Patton Boggs LLP Guides Benitec to Victory in Biotech Patent Law Infringement Suit
Patton Boggs LLP has prevailed on behalf of its client, Benitec, an Australia-based biotechnology company, in a high-profile patent infringement suit. On Friday, the Federal Circuit issued its decision in the Benitec v. Nucleonics appeal, affirming the District Court’s decision to dismiss the case for lack of subject matter jurisdiction.

Initiated in 2004, the lawsuit alleged that rival biotechnology company Nucleonics Inc. was infringing on Benitec’s patent for the iRNA gene-silencing treatment. This gene regulation treatment had been developed largely by Benitec and has provided promising results treating diseases such as HIV, cancer, hepatitis B and C, and autoimmune and central nervous system disorders.

Benitec had originally sought dismissal after the Supreme Court’s Integra v. Merck decision rendered further litigation on the issues in the case irrelevant. Nucleonics opposed the dismissal, arguing that a case and controversy remained. Nucleonics lost at the District Court and appealed the decision to the Court of Appeals for the Federal Circuit.

After the Supreme Court expanded declaratory judgment jurisdiction in MedImmune v. Genentech, the Federal Circuit requested supplemental briefing to determine if the expanded jurisdiction conferred the necessary case and controversy requirements to continue the Benitec v. Nucleonics litigation. The Federal Circuit, in a 2-1 decision, ultimately determined the position advanced by Patton Boggs for Nucleonics was correct, affirming the District Court’s decision.

“When the Integra v. Merck decision was handed down, it was clear that additional litigation in this case would not serve the client’s purposes and that dismissal was appropriate. We are happy the Federal Circuit agreed, permitting the client to use its resources in research, not litigation,” noted Dr. Scott A. Chambers, Chair of Patton Boggs’ Intellectual Property Department who led the firm’s efforts in this matter.

Chambers USA Recognizes McGuireWoods' Land Use and Environmental Department
Chambers USA has again honored McGuireWoods, ranking us one of the top law firms for environmental services. Chambers, one of the most widely referenced guides to legal services, has ranked McGuireWoods among the nation's leading firms each year since it began publishing in the United States four years ago.

We thank our clients and friends for the votes of confidence. As Chambers assembles its annual rankings based on thousands of client interviews and independent peer reviews, we know that without your positive response to our work, McGuireWoods would not have been so honored. To us, there is no better compliment than positive feedback from clients and colleagues.

McGuireWoods' Land Use and Environmental Department is one of the most comprehensive in the country and comprises 35 lawyers, many of whom have been practicing environmental law for decades. Our group includes former government regulators and lawyers with technical backgrounds in engineering and the natural sciences. By integrating the skills of these group members with the latest technological approaches to practicing law, we focus our efforts for our clients on effective problem solving.

Our environmental practice is diverse in subject matter, geography and the businesses we serve. Within the group, there are concentrations in air, water, solid and hazardous waste, wetlands, and other permitting under federal and state regulatory programs. We have gained wide recognition for results that allow facilities maximum flexibility in meeting legal requirements, with maximum protection for their business and personnel. We also focus on transactions involving natural resources development or major manufacturing facilities and energy projects.

Our land use practice extends beyond advising clients on local land use regulations and ordinances. From McGuireWoods offices across the country, we advise clients on the zoning, development and environmental aspects of potential sites, and assist clients with real estate acquisitions, leasing and/or financing for development projects.

We also maintain an active land use litigation practice, representing clients who challenge local land use decisions as well as local governments in the defense of their land use decisions. In addition, we represent clients in coordination with our government relations team to draft, review and promote or deter proposed state or local legislation that affects our clients.
