Dreier LLP Wins Precedent Setting Patent Case Challenging Co-Inventorship of Diamond Licensed by Tiffany & Co.
Dreier LLP announced today that Judge Richard J. Holwell of the U.S. District Court for the Southern District of New York rejected a challenge to patents held by Joseph Mardkha, the inventor of a highly prized diamond design that is exclusively licensed by Tiffany & Co. as the centerpiece of its Legacy collection.

Plaintiff Yoram Finkelstein, brother-in-law of the defendant, claimed he was a co-inventor of the diamond, having worked with cutters in Israel at Mr. Mardkha’s direction during the development phase.

The Court found that the assistance provided by Mr. Finkelstein did not rise to the level of inventorship, even though he claimed to be an expert in diamonds. “Nothing in the record suggests that someone familiar with jewelry and gemstones, but not physically sitting at the cutting wheel, would not be able to conceive of [the invention]”, the Court said.

Mr. Mardkha was represented by Jeffrey A. Mitchell, a litigation partner at Dreier LLP, and associate Don Abraham.
“This is not only an important win for our client, but it is also a precedent setting decision in the world of gemstone patents,” Mitchell stated. “Judge Holwell’s decision limits the ability of someone who just helps an inventor to claim patent rights, and confirms that Tiffany will be able to maintain its exclusive license without interference.”

The diamond, known in the industry as a cushion cut, is unique because of its shape and facet arrangement. Mr. Mardkha’s company Colormasters Precious Jewelry is known for its jewelry designs that feature color gemstones such as rubies, emeralds, and sapphires, stones which are typically cut to retain light to show off color. Mr. Mardkha was looking to create a cushion cut for diamonds which would similarly retain light within the diamond to show off its colorlessness, rather than sparkle.

“We are gratified that the court saw the evidence as we did, and did not credit Mr. Finkelstein’s contributions as invention,” Mr. Mitchell stated. “There are very few cases which analyze the standard of inventorship required for diamond designs, and this
decision clearly sets out what is required before someone can be considered an inventor of a new cut. Just because you are a cutter does not make you an inventor.”

Porzio Principals Hold Key Positions in the IADC
D. Jeffrey Campbell, Managing Principal, has been elected to the International Association of Defense Counsel’s (IADC) Board of Directors at the Closing Session of the 2007 Annual Meeting in Bermuda. Mr. Campbell previously served as Chair of the IADC’s Toxic & Hazardous Substances Litigation Committee from 2003–2005 and Vice-Chair for Programs and Projects from 2001–2003. He currently serves as the Northern New Jersey State Membership Chair, is on the Editorial Board of the prestigious Defense Counsel Journal, and has served on the Nominating Committee.

Kenneth R. Meyer, Principal, has been appointed to a two-year position as Chair of the IADC's Product Liability Committee. He previously served this Committee as Vice-Chair of Programs from 2005–2007 and Vice-Chair of Journal Articles from 2003-2005. Mr. Meyer co-chairs the firm's Complex Tort Group and litigates and tries a wide variety of product liability and toxic tort cases and is Certified as a Civil Trial Attorney by the New Jersey Supreme Court Board on Trial Certification.

Roy Alan Cohen, Principal, is currently serving a second year as Chair of the IADC's Toxic and Hazardous Substances Litigation Committee. He previously served as Vice-Chair of Programs from 2005-2006. Mr. Cohen litigates and tries a wide variety of toxic tort, product liability, environmental, professional liability and trucking cases, and is Certified as a Civil Trial Attorney by the New Jersey Supreme Court Board on Trial Certification.

LeBoeuf Lamb Advises VTB Bank Europe on its $25 million Loan to Russian Retailer Nezabudka
LeBoeuf, Lamb, Greene & MacRae is advising VTB Bank Europe PLC as provider of a $25 million loan facility to Russian retail supermarket chain Nezabudka.

The VTB Bank loan to troubled Chelyabinsk company Nezabudka will assist with its repayment of debt to suppliers and enable it to proceed with its planned merger with Russian supermarket chain Grossmart, announced 10 July, 2007. VTB Bank was also the consultant on finding a strategic investor for Nezabudka.

According to the agreement of intent, the Nezabudka supermarket chain, with its 104 stores in the Ural region within the Russian Federation, and Grossmart, which has 142 supermarkets in 18 regions of Russia, will form a united retail chain. The chain will occupy one of the leading positions on the Russian retail market. The merged entity will be owned by InvestRetailGroup. Currently, the companies are discussing the details of the integration process.

VTB Bank is a longstanding client of LeBoeuf Lamb, whose London and Moscow offices regularly advise the bank on its transactions throughout the Russian Federation.

The LeBoeuf Lamb team advising VTB Bank included lead partner Bruce Johnston (energy and infrastructure finance, London) and associates Mohsin Iqbal and Helen Campbell (energy and infrastructure finance, London), and Anatoly I. Alexandrov (corporate and finance, Moscow).
