Vandenberg Discusses Human Trafficking Laws At International Peace Operations Association Conference
Martina E. Vandenberg addressed a conference of the International Peace Operations Association (IPOA) in Washington, DC, that was convened to deal with the issue of combating trafficking in persons. U.S. law and procurement regulations prohibit trafficking for forced labor and forced prostitution, and there have been several credible allegations in the past few years of human trafficking by U.S. contractors serving abroad in the Balkans and Iraq.

The IPOA is a trade association of contractors that work with the Department of Defense and other agencies to assist them in war zones around the world.

The specific topic of the conference was “FAR Compliance Training for Government Contractors,” and Ms. Vandenberg spoke on “Origins of FAR and DFARS: Cases and Victims.” FAR (the Federal Acquisition Regulation) and DFARS (the Defense Federal Acquisition Regulation Supplement) govern all aspects of conduct by defense contractors.

Ms. Vandenberg pointed out that the Trafficking Victims Protection Reauthorization Act of 2003 requires that federal contracts include a provision permitting termination if a contractor or subcontractor engages in severe forms of trafficking, procures a commercial sex act, or uses forced labor in the performance of the contract.

Ms. Vandenberg told the audience that while the regulations may have taken some in the defense community by surprise, the clauses “have been in the works for more than five years.”

Also speaking at the conference were several representatives of the Defense Department, as well as Sen. Sam Brownback (R-Kan.) and Rep. Christopher Smith (R-N.J.).

Ms. Vandenberg has an extensive background on the issue of human trafficking, providing pro bono legal services for victims of trafficking as well as providing legal advice to companies developing compliance plans to implement the FAR and DFARS provisions. She has worked extensively on the regulations, submitting comments on the DFARS clause and providing training seminars for clients and non-governmental organizations on compliance.

Before joining the Firm in 2003, Ms. Vandenberg was the Europe researcher for Human Rights Watch’s Women’s Rights Division, where she documented the trafficking of women and girls from the former Soviet Union to Bosnia and Herzegovina for forced prostitution. She has also spoken at NATO headquarters in Brussels on human trafficking policy, and testified on trafficking before the House International Relations Committee (2002), the Helsinki Commission, the House Armed Services Committee (2004), and a Senate Judiciary subcommittee (2007).

New Partner Brings Extensive Employee Benefits and Executive Compensation Experience
Blank Rome is pleased to announce Barry L. Klein has joined the Firm as a partner in the Employment, Benefits and Labor group. Mr. Klein brings more than 20 years of experience in benefits and employment law, with concentration in employee benefits and executive compensation. He will be based in Blank Rome’s Philadelphia office.

Buchholz, managing partner and chief executive officer. “Barry’s extensive benefits and executive compensation experience will be a great complement to the Firm, and we look forward to incorporating his expertise into our employment, benefit, and labor group.”

Prior to joining Blank Rome, Mr. Klein served as partner in the employee benefits and executive Ccmpensation group of Ballard Spahr Andrews & Ingersoll LLP, advising a multitude of clients on employee benefits and executive compensation arrangements, employee benefit aspects of mergers and acquisitions, 401(k) and ESOP plans, stock options, and administrative procedures and investment policy. He also represented employers in connection with IRS audits and Department of Labor proceedings.

Mr. Klein served as assistant general counsel for the Vanguard Group of Investment Companies and the Prudential Insurance Company of America, providing support for corporate human resources in connection with the companies’ retirement and benefits planning.

At the Internal Revenue Services (IRS), Mr. Klein served as in-house counsel in the Employee Plans Division, drafting private letter rulings, technical advice memoranda, and providing guidance on qualified plan issues. Prior to joining the IRS, Mr. Klein began his career at Blank Rome as an associate in the trusts and estates group.

Mr. Klein is an adjunct professor at Temple University School of Law, where he teaches an advanced LLM course on fiduciary responsibility and investment management for employee benefit plans. He was also listed in the 2007 edition of Chambers USA: Americas Leading Lawyers for Business.

Admitted to practice in Pennsylvania, Mr. Klein received his law degree from Temple University School of Law and his bachelor of arts degree in economics from the University of Pennsylvania.

Max R. Rodden has recently joined the litigation section of Smith Debnam Narron Wyche Saintsing & Myers, LLP. He will concentrate his practice in family law and civil litigation.

Mr. Rodden earned his J.D. from Wake Forest University Law School in 1991 and his B.S. in Business, cum laude, from Wake Forest University in 1985. He has practiced law in North Carolina since 1991 and specialized in family law since 1992. Mr. Rodden has extensive trial experience and has represented clients at all levels of North Carolina courts. He has participated in numerous mediations and arbitrations in family law and other civil litigation cases. He has also appeared in bankruptcy court to protect creditor rights of family law clients.

K&L Gates Sponsors Third Annual Essay Contest for Robert Treat Academy Charter School Students
Kirkpatrick & Lockhart Preston Gates Ellis LLP (K&L Gates) sponsored its third annual civics essay contest for eighth-grade students at Newark’s Robert Treat Academy Charter School. The winners were announced at a recent awards ceremony.

As part of the contest, students wrote 300-plus-word essays on one of several civics topics. The top three winning essays provided perspectives about the importance of citizenship, presidential authority and democracy. K&L Gates awarded a total of $4,000 to winners Kathleen Morales (first place), Alejandro Bernal (second place) and Joshua Medina (third place).

Students use the prize money to help offset high school tuition costs.

Mattioli Speaks on Aviation Law Issues
Partner Mark Mattioli will speak about Aviation Law issues at Airventure 2007 in Oshkosh WI on Wednesday July 25, 2007. The title of his presentation is "Getting Along with our Non-Pilot Neighbors and the FAA". Mark will be on a panel with noted aviation experts and will be addressing legal (tort) theories brought by residents against aircraft operators and airports.

Airventure is one of the biggest aviation events in the world, and attendance tops 750,000 people, including manufacturers, FBO managers, pilots, and the general public.

Mark has been a pilot since 1998 and is an active aerobatic competitor.
