Veteran SEC Enforcement Attorney J. David Fielder Moves to Haynes and Boone Washington, D.C
J. David Fielder, a 10-year U.S. Securities and Exchange Commission enforcement attorney who led key parts of the government’s case against Enron, has joined the Haynes and Boone, LLP Washington, D.C. office as partner.

"David's rich SEC experience and deep knowledge of regulatory law wonderfully complements the growing talent base in our Washington office," said Ron Breaux, who oversees the Haynes and Boone White Collar, Antitrust and Securities Litigation practice. "We are proud to welcome him as a new partner. Our clients will benefit substantially from his expert advice and counsel."

Mr. Fielder will concentrate on securities law matters including SEC enforcement investigations, regulatory compliance matters, investment company and investment adviser matters and white collar criminal defense matters related to securities law investigations.

Prior to joining the firm, he served as a branch chief in the SEC’s Division of Enforcement, advisor to the director of the Division of Investment Management and counsel to the SEC chairman. For his work on Enron matters, Mr. Fielder and others who investigated Enron received the Chairman’s Award for Excellence. He also received two Enforcement Division Director Awards for his work as Branch Chief.

While at the SEC Division of Enforcement, Mr. Fielder’s experience included the investigation of several complex structured finance transactions as a member of the Enron investigative team. He led the investigations of two financial institutions for aiding and abetting Enron’s fraud, which resulted in $135 million and $120 million settlements. He also supervised multiple investigations of public companies for possible backdating of options grants, and brought the first SEC-settled action against a CEO for that practice.

Before his SEC career, Mr. Fielder served as special assistant counsel to the President of the United States and was in private practice representing clients in white collar criminal defense and complex commercial litigation matters.

He received his B.A. magna cum laude from Washington University in 1987, a master’s in hydrogeology/environmental geology from Pennsylvania State University in 1989, and his J.D. from the University of Michigan in 1992.

Donald F. Zimmer Elected to IADC's Board of Directors
Fritz Zimmer, a partner in our San Francisco office, was elected to the board of directors of the International Association of Defense Counsel (IADC) at the group’s annual meeting held earlier this month in Bermuda. Fritz, an active member of both the IADC and the Defense Research Institute (DRI), is part of a class of three new directors eligible to be elected president at the end of his three-year term on the board. San Francisco Regional-Partner-in-Charge Chuck Preuss served as IADC's president in 1997-98.

The IADC, founded in 1920, was originally called the General Counsel’s Association of the United States. By the mid-1970s, the group’s membership had expanded to include insurance defense lawyers, corporate lawyers and executives from industries in the United States, Canada and several European countries. In 1985, the group changed its name to IADC to reflect these changes. Membership currently stands at 2,500 and remains by invitation only.

Labor and Employment Team Wins Another Union Election
The Labor and Employment Law Section of the Firm just posted another win in a union election conducted at a client's facilities in Oregon and Idaho. This election and the events leading up to it offer a text book example of creative union avoidance techniques.

The union initially attempted to organize a single facility in Portland where the union had significant support. The Labor and Employment law team of Mark Kingseed and Laura Wilson, after examining the client's business operations, objected to the Oregon unit and argued that due to overlapping management control and identical employee duties, two other facilities should be added to the proposed bargaining unit. After a hearing, the National Labor Relations Board ruled in the company's favor and expanded the proposed bargaining unit to include another facility in Oregon and one in Idaho. The union was decisively defeated in the election held in the expanded three facility bargaining unit.

The Labor and Employment Law team at Coolidge Wall is experienced in all aspects of union/company relationships, including union avoidance training, conducting elections, handling grievance and arbitration hearings and conducting collective bargaining negotiations for those clients with existing union agreements.

Attorney Thomas A. Doyle offers estate planning advice
B Thomas A. Doyle, director of the estate planning and settlement group for Garan Lucow Miller, P.C., contributed to an article that appeared in the July 2007 edition of the Greater Lansing Woman, a publication of the Lansing State Journal (LSJ). In an interview by Samantha Meinke, a reporter at LSJ, Mr. Doyle recommends that each person should have the following four documents - a will, a durable power of attorney, a healthcare power of attorney and a living trust. Mr. Doyle graduated from Aquinas College with a B.A. in 1975 and earned his J.D. from Thomas M. Cooley Law School in 1980. With 27 years of estate planning and settlement experience, Mr. Doyle is a recognized expert in his field. Since 1990, he has been an adjunct professor at Thomas M. Cooley Law School and has hosted, or been a guest speaker at, a number of estate planning seminars. He is the continuing legal education instructor on estate planning and business succession planning at Farm Bureau Insurance Company, and is the author the video of How to Avoid the Six Most Common Estate Planning Mistakes. Mr. Doyle is a life-long resident of Michigan and currently resides in the Lansing area.

Attorney Greg A. Light joins the firm's Lansing office
The Law Offices of Garan Lucow Miller, P.C. announces the hiring of Gregory A. Light in the Lansing office. Mr. Light areas of practice include first and third party no-fault insurance, municipal liability, medical malpractice, general liability and contract disputes.

Mr. Light earned his B.S. in Political Science from Northern Michigan University in 1990 and graduated with a J.D. from Detroit College of Law in 1994. In 1995, he was admitted to Bar of Michigan and the U.S. District Court – Eastern District of Michigan in 2004. He currently resides in Hartland, Michigan. Previously, Mr. Light was an attorney at Schwartz, Jalkanen & Hannum, P.C. in Southfield, Michigan.

Womble Carlyle Welcomes Kim Licata to Research Triangle Park Office
Womble Carlyle Sandridge & Rice, PLLC today announced the addition of Kim Licata to the firm's Health Care Practice Group. Licata, who joins the firm as of counsel in its Research Triangle Park office, previously worked for the firm as an associate for eight years.

Formerly Senior Vice-President and General Counsel of Sterling Healthcare, Licata represents clients on a wide variety of areas, including health care law, medical malpractice defense, regulatory compliance and products liability litigation defense. Specifically, Licata's practice includes: counseling long-term care facilities, hospitals, physicians and other providers on regulatory compliance and/or litigation issues; advising hospitals, physician groups, and other health care providers on obtaining necessary state regulatory approval for health care projects under state law; and advising drug manufacturers on various pharmaceutical and clinical trial issues. She has had significant experience handling physician misconduct and investigations, allegations of EMTALA or other statutory noncompliance, vendor management, and various contract negotiations. Working as General Counsel as part of an executive management team, Licata gained an appreciation for business operations, organizational expectations and legal solutions that meet corporate objectives. Her former position involved management of all corporate litigation and legal advice, extensive interaction and counseling on Human Resources issues and internal investigations, participation in financial audits, as well as oversight of risk management, claims, and compliance.

Licata received her bachelor's degree in the majors of American government and philosophy, with distinction, from the University of Virginia. She obtained her J.D., with honors, from the University of North Carolina School of Law where she was a member of the UNC Law Review, a Chancellor's Scholar, and received the American Jurisprudence Award in property and legal research. She is admitted to practice law in North Carolina and the District of Columbia, and before all North Carolina State courts and the District of Columbia Court of Appeals, and U.S. District Court for the Eastern District of North Carolina.
