Marketers at Rutan & Tucker LLP Join Board of Directors of Southern California Chapter of Legal Marketing Association (LMA)
Bruce Allen, chief marketing officer, and Jessica Blanche, marketing coordinator, at Rutan & Tucker LLP, California’s largest full-service law firm based in Orange County, have joined the Board of Directors of the Southern California Chapter of the Legal Marketing Association (LMA).

Founded in 1985, the LMA is the world’s largest marketing network for the legal profession. Allen serves as a Board member at large for the organization, and Blanche has assumed the Chapter’s technology chair.

Prior to joining Rutan & Tucker in June of 2005, Allen was with the Deloitte & Touche LLP, and the international law firm Brobeck, Phleger & Harrison LLP, and is a veteran of the United States Marine Corps. He serves on the Board of the United States Adaptive Recreation Center and is the author of a top-ranked marketing blog, ‘”Marketing Catalyst.”

Rutan & Tucker Sponsors Golden Gavel Appellate Moot Court Competition at Chapman University School of Law
Rutan & Tucker LLP, California’s largest full-service law firm based in Orange County, recently co-sponsored the annual Golden Gavel Appellate Moot Court Competition at Chapman University School of Law. The program offers first-year law students the opportunity to develop oral and written advocacy skills by applying them in simulated courtroom settings.

In 2006, Rutan & Tucker made a $75,000 donation to help fund the law school’s Legal Research and Writing Program, which helps students acquire the skills they need for the competition. Rutan & Tucker partners Tom Salinger, a member and former head of the firm’s Trial Section, and Mike Rubin, a member of the firm’s Public Law Section, joined law school Dean Parham Williams in judging this year’s competition.

This year, students wrote a persuasive brief involving an employer’s responsibilities under the Americans with Disabilities Act, and then argued their case in a mock oral argument. From the initial rounds of arguments, 30 students were selected to advance to final elimination rounds that were judged by local attorneys.

The eight students who advanced to the Golden Gavel quarterfinal rounds were Angelique Batsel, Alex Brewshaugh, Jenos Firouzman, Tracy Guenther, William Nones, Brian Thomley, Jessica Tincopa, and Matt Wechter. The two Rutan & Tucker Golden Gavel Award winners were William Nones, representing the plaintiff (Nones also won the Best Oralist award) and Matt Wechter, representing the defendant.

The two students who wrote the top plaintiff’s and defendant’s briefs will be announced in the fall and presented with Rutan & Tucker Golden Quill Awards. Each award is accompanied by a cash stipend. The top advocates and brief-writers in this and other competitions held at the Chapman law school are invited to become members of the school’s Appellate Moot Court Board, making them eligible to represent the school in regional and national competitions.

“From my experience over the last two years as a judge of the moot court competition, I found the law student participants to be bright, personable and energetic,” said Salinger. “I think they not only are a credit to their school but also, even at this early stage of their legal education, to the legal community. The faculty and the administration of the law school can take great pride in the fact that they have such talented first-year students and that their Legal Research and Writing instructors have obviously taught them a great deal about oral advocacy in a brief period of time.”

“I was very impressed with the caliber of advocacy, finding it difficult to believe that these were merely first year law students,” said Rubin. “They were well prepared, knew the facts, knew the law, and articulated their positions forcefully and persuasively. They have a bright future. Credit goes to the Chapman faculty involved in the Legal Research and Writing Program for enabling these students to excel so impressively.”

Professor Robin Slocum, director of the Legal Research and Writing program, said, “We very much appreciate the numerous ways in which Rutan & Tucker has supported this program. We are so grateful for the firm’s donation, which will be used to enhance the services we offer our students. Equally as important, however, is the time and energy so many attorneys at Rutan & Tucker have so generously provided in supporting and serving as judges for the Golden Gavel competition each year.”

Several attorneys at the firm are graduates of the law school or were undergraduates at the Chapman University, including associate attorneys Allison LeMoine-Bui, who earned her Chapman law degree there in 1999, and Richard R. W. Houston, who earned a Chapman undergraduate degree in 1997.

Attorney William Marticorena of Rutan & Tucker LLP is president elect for local chapter of National Association of Telecommunications Officers and Advisors
William M. Marticorena, a partner in the Public Law Section of Rutan & Tucker LLP, California’s largest full-service law firm based in Orange County, is the president elect for the California and Nevada chapter (SCAN) of the National Association of Telecommunications Officers and Advisors (NATOA).

Bill Marticorena specializes in telecommunications, cable television regulation, public finance and economic development. He has delivered numerous speeches, lectures and seminars on cable television, telecommunications, public finance and economic development over the last 25 years. A frequent speaker at NATOA regional and national conferences, he also has regularly addressed the League of California Cities on cable television and telecommunications regulation. Supreme Court Finds Duty to Defend Additional Insureds, Despite Dismissal of Named Insured from Underlying Tort Action
Ellen M. Spindler recently won summary judgment in a declaratory judgment action seeking additional insured coverage for the New York City School Construction Authority, City of New York and Board of Education of the City of New York ("the City Plaintiffs") with respect to an underlying tort action involving an injury to an employee of a general contractor caused by a fall from a ladder attached to an asbestos container on site to dispose of asbestos waste. Judge Herman Cahn, of New York County Supreme Court, ruled that, despite the dismissal of the asbestos subcontractor from the underlying tort action, Lumbermen's Mutual Casualty, the carrier for the asbestos subcontractor owed a duty to defend the City Plaintiffs as additional insureds under a policy of insurance issued to the named insured asbestos subcontractor as that policy provided coverage for bodily injury arising from your "work", defined to include work or operations performed by the subcontractor and materials, parts or equipment furnished in connection with such work and also denied Lumbermen's cross-motion seeking a declaration that there was no duty to defend or indemnify the City Plaintiffs. Judge Cahn relied on the recent Appellate Division, First Department decision of Worth Construction Company, Inc. v. Admiral Insurance Company, 40 A.D.3d 423, 836 N.Y.S.2d 155 where the Court found that it was sufficient that an injury occurred on stairs to trigger additional insured coverage by a policy of insurance issued to the stairway subcontractor, despite its dismissal from the action.

Nancy Brown Recognized for Work Benefiting Houston's Habitat for Humanity
Gardere Wynne Sewell LLP, is pleased to announce that Nancy Brown, a senior attorney at the Houston office, has been recognized for her volunteer work benefiting the Houston chapter of Habitat for Humanity. Brown, co-chair of the Houston Bar Association’s (HBA) Habitat for Humanity Committee, along with Randall O. Sorrels, a partner at Abraham, Watkins, Nichols, Sorrels, Matthews & Friends, each received the HBA’s President’s Award, after recruiting more than 250 volunteers, raising more than $118,000 and building two HBA Habitat houses in 2007.

Brown has worked with Habitat for Humanity for more than 18 years and spent six years serving on the board of the Fort Bend County Habitat chapter. As part of her recent fundraising efforts, she organized a “Wear Denim for HBA Habitat” day in January at Gardere’s Houston office, where all employees could pay $5 to wear denim that day. The Gardere family, in a strong show of support, raised more than $2,500 for the organization Brown also secured meals for the construction sites workers, recruited volunteers to help with fund-raising efforts and found workers to help with the actual construction of the homes

“The Habitat program provides a hand-up, not a handout to low-income families seeking to become homeowners and fulfill the American dream. I wholeheartedly believe in that mission and Habitat’s effort to build better communities around the world” said Brown. “This is a community effort in the truest sense and I couldn’t be more thrilled with the support we received from individuals and organizations here in Houston.”

This past year, the HBA Habitat for Humanity Project celebrated its 10th Anniversary by attempting, for the first time, to build two Habitat homes in one year. These homes were built side by side for two very deserving Houston families. With HBA volunteers working three consecutive weekends in April, the organization was able to complete both houses.
