GAQS Receives Top Law Firm Award from VLSH
Volunteer Legal Services Hawaii (VLSH) held a special Kahiau luncheon today at the Plaza Club to recognize individuals and law firms that made a significant contribution of their time to various programs in 2006. The Hawaiian word “Kahiau” was chosen to signify the spirit of selfless giving without an expectation of return demonstrated by the volunteers. The keynote speaker at the luncheon was Mark Recktenwald, recently appointed Chief Judge of the Intermediate Court of Appeals. Dale Lee, Chief Operating Officer of the William S. Richardson School of Law and Vice President of the VLSH Board of Directors, was also present and acted as Master of Ceremonies for the event. VLSH Executive Director Moya Gray said, “The support of our Board and the tremendous contribution of our volunteers allow us to continue providing legal assistance to the many who depend on us. This luncheon is just a small way to say “thank you” to everyone for their help and support.”

Among those recognized today were the late Judge John Lim, for his pioneering spirit as one of the founders of VLSH, and Ellen Politano and Sue Miller, winners of the Spirit of Kahiau Award. Both Politano and Miller cited the enormous personal gratification they derived from their volunteer work as part of the reason they keep volunteering. The relationships they build with those they help are also very enriching, they said. Other awards conferred included the Top Law Firm Award, which went to Goodsill Anderson Quinn & Stifel LLP, and the Top Pro Bono Firm Coordinator Award, given to Christopher Yeh of Marr Hipp Jones & Wang, LLP. Golden State Foods received Outstanding Corporate Sponsor, while many individuals received awards for their hours of service to those in dire need of legal assistance.

With over 25 years of service in Hawai`i, VLSH has hundreds of volunteers active in a variety of programs, from neighborhood legal and tax clinics to training and assistance programs for non-profits, the homeless and children. With a continuing mission to provide free or low-cost legal help to low-income residents and the non-profit organizations serving them, VLSH is always in need of new volunteers.

Weil Gotshal Receives High Marks for Diversity
In the most recent issue of The Lawyer, Weil, Gotshal & Manges made a prominent showing in several diversity categories. The firm was ranked 6th for "UK Top 10 Law Firms by Associate Diversity" and 5th in the Diversity League Table for "UK Top 10 Law Firms Ranked by Partner Diversity." The League Table is compiled by the Black Solicitors Network, an organization that is endorsed by the Law Society, the Commission for Racial Equality and Justice Minister Bridget Prentice.

Plunkett Cooney takes home Metro Detroit Heart Walk Law Cup
Plunkett Cooney delivered on a pledge by its president and CEO to be the top law firm fundraiser and bring home the American Heart Association’s (AHA) Metro Detroit Heart Walk Law Cup in 2007.

“Last year we came up a bit short and finished behind another law firm. During the awards party, I went out on a limb and said Plunkett Cooney would bring home the Cup in 2007,” said the firm’s President and CEO Henry B. Cooney. “Knowing the generosity and competitive spirit of our employees, I knew we would make a comeback.”

Plunkett Cooney, one of Michigan’s oldest and most accomplished full-service law firms, was awarded the Law Cup during the AHA Heart Walk Awards Party on July 31 at Andiamo’s Italian Bistro in Warren. The firm raised $17,000 for the Heart Walk and donated additional funds as sponsor of the Awards Party.

Approximately 125 people attended the Awards Party, including corporate executives and top walkers from participating teams. Numerous companies and individuals received awards and acknowledgements for their efforts to raise funds for the Heart Walk, which benefits research and awareness campaigns related to the leading killer in the United States – heart disease.

Held on May 19 on the grounds of the Southfield municipal complex, the 2007 AHA Heart Walk was a non-competitive 3.2 mile walking event. More than $1.2 million in pledges were raised this year due to the tireless work of dozens of Metro Detroit businesses, their employees and individual participants.

Firm Assists Lead Investor in $750 Million Investment in Dana Corp.
It was announced that bankrupt auto parts manufacturer Dana Corporation has reached crucial agreements with its two biggest unions, United Steel Workers and United Auto Workers, with respect to a $750 million investment in the company led by Willkie client Centerbridge Capital Partners L.P. The agreements also cover support for Dana’s reorganization plan, and provides a means for lowering Dana’s labor costs and replacing its health care and long-term disability obligations for retirees. Under the investment deal, Centerbridge will invest up to $500 million in cash for convertible preferred stock in the reorganized Dana and facilitate an additional investment by other investors of up to $250 million in convertible preferred stock. The agreements are expected to substantially reduce the company's operating costs and provide important momentum toward its emergence from bankruptcy. Dana is a world leader in the supply of axles, driveshafts, management products (structural, sealing, and thermal), as well as genuine service parts. Based in Toledo, Ohio, the company, with reported 2006 sales of $8.5 billion, employs about 35,000 people in 28 countries. The transaction was handled by partners, Jeffrey Poss, Henry Cohen, Donald Elliott, Brian O'Conner and Matthew Feldman; special counsel Peter Allman, Jonathan Konoff, Lawrence Plotkin and Kim Walker; and associates Peter Agnetti, Lauren Cohen, Bret Cohen, Lisa, Eskenazi, Paul Horan, Morris Massel, Hillel Jacobson, Fara Sunderji, Jason Ertel, Katherine Pantazis Schroeder, Jeffrey Letalien and Debra Sapp.

Court Success for Baker & McKenzie LLP Public Law Team
"The Public Law Team at Baker & McKenzie LLP has acted successfully for the Council for Healthcare Regulatory Excellence (CHRE) in obtaining a judgment in the Administrative Court, allowing CHRE's statutory appeal in CHRE v (1) Nursing and Midwifery Council (2) Michelle Louise Kingdom. The UK Administrative Court is the High Court division which deals with regulatory and public law cases covering areas such as healthcare, telecommunications and media.

CHRE oversees the nine major healthcare regulators in the UK, including the General Medical Council, and has statutory power to refer to Court decisions of the disciplinary panels of the regulators where public protection is in issue.

The Nursing and Midwifery Council had failed to allege dishonesty in framing their charges against Ms Kingdom when the complaint in the case related to a false document recording Ms Kingdom had passed an exam when she had not. Following the successful appeal, the case will now be reconsidered by the Professional Conduct Committee of the Nursing and Midwifery Council with revised charges.

The Baker & McKenzie team was Len Murray, Paul Benjamin, Ruth Tomlinson and trainee Geoff Martin.

This is the latest in a series of successful High Court appeals brought by CHRE in which the Public Law team, headed by Tom Cassels, has acted and Martin Chamberlain of Brick Court Chambers was counsel. Baker & McKenzie LLP has acted for CHRE since 2003. "

Mars and its Italian Subsidiary Win Appeal Against Italian Competition Authority and Largest Wrapped Ice Cream Producers
Cleary Gottlieb successfully represented Mars, Inc. and its Italian subsidiary Masterfoods S.p.A. in winning a key judgment in the Consiglio di Stato (Council of State), the highest Italian administrative court, against the Italian Competition Authority and wrapped impulse ice-cream producers Unilever, Nestlé, Sammontana and Sanson. On July 13, the Council of State granted the Mars group’s appeal and set aside a lower court’s 2004 ruling, which upheld a decision in which the ICA found that the four suppliers’ wholesale, outlet and freezer exclusivity practices did not violate Article 81 EC, and that Unilever’s standard exclusive-distribution agreements did not have as their object or effect the restriction or distortion of competition within the meaning of Article 2 of the Italian competition statute.

This ruling has implications beyond the Italian market, in particular since various national courts and competition authorities have dealt and are dealing with parallel cases raising similar issues. The application of the unlawful exclusivity provisions has been a contractual practice adopted by the majority of impulse ice-cream manufacturers in the European Community for over 15 years, and companies in the Unilever group have played a significant role in this market in several Member States. The case follows in the line of the similar Langnese/Schöller and Van den Bergh Foods cases, both concerning companies of the Unilever group and their respective impulse ice cream’s distribution policy in Germany and Ireland, respectively, in which the European Commission’s infringement decisions were upheld by the Community courts of law. Therefore, the appellants argued before the Council of State that the solution reached by the ICA, and upheld by the lower court, was so fundamentally inconsistent with the established EC case law in this area, that the coherent and effective application of Article 81 EC throughout the Community was at stake.
