Eleanor J. Tschugunov Elected as President of the Board of Directors of the International Institute of Akron
Buckingham, Doolittle & Burroughs, LLP (“BDB”) is proud to announce that Eleanor J. Tschugunov, a shareholder in the Firm’s Akron office, was elected President of the Board of Directors of the International Institute of Akron (“IIA”). Tschugunov has been a member of the board for over 10 years. This is her third term as president, having previously served in 2003 and 2004.

The IIA is a nonprofit organization that is committed to serving the immigrant community in Akron and surrounding areas. IIA provides educational programs, employment counseling, immigration counseling, translation and interpretation services, and refugee resettlement assistance to its clients. Since 1916, IIA has served over 85,000 individuals.

Tschugunov has been practicing Immigration Law since 1995. She has handled a wide range of immigration matters focusing on business-related immigration for both individual professionals and the firm’s corporate clients. Tschugunov advises business clients and prospective alien employees regarding procedures for obtaining temporary work visas as well as U.S. permanent residency status. She also provides counseling to corporate clients on I-9 employment verification issues and national origin discrimination. Tschugunov provides comprehensive immigration strategies utilizing the firm’s depth of practice areas, including corporate and business, taxation, estate planning, and health law.

In the course of her practice, she has developed considerable expertise in the Immigration of Healthcare professionals. She routinely counsels such professionals on the complex credentialing and licensing requirements for foreign practitioners. Tschugunov has obtained H-1B and permanent resident visas for physicians, nurses, and pharmacists. She has also provided counsel on J-1 home residency waivers.

Tschugunov earned her JD from The University of Akron School of Law, and her BA from Heidelberg. She is a member of the American Immigration Lawyers Association (AILA) and is an active member of the Ohio Chapter of AILA.

Jeffrey A. Handelman Elected to the Board of Directors for the Chicago Intellectual Property Alliance
Brinks Hofer Gilson & Lione, one of the largest intellectual property law firms in the U.S., is pleased to announce that Jeffrey A. Handelman, chair of the Trademark Group at the firm, has been elected to the Board of Directors for the Chicago Intellectual Property Alliance (CIPA). Brinks is a founding member of CIPA.

At CIPA’s 2nd annual “IP Day in Chicago,” Mr. Handelman spoke on recent Supreme Court decisions in the trademark field. He focuses his practice on trademark, unfair competition, trade dress, dilution, false advertising, copyright, trade secret and licensing matters. He is also involved in Internet-related litigation and counseling. Mr. Handelman has extensive litigation experience in the Federal Court and before the U.S. Patent and Trademark Office.

Mr. Handelman received his B.A. from the University of Illinois and his J.D. from the Georgetown University Law Center.

CIPA is a non-profit organization that works to promote the Chicago and Midwest region as a vibrant center for the development and management of intellectual property and partners with law schools, intellectual property practitioners, law firms and businesses to promote new ideas and educational programs in the area of intellectual property. CIPA sponsors the “Most Inventive” award and provides judges for the Chicago Public Schools’ annual Science Fair and was instrumental in bringing the Court of Appeals for the Federal Circuit to Chicago for hearings.

James F. Henry Joins Bradley Arant Rose & White LLP
Bradley Arant Rose & White LLP is pleased to announce that James F. Henry has joined as a partner in the Birmingham office and is a member of the Health Care Practice Group and the White Collar Criminal Defense Practice Team. Mr. Henry has extensive experience in regulatory matters and state and federal litigation, focusing primarily on defending nursing homes, assisted living facilities and other health care providers in cases alleging malpractice or fraud. He also provides advice and counsel to health care providers with respect to regulatory compliance and regularly represents health care providers before a variety of state and federal agencies.

Former Chief Justice of the Florida Supreme Court, Arthur England, to Speak on the Appellate Aspects of Bad Faith Litigation
Arthur J. England, Jr., former Chief Justice of the Florida Supreme Court, will address the appellate considerations of bad faith litigation as a panelist at Mealey's Bad Faith Litigation Conference in Philadelphia on September 24-25, 2007. Mr. England is a co-chair of the National Appellate Practice Group of the Greenberg Traurig law firm.

The Conference will offer programs which address the complete anatomy of bad faith lawsuits, and has been designed to sharpen trial skills and provide analysis of precedential and cite-worthy bad faith cases. Mr. England's appellate panel will discuss such matters as planning for an appeal before trial, the role of appellate counsel at trial, the need for separate appellate counsel, and the issues of bad faith litigation which attract appellate attention.

Greenberg Traurig's Appellate Practice Group has been at the center of some of the most important appellate cases in recent times, including serving as appellate counsel to Lorillard Tobacco in the landmark appeal which reversed a $145 billion award, and writing the amicus brief cited extensively in the Supreme Court's decision in the University of Michigan affirmative action cases.

Mr. England is the author of Florida's Administrative Procedure Act and Corporate Income Tax Code. He focuses his practice on appellate work and trial counseling, constitutional matters, commercial litigation, administrative law, and insurance defense. He received a B.S. from the Wharton School of Finance and Commerce of the University of Pennsylvania, an LL.B. from the University of Pennsylvania Law School, and a LL.M. from the University of Miami School of Law.

Howrey Files Suit Against Milk Processors on Behalf of Southeast Dairy Farmers
Howrey LLP has filed two suits in federal court in Columbia, Tennessee, on behalf of Southeast dairy farmers alleging that Dean Foods Co. (“Dean”), Dairy Farmers of America (“DFA”), and National Dairy Holdings (NDH), along with a number of co-conspirators, have conspired to monopolize and monopsonize the production, marketing and processing of raw Grade A milk in the Southeast through a series of coordinated anti-competitive activities such as foreclosing access to milk bottling plants, requiring dairy farmers to join Defendants’ marketing associations, fixing and suppressing prices for milk paid to dairy farmers in the Southeast, and refusing to compete with each other for the purchase of raw Grade A milk.

Defendants dominate the production, marketing and processing of milk in the Southeast. DFA controls over 90 percent of raw Grade A milk produced and marketed in the Southeast, and along with its its coconspirators, Dean and NDH, controls over 75 percent of the fluid milk processing capacity in the Southeast.

In the complaints, filed on behalf of independent dairy farmers, members of the Maryland & Virginia Producers Cooperative Association and members of DFA, Plaintiffs allege Defendants have engaged in these unlawful activities for the purpose of artificially reducing the price paid by Defendants to Southeast dairy farmers for Grade A milk. Defendants’ dominance of the market permits them to monitor and police compliance with the goals of the conspiracy and to insure that all of the Defendants refuse to compete for the purchase of Southeast dairy farmers’ milk. Because of Defendants’ actions, Southeast dairy farmers have no competitive options for the marketing and processing of their Grade A milk – they must either accept the conspirators’ fixed price, or go out of business. Over the last four years, hundreds of dairy farmers have been forced out of business.

In addition, DFA members allege Defendant DFA has breached its contractual obligations to act for the benefit of its members. According to the complaint, DFA management diverted millions of dollars of revenues, monies and assets that lawfully belonged to DFA dairy farmer members through a pattern of inappropriate transactions involving its co-conspirators and others. These actions resulted in extraordinary and unnecessary fees being passed through to DFA members.
