Foley Jacksonville Attorneys Named Florida “Super Lawyers”
Foley & Lardner LLP announced today that six attorneys have been named 2007 Florida “Super Lawyers” by Law & Politics Media, Inc.

The Foley attorneys named and their primary practices as classified by Law & Politics are: Allan P. Clark, employment & labor; Charles E. Commander III, real estate; Gardner F. Davis, business/corporate; Kevin E. Hyde, employment & labor; Emerson M. Lotzia, real estate; and Robert M. Rhodes, real estate.

To compile the annual list, Law & Politics surveyed more than 44,000 lawyers across Florida, asking them to vote for the best lawyers they have personally observed in action. The final list features the top five percent of Florida attorneys in more than 60 areas of practice.

Allan P. Clark is a member of the firm's Labor & Employment and Construction Practices. He focuses his practice in the areas of construction law, employment law for management, surety law and mediation. In addition to maintaining an active law practice, he is also a certified circuit and federal court mediator.

Charles E. Commander III is a member of the firm's Finance & Financial Institutions and Real Estate Practices and the firm's Golf & Resort Industry Team. He advises and counsels corporate, financial institution and real estate clients in all aspects of their business.

Gardner F. Davis is a member of the firm's Transactional & Securities and Business Reorganizations Practices. Davis is particularly knowledgeable in regard to buying, selling, and recapitalizing companies, restructuring financially distressed enterprises and counseling officers and directors in corporate governance and control situations.

Kevin E. Hyde is a member of the firm's Labor & Employment Practice and Automotive Industry Team. He represents employers in a variety of human resources matters, including day-to-day employment counseling, and he regularly advises employers on creating appropriate compensation systems. Hyde is an elected official, serving as a member of the Jacksonville City Council.

Emerson M. Lotzia is a member of the firm's Real Estate Practice and its Golf & Resort Industry Team. Lotzia represents lenders, developers and tenants in real estate financing, development and leasing matters. He has extensive experience in condominium law, federal and Florida land sales registrations and exemptions, community development districts and the representation of developers of golf course mixed-use communities.

Robert M. Rhodes, of counsel, is a member of the Real Estate Practice. He has extensive experience in land use and environmental law and real estate development. He currently chairs the Northeast Florida Advisory Council for the Trust For Public Land, the Jacksonville Economic Development Commission, the Florida Coastal School of Law Board of Trustees and chaired the City of Jacksonville Mayor's Growth Management Task Force.

J. Gordon Arkin is a member of the Finance & Financial Institutions, Health Care Finance & Restructuring and Transactional & Securities Practices. Arkin practices general business law with an emphasis on finance, airport law and senior housing. He currently serves as special counsel to many airports, and was general counsel to the Greater Orlando Aviation Authority for more than 20 years.

Edmund T. Baxa Jr. is a member of the firm's Management Committee, chair of its National Pro Bono Committee and the former managing partner of the Orlando office. He is also a member of the Construction and the White Collar Defense & Corporate Compliance Practices. He maintains a complex commercial litigation practice focusing on representation of owners, general contractors, design professionals, subcontractors, and suppliers in contract drafting and negotiation, bid protests, workouts, claims litigation and arbitration proceedings.

James S. Grodin is chair of the Orlando office Litigation Department and a member of the Business Reorganizations Practice. He maintains a general commercial litigation practice including matters relating to insurance/bad faith, commercial contracts, product liability, intellectual property and banking. He counsels clients on banking law issues including problem loan workouts and lender liability defense.

John R. Hamilton is a member of the firm's Appellate and General Commercial Litigation Practices. He gained certification in appellate practice in 1996 from The Florida Bar, a rigorous process requiring substantial appellate experience, professional referrals and testing. He has handled numerous appeals in all of the appellate courts in Florida, as well as in several federal appellate courts.

John P. Horan is the founding chairman and a current member of the Construction Practice. His practice is concentrated in commercial litigation, administrative litigation, governmental law, construction law and dispute resolution. He has represented international construction and engineering firms, national industrial, infrastructure and highway contractors, homebuilders, designers and municipal governments.

John S. Lord, Jr. is a member of the firm's Labor & Employment Practice. Lord works with private and public employers in matters involving employment discrimination litigation, labor issues and general labor and employment law advice. In 2005, he received the Orlando Business Journal's “40 under 40” award, and in 1997 he received Foley's Lynford Lardner Community Service Award in recognition of his volunteer work and civic involvement.

Thomas K. Maurer is a member of the firm's Environmental Regulation Practice. He has represented clients in environmental and regulatory matters, including air pollution, hazardous waste management, underground storage tank, groundwater contamination and the siting of controversial projects.

Paul E. Rosenthal is a member of the firm's Real Estate Practice. He practices in the areas of real estate acquisition and sales, zoning and land use regulatory matters, local government and municipal law and real estate financing. He has extensive experience in land development and municipal law, negotiating and preparing purchase and sale agreements in real estate transactions for individuals, businesses, and public companies.

R. Duke Woodson heads the firm's environmental law practice in Florida. He is also a member of the Real Estate Practice and Golf & Resort Industry Team. He represents business and governmental clients throughout the state in environmental compliance and permitting matters. A significant portion of Woodson's practice involves the sale of environmentally sensitive lands to government.

Michael D. Annis is managing partner of the firm's Tampa office. As a member of the Tax & Employee Benefits and Estates & Trusts Practices, he focuses his practice in the areas of corporate taxation, tax litigation, estate planning and trusts and probate.

Stephen A. Crane chairs the firm's Commercial Transactions & Business Counseling Practice and is a member of the Transactional & Securities Practice. The primary focus of Crane's practice is business and corporate law with an emphasis in counseling business owners and negotiation and documentation of a broad range of commercial transactions, including mergers and acquisitions, roll-ups, venture capital transactions, joint ventures and equity financings.

W. Keith Fendrick is a member of the Business Reorganizations Practice. He focuses on bankruptcy and creditors' rights, corporate reorganizations and restructurings and commercial litigation. Thomas F. “Chip” Munro II is chair of the firm's Litigation Department in Tampa, litigation partner and a member and former chair of the firm's Construction Practice. He is also a member of the firm's General Commercial Litigation Practice and the Golf & Resort Industry Team. During his years of practice, Munro has concentrated in general commercial litigation with an emphasis on construction matters and product liability issues, both personal injury and commercial products disputes.

Fred S. Ridley is co-chair of the Golf & Resort Industry Team and national vice chair of the firm's Real Estate Practice Group. Fourteen Taft Partners Named in Chambers USA Publication
Fourteen Taft partners have been named to the 2007 edition of Chambers U.S.A.: America's Leading Lawyers for Business.

In Bankruptcy/Restructuring the firm is dubbed "one of the best mid-market firms in the city" by clients who look to this group for "prompt responses and a quality work product." The firm is also expanding its team in Cleveland, in order to provide statewide coverage.

The Lawyers: "When Tim Hurley tells you something, you know you can take it to the bank," enthused clients of this well-regarded lawyer. Hurley is admired and trusted as "a down-to-earth guy who you know won't pull a fast one on you." An excellent writer with an in-depth understanding of the Bankruptcy Code, he is technically strong and "an effective guiding hand for his clients." Peers say: "You always know that when he's on the other side, it'll be as easy an experience as you'd like." Tim Miller continues to win plaudits as a bright, promising lawyer who "definitely knows what he is doing." Clients endorsed his practical approach and technical abilities, adding: "He's always able to listen and focus on our management objectives."

In Corporate/Mergers & Acquisitions, Chambers says the firm has a long-standing reputation in the corporate and securities area, particularly in Cincinnati, where its lawyers are "on top of everything." The Lawyers: Mark Stepaniak is "an extraordinarily fine lawyer" who is applauded for his high-profile work for the University of Cincinnati. His strengths lie in communication and negotiations, for he is "approachable, not only to his clients but to the unions and employees too. The late Roger Weber, who served as chairman of the department until his untimely death On February 20, 2007, was revered for taking a cerebral approach to matters. Doreen Canton is termed "a real star in the courtroom." A "calm, cool and collected" trial lawyer, she represents defendant corporations in jury trial in employment discrimination cases in the federal courts in Southern Ohio. "People feel comfortable with her because she's so experienced," reports peers. Tim Reilly is recognized for being an experienced, ethical lawyer who is practical and results-oriented in his approach to litigation. he is popular with peers because "he'll settle cases and doesn't get mired down in strict legal issues," while clients admire his "easygoing" manner and big-picture approach. Rising star Greg Rogers is acknowledged for "fighting his cases hard." Clients applaud him for being "quick to respond with good practical legal advice, without lavishing lots of extra time on the matter."

In Litigation, Chambers describes the firm as: This prestigious Cincinnati outfit also has offices in Cleveland and Columbus. Peers conceded that the strength of the firm's trial group was impressive and consisted of some "absolutely terrific people." The Lawyers: "Firm and articulate" Kim Burke has a stalwart reputation for his skills in the courtroom. Thomas Terp has a reputation that transcends state boundaries as he is retained by many of his clients on a national basis, whom appreciate his "good blend of business and legal sense." Sources report: He answers questions in a straightforward manner which makes the whole process a lot easier."

In construction matters, David Wallace ”is described by those who have opposed him as ‘tenacious and vastly knowledgeable’.”

In matters of real estate, Chambers notes that Ed Diller, Partner-in-charge of Taft’s Cincinnati office, “has years of real estate-related experience behind him and continues to shine. As the ‘archetypal professional,’ he is praised for his clear judgment and deal-oriented approach.”

In Banking & Finance, Jeff Schloemer “wins plaudits for being ‘a match for any attorney in Los Angeles or New York’ and ‘His deal management skills are second to none’.”

Entry in Chambers USA, a London-based publication, is based on market recommendation. Researchers spend a year canvassing clients and lawyers across the United States to obtain a consistent market view of which firms and attorneys are considered leaders in their field.

Ed Diller Elected Moderator-Elect of Mennonite Church USA
Edward D. Diller, partner-in-charge of the Cincinnati office of Taft Stettinius & Hollister LLP, has been elected Moderator-Elect of the Mennonite Church USA at the National Assembly in San Jose, California earlier this month. He is now vice-chair of the Board which governs the church.

Diller will serve as the moderator at the National Assembly in 2009, which will be held in Columbus, Ohio. He also served as Parliamentarian at this year’s event.

Diller, a resident of Fort Thomas, Kentucky, is a partner in the firm’s Business and Finance Department, and is a member of the Executive, Development and Diversity Committees. Diller practices primarily in the areas of real estate, health care and general corporate law.

After receiving his undergraduate degree from Bluffton University, Diller attended the University of Oregon and later received his law degree from Harvard Law School. He has been listed in The Best Lawyers in America since 1987 and has been included among the 100 Ohio Super Lawyers listings jointly developed by the publishers of Cincinnati Magazine and Law & Politics magazine. Diller also is listed in Chambers USA.

Simpson Thacher Represents New Horizon Capital in Establishing $500 Million China Private Equity Fund
Simpson Thacher represented New Horizon Capital in the establishment of New Horizon Capital, L.P. its second China private equity fund. The fund will primarily invest in the privatization of China’s state-owned enterprises.
