Merck Gets Boost in Suits on Vioxx with Win in NJ
Merck & Co. won a victory in New Jersey yesterday when a jury ruled the drug maker's Vioxx painkiller wasn't a cause of a 68-year-old woman's heart attack, strengthening its position in about 16,000 similar lawsuits. Jurors in Atlantic City found Vioxx didn't contribute to Elaine Doherty's heart attack in 2004. Merck warned Doherty's doctor of the drug's risk, and didn't defraud consumers, jurors said. Merck attorney Diane Sullivan, who has won two Vioxx trials, said, "The duty to warn is to the physician because the physician prescribes the medication," said Sullivan, of Dechert. "This is an unprecedented claim in pharmaceutical liability litigation. We think we have a strong legal argument that this kind of claim should not be submitted to a jury.

Mark Wilson’s Article on Patent Trolls Appears in Charlotte Business Journal
The Business of Law section of the Charlotte Business Journal ran an article by Mark Wilson titled “Trolls seek easy marks for patent suits.” As Mark points out in the article, a patent troll “‘tries to make a lot of money off a patent that they are not practicing and have no intention of practicing and in most cases never practiced.’” Patent trolls have collected billions of dollars in recent years in license fees. Mark suggests that “The best strategy for avoiding a patent troll is to seek the assistance of legal counsel before becoming a target. Patent attorneys can search for and analyze issued patents, and even published patent applications, to determine whether there is a patent that might cover what you plan to do. Such work is of relative minimal expense compared with the often exorbitant cost of dealing with a troll.
