Gary Born Named Among World’s “Top 20 Arbitration Specialists
The July-September 2006 issue of the PLC Cross-border Quarterly ranked Gary Born as one of the world’s “top 20 arbitration specialists.”

The article, titled “The Arbitration Elite: In a League of Their Own,” comments that as “one of the world’s leading arbitrators [Gary Born] continues to be in high demand as both counsel and arbitrator.” Mr. Born is among a short list of lawyers who were found to have “made strong contributions to the international arbitration community” and recognized accordingly for “the strength of their personal practices as well as that of their firms.” These findings are based on research undertaken for the fifth edition of the PLC Cross-border Dispute Resolution Handbook and PLC Which lawyer? and additional interviews with in-house counsel, fellow lawyers and barristers.

This recognition almost immediately follows the announcement made by the Legal Media Group regarding the selection of Mr. Born as the world’s leading international litigator in its poll of experts on international litigation.

Mr. Born chairs WilmerHale’s International Dispute Resolution and Arbitration practices and is widely regarded as one of the world’s leading authorities in both fields. He has been lead counsel in more than 300 international arbitrations and litigations, and is the author of several leading works on international arbitration and litigation, including, International Commercial Arbitration (2d ed. 2000 Kluwer/Transnational Publishers), and International Arbitration and Forum Selection Clauses (2d ed. 2006 Kluwer).

Mr. Born’s most recent book, International Civil Litigation in U.S. Courts (4th ed. 2006), will be released by Aspen Publishers this summer. All books may be purchased through the Aspen Publishers website at www.aspenpublishers.com.

Tax Lawyer Chuck Moll Joins Winston & Strawn as Partner in San Francisco
Winston & Strawn LLP announced today that prominent tax attorney Charles J. Moll III joined the San Francisco office as a partner in the tax department. Moll moved his practice from Morrison & Foerster, where he chaired the firm’s property tax group and focused on the resolution of federal, state and local tax controversies.

“Hiring Chuck is part of our plan to expand our West Coast presence with lawyers whose practices focus in Winston & Strawn’s core competencies, in this case corporate taxation,” said Charles S. Birenbaum, managing partner of the firm’s San Francisco office. “His superior skills and experience will prove valuable to our clients.”

Moll is acknowledged for his ability to win precedent-setting cases. Most recently, in 2005, he won an important published decision in NMI v. City of Modesto protecting tax payers from retroactive taxation and unconstitutional extra-territorial taxation. In 2000, he convinced the U.S. Supreme Court to unanimously declare California’s interest-offset provision unconstitutional in Hunt-Wesson v. Franchise Tax Board. That same year, Moll prevailed against the Franchise Tax Board in a business income case that resulted in a rare published opinion, Appeal in Consolidated Freightways. A decade earlier, Moll successfully represented the taxpayer in Crocker National Bank v. San Francisco, a seminal California Supreme Court property tax case.

"Chuck is a terrific addition, and will lead the firm's expanding state and local tax practice," said Robert F. Denvir, who chairs the firm's 43-attorney tax practice. "We continue to implement the strategic vision that we set in motion last spring and bringing him on board is a critical part of that," referring to five prominent lateral tax partners who have joined Winston's New York and Washington, D.C. offices in the last 14 months.

Moll’s extensive experience includes regular appearances in court and before California and local tax authorities, most notably the State Board of Equalization, Franchise Tax Board, local assessors and appeals boards. At the federal level, Moll represents clients in court and in hearings before the Internal Revenue Service. He also has handled state tax law cases outside of California.

A graduate of Cornell University, Moll earned his juris doctor from the George Washington University School of Law. He chaired the State Bar of California’s Tax Law Section in 2003-04 and is founder and past chair of the American Bar Association Section of Taxation’s Environmental Taxes Committee.
