litigation of patent and trade secret cases. He frequently speaks before academic, business, and legal communities on topics ranging from Federal Circuit patent cases to business method and software patent practice.

Located in Taipei’s business center since March 2003, the office provides a full range of U.S. intellectual property services to companies in Taiwan, including litigation, management, licensing and counseling, and prosecution of U.S. patents and trademarks. The Taipei office is fully supported by a local professional staff of attorneys, patent agents, and administrative staff who are fluent in English, Mandarin, and Taiwanese. Dr. Hsuanyeh Chang, a technical specialist, will relocate to Taipei this month from the firm’s Washington, DC office.

“Since opening nearly five years ago, the Taipei office has integrated into the local intellectual property rights community, due in large part to the leadership and guidance provided by John R. Alison, who served as managing partner for three years and continues to actively service clients in the Greater China region,” commented firm chairman Thomas H. Jenkins. “We are delighted to have Doug take the helm and continue the course of enhancing the office’s resources and relationships as a member of the international legal community.”

Baker & McKenzie Acts for Russian Diamond Producer in Landmark European Court Judgment
The European Court of First Instance has today annulled an earlier European Commission settlement decision accepting commitments from De Beers, the world's largest rough diamond producer, to cease all purchases of rough diamonds from ALROSA Company, the world's second largest rough diamond supplier.

This is the first time the European Court has set aside a Commission settlement made under the EU's modernised competition enforcement regime. It is also the first time the European Court has recognised the need to proceed on an urgent basis outside of the merger context.

In February 2006, the Commission settled an investigation into an agreement by ALROSA to supply rough diamonds to De Beers by accepting commitments from De Beers to cease buying any rough diamonds from ALROSA. ALROSA did not consent to this settlement. The European Court today ruled that the Commission should have checked that the settlement was proportionate but did not do so, and should also have given ALROSA a full right to be heard on the settlement, which it did not.

Samantha Mobley, Competition partner at Baker & McKenzie, said: ''We are delighted with this judgment, which has implications beyond the facts examined. The Court confirmed that, when settling cases, the Commission must respect the principle of proportionality. Furthermore it must give relevant parties, such as our client, their full procedural rights.''

The Baker & McKenzie team advising ALROSA was led by Competition partners Samantha Mobley and Keith Jones. Romano Subiotto in Brussels and David Sabel in London from Cleary Gottlieb & Hamilton LLP, acted as co-counsel to ALROSA.

Banks Elected to Law Center Board of Directors
Stradley Ronon partner Danielle Banks was recently elected to the Public Interest Law Center of Philadelphia’s Board of Directors. The Law Center is governed by the board, whose purpose is to provide management support and fiscal oversight to the Law Center staff and review programming to ensure that it is consistent with the organizational mission.

The Law Center’s mission is to advance the Constitutional promise of equal citizenship to all persons irrespective of race, ethnicity, national origin, disability, gender or poverty through the provision of legal and technical assistance.

As a partner in Stradley Ronon’s litigation practice group, Banks represents clients in employment and commercial litigation matters. In addition to her commercial practice, Banks also represents the underprivileged and underrepresented in cases that impact the community. Banks has been involved in several high profile and precedent-setting civil rights cases including successfully representing Ramona Africa in the MOVE case and representing African-American and learning disabled student-athletes in suits against the NCAA.

Complex Business Litigation Partner Chris Reeder Joins Sheppard Mullin Los Angeles
Christopher S. Reeder has joined the Los Angeles office of Sheppard Mullin Richter & Hampton LLP as part of the firm's Business Trial practice group. Reeder, and a team of three attorneys who are joining Sheppard Mullin with him, most recently practiced with Lord, Bissell & Brook in Los Angeles.

Reeder represents clients in the areas of commercial law, real estate, franchise, business practices, intellectual property, employment and labor, construction, aviation, entertainment, hospitality and class action litigation. He also counsels clients in real estate transactions, lending and brokerage laws, construction contracting and licensure requirements, advertising, business practices, and employment law.

Reeder is joined by special counsel Beverly Lu and associates Gabriel Green and Gene Wu.

"Chris brings diverse trial experience to our litigation group, one of the firm's core practices. The team's practice dovetails well with other key groups in the Los Angeles office, such as real estate, employment and IP," said Guy Halgren, chairman of the firm.

Reeder received his J.D., magna cum laude, from University of Dayton School of Law in 1997 and his B.S. from the University of the State of New York in 1993.
