Paris Office Wins Competition Case for France Telecom
Sabine Nauges and Julien Martinet of the Paris office won a competition case for client FRANCE TELECOM against the internet provider FREE. FRANCE TELECOM brought proceeding against FREE in May for unfair advertising. FREE was found guilty by the Paris Court of Appeal. The Court stated that FREE mislead customers by sending more than 2000 thousands brochures to condominium owners stating falsely that the connection of their building to optic fibre was compulsory by virtue of a statute. FREE has been sentenced to send a disclaimer to all the adressees of the misleading brochure with penalties for delay of 10.000 euros per day and to pay damages to FRANCE TELECOM.

Holland & Knight Expands Its West Coast Real Estate Practice with Addition of Kenneth Kecskes in the San Francisco Office
Kenneth A. Kecskes has joined Holland & Knight as a partner in the firm's San Francisco office. Kecskes brings a wealth of experience in handling a wide variety of complex real estate projects, including master planned and mixed use communities, hotels and resorts, corporate campuses, and a major league ballpark, further strengthening Holland & Knight's West Coast Real Estate Practice.

Kecskes has assisted developers of large master planned, mixed use communities in the full life cycle of their development from initial acquisition to the sale of lands to merchant home builders and commercial developers. He also has experience in acquisitions and dispositions, project development documentation, construction contracts, developer/equity participant venture formation, and analysis of land use entitlements. He has drafted and reviewed commercial and industrial leases on behalf of biotechnology and software companies, dot-coms, retailers and landlords. In addition, he has advised publicly traded and private companies on the real estate issues involved with mergers, acquisitions and spin-offs.

By adding Kecskes to the Real Estate Group in San Francisco, Holland & Knight further deepens its expertise in the development of large, mixed-use master planned communities. The firm is now advising clients on 13 different master planned communities in various stages of development in California from San Diego County to San Benito County, totaling more than 20,000 residential units and over 5.5 million square feet of commercial space. Kecskes' background also includes working on a team of lawyers that was responsible for the development of Petco Park in downtown San Diego, the home of the San Diego Padres. Holland & Knight is currently advising the ownership of the Oakland A's in its efforts to build a new ballpark in the San Francisco Bay area and is assisting the San Jose Earthquakes with the development of a new soccer stadium.

"Ken's experience in so many facets of the real estate industry will continue to expand the depth and breadth of our West Coast real estate reach," said Susan Booth, head of Holland & Knight''s West Coast Real Estate Practice. "His work with a diverse group of industries, including construction, telecommunications and biotechnology, will play a pivotal role in further developing our practice."

Holland & Knight's San Francisco Real Estate and Land Use Practice has grown significantly over the last few years. Less than two years ago the firm added a large team of land use and environmental lawyers from Beveridge & Diamond, headed up by Jennifer Hernandez and Elizabeth "Betsy" Lake. The Real Estate Group has also added additional associates to support its active real estate practice, which includes work for some of the world's leading hotel brands on large, master planned hotel and resort communities in the United States, Latin America and the Caribbean. Holland & Knight’s Real Estate Section is the largest real estate practice in the United States.

Prior to joining Holland & Knight, Kecskes was with DLA Piper, where he was co-chair of that firm's Homebuilding and Master Planned Communities Practice Group. He earned his B.A. from the University of California at Los Angeles and his J.D., cum laude, from the University of San Diego School of Law.

Virginia Super Lawyers Honors Hogan & Hartson Attorneys

Federal Court of Appeal Rules in Favor of Dykes on Bikes in Landmark Trademark Case
The San Francisco Women’s Motorcycle Contingent announced today that the U.S. Court of Appeals for the Federal Circuit issued a final ruling yesterday affirming the group’s trademark of the name “DYKES ON BIKES.” The Court of Appeals rejected the argument that the name “DYKES ON BIKES” was disparaging to men. Barring Supreme Court intervention, yesterday’s decision removed the last obstacle to registration of the trademark.

“After a three year court battle, we are thrilled ‘DYKES ON BIKES’ will be protected under trademark and recognized as a celebration of our identity,” said Vick Germany, the group’s president. Soni Wolf, SFWMC secretary said, “This is a great victory for dyke pride and visibility -- not just for our group, but for lesbians across the country who value ‘DYKES ON BIKES’ as an affirmation of lesbian strength and resilience.”

“We are delighted that ‘DYKES ON BIKES’ has been vindicated and that it is now clear that asserting pride in being ‘DYKES ON BIKES’ does not impact others negatively,” said Brooke Oliver, the lead attorney on the case. “A lone person with a political objection to women’s political speech does not have standing to object to a trademark.”

“The ‘DYKES ON BIKES’ trademark is an important symbol to the lesbian, gay, bisexual and transgender community,” said Greg Gilchrist of Townsend and Townsend and Crew. “Although it took a long time, the Trademark Office eventually agreed that the mark deserved fair and equal protection under the trademark laws. In this latest proceeding, we are grateful that the Federal Circuit agreed that bias against the San Francisco Women’s Motorcycle Contingent was no basis for further delay.”

The Trademark Office initially rejected the group’s application for a trademark in 2004, on the ground that the name “DYKES ON BIKES” is allegedly disparaging to lesbians. In response, Brooke Oliver and the National Center for Lesbian Rights submitted more than two dozen expert declarations from scholars, linguists, psychologists, and activists showing how the word “dyke” has evolved to become a positive term and that lesbians view “DYKES ON BIKES” as a symbol of pride and empowerment. The Trademark Office then denied the request a second time.

After bringing in additional assistance from the law firm of Townsend and Townsend and Crew, the San Francisco Women’s Motorcycle Contingent appealed the denial. In a decision issued December 6, 2004, the Trademark Office reversed itself and granted the application.

In February, 2006, an individual filed an opposition to the trademark, alleging the name “DYKES ON BIKES” was disparaging to men, as well as accusing group members of misconduct toward men. On September 13, the U.S. Trademark Trial and Appeal Board dismissed the opposition. In its decision yesterday, the Court of Appeal affirmed the dismissal. The Court of Appeal held that the name “DYKES ON BIKES” “would have no implications for a man” and that the individual who filed the opposition had failed to show that “his belief is shared by others.”

The San Francisco Women’s Motorcycle Contingent, which is a non-profit group, was forced to seek registration of the name “DYKES ON BIKES” when an individual, unassociated with the organization, attempted to use the phrase for commercial purposes and wanted to charge contingents throughout the country for its use. The San Francisco Women’s Motorcycle Contingent organization decided to obtain a trademark to protect the non-commercial use of the name and its meaning to the LGBT community from private commercial use.

The San Francisco Women’s Motorcycle Contingent was represented pro-bono by Brooke Oliver and Pablo Manga of Oliver-Sabec, P.C., Gregory Gilchrist, Gia Cincone, and Raquel Pacheco of Townsend and Townsend and Crew LLP, and the National Center for Lesbian Rights.

Tonkon Torp Forms Sustainability Practice Group
Tonkon Torp has launched a sustainability practice group leveraging the firm's experience in energy, forestry, green building and advising emerging companies.

The interdisciplinary group is made up of 12 seasoned attorneys who focus on issues ranging from renewable energy, real estate and environmental law to corporate finance and governance, intellectual property and lobbying. The new practice group is co-chaired by Tonkon partners Max M. Miller, Jr. and David Copley Forman.

Miller, whose practice focuses on environmental and natural resource issues, is named as a leading environmental lawyer in Chambers USA America’s Leading Lawyers for Business. Miller also chairs Tonkon Torp’s internal committee to develop and monitor sustainable business practices within the firm.

Forman’s law practice includes corporate finance and assisting emerging companies to develop sustainable products and services. In 2004, Forman was recognized by The Portland Business Journal as one of the 40 most influential community and business leaders under the age of 40.

Salans advises MAKIZ PHARMA on American launch of Russian original pharmaceutical
Salans has advised Russian pharmaceuticals holding MAKIZ PHARMA on a license agreement for registering and producing the medicinal form of its Acizol ® product in the United States and a number of other countries¹. The agreement was signed by American pharmaceuticals company MPP Group LLC and ZAO Acizol-Pharma, which owns the rights to the preparation, with the participation of MAKIZ PHARMA, which has been granted exclusive rights to produce and market Acizol ® in the Russian Federation, the CIS and certain other countries. The signing ceremony took place in Milwaukee (Wisconsin). Moscow partner Alexander Skoblo led the deal assisted by Olga Rogozhina, Moscow associate.

"This is the first ever agreement to register and produce a Russian pharmaceutical product in the United States," said ZAO MAKIZ PHARMA general director Nail Khamidullin. "Salans' experience and resources in intellectual property, and the strength of its Russian and international corporate law practice, helped us to a swift and successful signing of this agreement."

¹ Acizol ® is used to prevent and treat carbon monoxide and other smoke-related poisoning. It was first synthesised by the Irkutsk Chemical Institute of the Siberian section of the Russian Academy of Sciences. The medicinal form was developed by ZAO Acizol-Pharma, led by Kh. Kh. Babaniyazov, Honoured Doctor RF, candidate of medical sciences. All pre-clinical and clinical trials, and the development of the technology for producing the medicinal form, were performed with the direct involvement and financing of ZAO MAKIZ PHARMA. The first industrial series of Acizol ® reached the Russian pharmaceuticals market in 2006 and quickly became one of the best selling products in MAKIZ PHARMA's portfolio.
