Larkin Hoffman Remembers Terrence E. Bishop (1954-2007)
Larkin Hoffman Daly & Lindgren Ltd. mourns the loss of our colleague, board member and dear friend, Terry Bishop, who was taken from us too soon on July 17, 2007.

To say he will be missed is too simple, but to say more would disappoint Terry who was always focused, accurate and efficient in his work. Always willing to give, listen and help, Terry's life is an example to us all.

Our thoughts and prayers are with his wife, Lisa and his family. We are deeply thankful for his commitment to the firm and to his family for sharing him with us for many years.

Patent Group From Greenberg Traurig LLP Joins Dreier LLP
Dreier LLP announced today that five patent attorneys from Greenberg Traurig LLP have joined the firm’s Intellectual Property Department.

The addition of Albert L. Jacobs, Jr., Daniel A. Ladow and Gerard F. Diebner as partners, along with Elizabeth S. Lapadula, Ph.D., DABT as of counsel and Michael P. Bauer, Ph.D. as an associate, adds a leading life sciences and biotechnology practice to Dreier LLP’s existing full-service patent practice. Mr. Jacobs was formerly the national chairperson of the Intellectual Property Department at Greenberg Traurig and Mr. Ladow previously led the Intellectual Property Litigation practice in the firm’s New York office.

The move represents an important step in the significant growth of Dreier LLP’s Intellectual Property Department, which now numbers 22 attorneys. The patent practice is chaired by Dreier LLP partner Seth H. Ostrow, who joined the firm in December 2006 with a team of four patent attorneys from Brown Raysman Millstein Felder & Steiner LLP including Arianna Frankl and Matthew Kaufman who joined as partners and Karine Louis and Daniel F. Mitry who joined as associates.

The group will continue its focus on biotechnology, life sciences and business method cases and is looking to establish both Court of Appeals for the Federal Circuit (“CAFC”) and International Trade Court (“ITC”) practices at Dreier LLP.

The group has particular expertise in complex biotechnology and pharmaceutical cases. They have handled many substantial patent matters for leading clients such as Novo Nordisk, Merck & Co., Inc. and GlaxoSmithKline plc. Among other engagements, the team obtained a temporary restraining order and then a preliminary injunction for Novo Nordisk in a patent infringement action in Delaware on human growth hormone; obtained patents on several commercially important pharmaceutical and health care products and was involved in the patenting of new life forms; successfully defended Novo Nordisk against a charge of patent infringement of human growth hormone process patents of Genentech before the ITC; succeeded on appeal before the CAFC (Genentech v. Novo Nordisk) in having the court vacate a preliminary injunction and direct the district court to enter a judgment of non-infringement; succeeded on appeal before the CAFC (Genentech v. Novo Nordisk II) in having the court not only vacate a preliminary injunction but, for the first and only time to date, hold a patent invalid in an appeal from the grant of a preliminary injunction; and obtained a patent on biosynthetic human growth hormone as a substance per se.

The group is also well known for its success in handling business method patent cases. They successfully represented E-Data before the CAFC in the first business method patent to come before the court. The CAFC Circuit reversed the District Court on all five claim phrases in issue.

The Patent group also has expertise in counseling Chinese companies on patent issues. Mr. Jacobs was the only speaker from the U.S. at the Fourth Annual IP Forum in Shanghai, China. In March 2007, he was a guest of the government in Shandong Province where Mr. Jacobs presented a lecture series on “How Chinese Companies Can Avoid being Sued at the ITC and in Federal Court in the United States" before various government officials and Chinese corporate executives to explain the important patent issues Chinese companies are now facing.

Albert L. Jacobs, Jr.
With more than 30 years of experience in patent law, Mr. Jacobs concentrates his practice in the areas of pharmaceutical, life sciences, medical, chemical and health care, as well as business method intellectual property law and litigation. In addition, Mr. Jacobs has extensive experience in Hatch Waxman cases and intellectual property cases before the ITC. He also has regularly lectured on and advised clients on the nature and enforcement of intellectual property rights in the People’s Republic of China. He has appeared before the CAFC almost from its inception representing both patentees and alleged infringers. He is the only attorney ever to have the CAFC invalidate a patent on an appeal he took from a district court grant of a preliminary injunction against his client. He is author of Patent and Trademark Forms in Four Volumes, and co-authored Patent and Trademark Forms in Two Volumes. He is a member of the Bar of the State of New York and is admitted to practice before the U.S. District Courts for the Southern, Eastern, Northern and Western Districts of New York, the U.S. Court of Appeals for the Federal Circuit and the Supreme Court of the United States. He was appointed by the U.S. Secretary of Commerce to serve as a member of the Patent Public Advisory Committee of the U.S. Patent and Trademark Office from 2002 to 2005. Mr. Jacobs received a B.A. from Harvard University in 1961 and a J.D. from Columbia University School of Law in 1964 where he was a Harlan Fiske Stone scholar.


Daniel A. Ladow
Mr. Ladow focuses his practice on handling patent litigation in various technologies in courts throughout the country for both plaintiffs and defendants, from pre-litigation strategy through discovery, motions, trial and appeal, including patent infringement litigation, preliminary injunction actions, Hatch-Waxman cases, section 337 proceedings before the ITC, interference proceedings before the U.S. Patent and Trademark Office and appeals of interference decisions to district courts under 35 U.S.C. section 146. He has extensive experience successfully handling patent appeals to the CAFC. With particularly extensive experience in complex biotechnology and pharmaceutical patent cases, Mr. Ladow has litigated a wide range of subject matters and technology, including scientific instruments, electrical devices, and computer disk technology, as well as technology and patent licenses. Mr. Ladow also has substantial experience litigating business method patents, including before the CAFC, in fields including the financial, legal and securities industries and Internet-related patents. Mr. Ladow is a member of the Bar of the State of New York and is admitted to practice before the U.S. Court of Appeals for the Federal Circuit, the U.S. District Court for the Southern and Eastern Districts of New York and U.S. Court of International Trade. Mr. Ladow received an A.B., magna cum laude, from Brown University in 1982 and a J.D., cum laude, from University of Michigan Law School in 1985.

Gerard F. Diebner
Mr. Diebner has a degree in pharmacy and focuses his practice principally in the technical areas of pharmaceuticals, biotechnology, chemistry, agriculture, veterinary products and medical devices. In addition to his extensive patent trial experience, he also handles patent issues concerning mergers and acquisitions and due diligence searches, and provides general intellectual property corporate advice. Mr. Diebner is a registered patent attorney and he drafts and prosecutes patent applications before the U.S. Patent and Trademark Office. He also has substantial experience with interference practice. Mr. Diebner was involved with one of the first biotechnology lawsuits ever brought, and was successful in the longest biotechnology case tried to a jury. He is a member of the Bar of the State of New York and is admitted to practice before the U.S. District Courts for the Southern and Eastern Districts of New York, the U.S. Court of Appeals for the Federal Circuit and the U.S. Patent and Trademark Office. Mr. Diebner received a B.S. from St. John’s University in 1978 and a J.D. from St. John’s University School of Law in 1983.

Elizabeth S. Lapadula, Ph.D., DABT
Ms. Lapadula’s practice focuses on patent litigation, concentrating in the pharmaceutical, biotechnology, and chemical areas. Ms. Lapadula is also a board certified toxicologist, Diplomate of the American Board of Toxicology. She has also previously worked as a
staff toxicologist at Texaco, Inc. and as a research scientist at Burroughs Wellcome Co. Ms. Lapadula received a B.S. in Medical Microbiology and a B.A. in Chemistry from California State University, Long Beach in 1983, a Ph.D. in Pharmacology from Duke University in 1987 and a J.D. from Pace University School of Law with certificates in Environmental Law and International Law in 1996. She is a member of the Bar of the States of New York and New Jersey and is admitted to practice before the U.S. District Court for the Southern District of New York and the U.S. Patent and Trademark Office. She is also a member of the American Intellectual Property Law Association, the American Bar Association, the New York Bar Association and the Society of Toxicology.

Michael P. Bauer, Ph.D.
A registered patent attorney, Dr. Bauer focuses his practice on patent prosecution and litigation, concentrating in the pharmaceutical, biotechnology, chemical and business method areas. Additionally, Dr. Bauer assists clients by providing patentability opinions as well as infringement/non-infringement and validity/invalidity opinions. From 2005 to 2006, Dr. Bauer was a legal fellow at the Institute for Science, Law & Technology at Chicago-Kent College of Law. He is a member of the Bar of the States of New York and Illinois and is admitted to practice before the U.S. District Court for the Northern District of Illinois, the U.S. District Court for the Southern District of New York, the U.S. Court of Appeals for the Federal Circuit and the U.S. Patent and Trademark Office. He is also a member of the American Intellectual Property Law Association and the Illinois State Bar Association. Dr. Bauer received a B.S. in biology from Indiana University in 1993, a Ph.D. in biological sciences from the University of Notre Dame in 2002 and a J.D. with honors from Chicago-Kent College of Law in 2004.

Attorney Jon S. Liland Joins Sheehan Phinney Bass + Green's Upper Valley Office

MMM Attorney Named Visiting Assistant Professor at University of Florida Law School
Gary M. Lucas, Jr., an attorney with Morris, Manning & Martin, LLP, has been chosen as a Visiting Professor of Law at the University of Florida. He will take a leave of absence from the firm to teach taxation courses at the Levin College of Law.

“Gary is a tremendous asset to the Tax Group within our firm, and his talents will be sorely missed,” said partner Cass Brewer. “We look forward greatly to his return next year. Just as Gary has distinguished himself here, I know he will prove to be an outstanding addition to the Florida law school faculty. We have worked together on many projects, and I can state without reservation that Gary’s work is truly exceptional.”

Lucas, an associate in the firm’s taxation group, focuses on federal and state taxation. He graduated magna cum laude from Tulane University Law School and was a Graduate Tax Scholar at the Levin College of Law in 2006.

Bill Migneron Joins Lathrop & Gage as Chief Operating Officer
Bill Migneron has joined Lathrop & Gage L.C. as the firm’s first chief operating officer, CEO Joel Voran announced today.

As COO, Migneron will oversee the day-to-day management of finances, business operations, staff and facilities. He also will serve as a business adviser, assisting the CEO and executive committee with the development and execution of the firm’s strategic plan. The top administrative post at Lathrop & Gage previously was held by Curt Boswell, who served as executive director for 18 years. Boswell retired in December 2006.

Voran described Migneron as “a consummate professional” with exceptional knowledge of law firm management.

“Bill has proven leadership and management skills that will make him an invaluable resource to Lathrop & Gage as we continue our strategic growth,” Voran said. “He is a top talent whose ideas and insight into firm operations will help us provide an even higher level of client service.”

For the past two years, Migneron has served as executive director of Minneapolis-based Gray Plant Mooty, where he was responsible for directing and managing the overall business operations of the 160-attorney firm.

Prior to joining Gray Plant Mooty, he was with Kansas City’s Shook, Hardy & Bacon LLP, where he worked for 18 years in a number of administrative roles, most recently serving as chief information officer. At Shook, Migneron coordinated the space design and site selection of the firm’s new 500,000-square-foot headquarters and planned and opened offices in England, Switzerland and three domestic locations.

“I have always admired Lathrop & Gage and its strengths in management, leadership and vision,” Migneron said. “I am eager to draw upon my experience to streamline operations and build upon the firm’s tradition of client service.”

A fixture in the legal community, Migneron has served in a variety of leadership positions with the international Association of Legal Administrators (ALA), including president, executive committee member and at-large director. He also is a past president and former board member of the ALA’s Greater Kansas City chapter.

Alan Daughtry Appointed to the Pattern Jury Charge Committee
Alan B. Daughtry, a partner at Jackson Walker L.L.P., was appointed by State Bar of Texas President Gib Walton to a three-year term on the Pattern Jury Charge Committee covering the subject area of General Negligence and Intentional Personal Torts.

The State Bar has established Pattern Jury Charge committees to study and formulate standardized jury charge forms for use in civil trials. The Bar publishes Pattern Jury Charge editions covering various subjects of civil law, and these committee publications are seen as the leading resource for courts and practitioners in jury charge practice. The committee is made up of judges, plaintiffs, and defense lawyers with demonstrated expertise in the areas of practice under review.

Mr. Daughtry is an appellate lawyer and has been Board-Certified in Civil Appellate Law by the Texas Board of Legal Specialization since 2001. In addition to his customary briefing and argument practice in the state and federal courts of appeals, he devotes a great deal of his practice to assisting trial lawyers from within and outside the firm in formulating substantive and procedural legal theories and strategies in litigation - from the initial drafting of the complaint and answer to preservation of issues in the jury charge conference to post-verdict briefing and error preservation. He has repeatedly been named a "Texas Rising Star" by Texas Monthly magazine and a "Top Lawyer" by H Texas Magazine.
