Hogan & Hartson Wins Antitrust Claim for MySpace.com
Lawyers with Hogan & Hartson LLP recently secured an antitrust victory for firm client MySpace, Inc. This is the first antitrust case ever to address whether a social networking Web site can prevent its users from posting links to competitors' Web pages on its Web site.

On June 4, 2007, The Honorable A. Howard Matz, U.S. District Court Judge in the Central District of California, dismissed the antitrust claims with prejudice. In his decision, the judge ruled that excluding a competitor's Web page links from MySpace.com is not anticompetitive and did not cause antitrust injury, and found that MySpace had no duty to promote its competitors' Web sites by displaying active links to those sites.

MySpace was represented by a team of Hogan & Hartson lawyers from its Los Angeles and Washington, D.C. offices, led by partners Rick Stone and Corey Roush with assistance from associates Logan Breed and David Singer.

Gibson Dunn Ranks 9th on American Lawyer's A-List
For the second consecutive year, Gibson Dunn was named to American Lawyer's A-List, moving to ninth slot from twentieth. The A-List comprises 20 law firms that are considered to be the "top tier of elite firms," measured by financial performance, associate satisfaction, commitment to pro bono and diversity. The American Lawyer considers this ranking to be its most prestigious honor. The A-List is featured in the July 2007 issue.

Salans advises Carrefour in the acquisition of Ahold Polska
Salans advised Carrefour, a multinational retailer, on the acquisition of the polish group Ahold Polska from Ahold Group, a multinational retailer primarily based in Europe and the United States.

The sale was valued at 375 million euros.

This transaction, which was recently approved by the Polish competition authorities, will allow Carrefour to count almost 330 stores in Poland and to position itself as Poland's second largest food retailer.

Salans advised Carrefour:

* On corporate and real estate aspects: Marek Grodek and Tomasz Dabrowski, Partner in the Warsaw office, assisted by Pirouzan Parvine and Bartosz Clemenz.
* On antitrust aspects: Mélanie Thill-Tayara on the European aspects before the European Commission and Agnieszka Stefanowicz-Baranska on the national aspects before the Polish competition authorities, assisted by Emmanuelle Van den Broucke in Paris and by Joanna Sapiezko in Warsaw.

Wainwright gets defense verdict in medical malpractice trial
"McCormick Barstow attorney, Dan Wainwright, concluded a three-week jury trial today when he received a defense verdict in a medical malpractice case.

In this case, Mr. Wainwright represented a local physician who was accused of failing to diagnose that the Plaintiff had suffered or was about to suffer a debilitating stroke. The jury deliberated for less than three hours before returning a verdict on behalf of Mr. Wainwright and his client.

This three-week trial was held in Fresno Superior Court, with the Hon. Mark Snauffer presiding.

Donald Calloway, Jr., Joins Lathrop & Gage as an Associate
Joel Voran, CEO of Lathrop & Gage L.C. announced today Don Calloway has joined the St. Louis, Mo., office as an associate in the business disputes section of the business litigation practice area.

Prior to joining the firm, Calloway practiced for Thompson Coburn L.L.P. He focuses his practice on a variety of complex legal issues in state and federal court litigation proceedings and has conducted pro bono breach of contract bench trials in Missouri state court, at circuit and associate circuit levels, and has argued pre-trial motions in Missouri circuit courts. Calloway also represents both artists and management in media and entertainment legal matters.

Calloway is an instructor for the federal procedure exam review sessions for first year law students at St. Louis University.

He earned his bachelor’s degree, cum laude, from Alabama A&M University in 2002 and his juris doctorate from Boston University School of Law in 2005. Calloway is a member of the Mound City Bar Association, Bar Association of Metropolitan St. Louis, The Missouri Bar, Illinois Bar Association and the American Bar Association. He is an assistant scout master, Boy Scouts of America, Troop 44, and youth organizer, tutor and mentor for the Matthews Dickey Boys’ and Girls’ Club, and an active member and youth ministry volunteer for the Greater Mr. Carmel M.B. Church.

Barbara A. McBride, a litigation paralegal at Hangley Aronchick Segal & Pudlin, received the 2007 Philadelphia Association of Paralegals President’s Award for her dedication to the profession. This award is given at the discretion of the President of the Association to those who have gone above and beyond the duties of their current position. Ms. McBride has served two terms on the Board of The Philadelphia Association of Paralegals and is currently the Treasurer.

Ms. McBride has been a paralegal for 20 years and is a graduate of Temple University. In addition to serving as Treasurer of the Board of the Philadelphia Association of Paralegals, she is also a contributing author to the Association’s newsletter, The Philadelphia Forum and a frequent presenter at local colleges and universities for the Association.

Bingham Achieves Victory in Case Against City of Santa Monica
The California Court of Appeal has denied the City of Santa Monica’s request to compel arbitration in a dispute over unpaid attorneys' fees claimed by the lawyers who represented the city in a prior water contamination suit against several major oil companies, reports the Santa Monica Mirror. The ruling signifies a major victory for Bingham and the three law firms it represents in the case: Baron & Budd; Miller Axline & Sawyer; and Sher Leff, and likely clears the way for a case that has been stayed for almost 18 months pending the outcome of an appeal to proceed to trial. According to the Santa Monica Mirror, the court affirmed the denial of the city’s motion, stating that it had lost its right to arbitrate the dispute by “engaging in full-blown, costly court litigation for 17 months” before seeking arbitration. The case arises out of the city’s June 2000 retention of a group of California and Texas lawyers to help sue several oil companies it believed were responsible for polluting its drinking water. The case was settled in late 2003 with a cash payment to the city and an agreement to fund a water treatment facility, but the lawyers involved contend the city never paid their contingent fee agreement. The latest ruling follows a series of motions filed by the city, all of which were denied. Santa Monica partners Marshall Grossman, Roland Tellis, Jonathan Loeb and Seth Gerber, and associates Sara Jasper and Jay Barron are working on the case for Bingham.
