Successfully Burying the Hatchet - A Lawyer’s Guide to Effectively Negotiating IP Cases
With over 30 years of experience in complex business litigation, including intellectual property disputes and handling all aspects of patent, trademark and copyright litigation, Paul Gale has become an authority in IP law. Mr. Gale reveals some of his best practices as an author in the book, Inside the Minds: Maximizing Intellectual Property Value – Leading Lawyers on Leveraging Your IP Portfolio, Negotiating IP Transactions, and Creating Intellectual Capital (Aspatore, 2007).

This book provides and insider’s perspective from partners and chairs of some of the nations leading law firms, and guides the reader through the various components of the constantly developing field of IP law, discussing strategies for successful negotiations and protecting one’s IP assets.

Mr. Gale’s chapter, entitled “Successfully Burying the Hatchet,” is a how-to guide to effectively negotiating IP cases. Mr. Gale offers advice on being a successful IP lawyer including useful strategies and mistakes to avoid, as well as best practices for negotiating an IP case including understanding the most frequently negotiated issues, preparing for a negotiation, and recognizing when to settle rather than litigate.

Governor Kaine Announces Additional Appointments
Governor Kaine announced additional appointments to the Boards and Commissions in Virginia. Thomas G. Slater Jr. of Richmond, head of litigation, IP, anti-trust team, and labor at Hunton & Williams, was appointed Virginia Military Institute Board of Visitors.

Attorney Appointed State Compliance Chair by International Trade Association
Attorney Jonathan D. Elliot, Zeldes, Needle & Cooper, P.C., Bridgeport, Connecticut, was recently appointed the 2007-2009 State Compliance Chair for Connecticut, by Members’ Attorney Program Committee of ACA International, the Association of Credit and Collection Professionals (ACA).

As a state compliance chair, Elliot will serve as a volunteer liaison between the national Members’ Attorney Program and ACA members in the state, by taking calls and serving as a legal resource, speaking at state unit meetings and/or writing articles for unit publications.

With more than 5,500 members in the U.S., Canada and 55 other countries throughout the world, ACA brings together third-party collection agencies, attorneys, creditors and vendor affiliates, establishes ethical standards, provides a wide variety of products, services and publications, and articulates the value of the industry to businesses, policymakers and consumers.

The Members’ Attorney Program is a division of ACA created to enable attorneys practicing in the credit and collection arena to better represent their clients through a number of resources designed to assist them in their practices, including up-to-the-minute information on legislative and case law developments. Through its state compliance chairs, the program provides ACA members with access to an attorney licensed to practice law in their state.

Attorney Chris A. Jenny Promoted to Shareholder
Randall D. Crocker, President and CEO of von Briesen & Roper, s.c., today announced the promotion of Attorney Chris A. Jenny to Shareholder. Attorney Chris A. Jenny is a Shareholder in the Business Practice Group of von Briesen & Roper,
s.c. and practices in the firm’s Madison office. Atty. Jenny’s practice focuses on representing individuals and businesses in transactional and litigation matters, including estate planning, real estate, business planning, and post-death administration. In 2004, Atty. Jenny was awarded the Wisconsin Small Business Legal Assistance of the Year award by the U.S. Small Business Administration (SBA).

Atty. Jenny is a frequent speaker on small business and real estate issues and has also presented multiple continuing education seminars on both estate planning and small business planning. In 2001, Atty. Jenny was named Volunteer of the Year by the Community Action Coalition for South Central Wisconsin, Inc.

Atty. Jenny is a member of the State Bar of Wisconsin, and the American and Dane County Bar Associations. He received a J.D., with honors, from the University of Wisconsin and a B.B.A., magna cum laude, from the University of Wisconsin-Whitewater. He resides in Sun Prairie, Wisconsin with his wife, Sara, and their son.

Torys: Contributor Most Read in Canada
Torys outdistanced strong Canada challengers in November, winning Mondaq's Contributor Most Read in Canada award.

Mondaq is one of the world's largest advisory content providers, publishing thousands of articles annually from more than 80 countries through its distribution network and its website, www.mondaq.com.

At the end of every month, for each country, Mondaq analyses its registered business readership statistics to determine which contributing author firms were read the most. All readership consists of real, identified individuals and no anonymous readers are included in the conferral of the award.

Mark Jones Joins Porter & Hedges Corporate Group
Porter & Hedges announced today that Mark Jones has joined the firm as a partner in the Corporate Group. He joins the firm from the Houston office of Adams & Reese, LLP.
Mr. Jones brings with him a national practice that focuses on the legal representation of both private and public clients in corporate securities, including public equity and debt financings, mergers and acquisitions, private placements, technology start-ups/private and venture capital financings, and compliance programs/enterprise risk management.

He has represented companies in initial and secondary public offerings, as well as underwriters, and has been involved in over 100 public and private offerings of equity and debt securities. Additionally, he assists clients, some of whom are Fortune 500 companies, in maintaining ongoing SEC compliance.

Mark has represented both acquirers and targets in a broad range of business combination transactions, including mergers, stock purchases, asset purchases and tender offers. He has represented primarily companies within the energy, banking, manufacturing, healthcare and technology industries, and has negotiated and closed over 80 business combination transactions, including five hostile tender offers with positive results. His previous experience includes serving as General Counsel of Argonne National Laboratory. Prior to Argonne, Mark was Senior Vice President and General Counsel of U.S. Water LLC., a Bechtel Enterprise company. Before U.S. Water LLC, Mark held a number of senior legal positions with Union Pacific Corporation, more recently with Union Pacific Resources Group, Inc., in Fort Worth, Texas. Mark began his legal career at Fulbright & Jaworski, LLP.

Mark received a B.B.A. from the University of Texas, and a J.D. from the University of Texas School of Law.
