La Fonte Nesbitt of Holland & Knight Recognized by the Minority Business & Professionals Network
Holland & Knight LLP is proud to announce that La Fonte Nesbitt, an African American partner in the firm's Real Estate Section, has been named one of the Fifty Influential Minorities in Business by the Minority Business & Professionals Network (MBPN). Nesbitt, the first attorney in private practice to be listed, will be recognized during MBPN's eighth annual awards gala on Friday, July 21, 2006, from 6:00 - 10:00 p.m. at the Mayflower Hotel in Washington, D.C. The event honors diverse, dynamic business professionals who have demonstrated strong leadership in their industry and share a commitment to their community, business growth and professional excellence. Gary Forsee, President and CEO of Sprint/Nextel is one of the keynote speakers, and former President Bill Clinton and Congressman Elijah Cummings (D-MD) have been invited to address the audience.

Nesbitt practices in the commercial real estate development and finance area, with a particular focus on affordable housing and community development, and public-private partnerships and privatization initiatives. He was Holland & Knight's first Diversity Partner and currently serves as Executive Partner of the firm''s Washington, D.C., Northern Virginia and Bethesda, Md. offices. Nesbitt serves as a Board Member of Street Law, Inc., and is a member of the Law Firm Pro Bono Project Advisory Committee, Pro Bono Institute. His past community involvement includes: member of the Leadership Greater Washington Class of 2003, Alexandria, Virginia School Board, Alexandria Economic Opportunities Commission, and the Board of Trustees of Hopkins House Association in Alexandria.

Holland & Knight Lawyer Leads Award-Winning Diversity Initiatives at The Boston Bar Association
The Boston Bar Association will be presented with the 2006 Partnership Award from the American Bar Association's Standing Committee on Bar Activities and Services. The BBA is receiving this award for its activities promoting the legal industry to young African-Americans, led by the BBA's Children and Youth Outreach Program and Diversity Committee, chaired by Holland & Knight Partner J.D. Smeallie. As chair of the BBA's Diversity Committee, Smeallie is responsible for promoting programs aimed at increasing diversity in the legal profession, including lawyers, judges and educators.

The BBA has created various activities designed at promoting legal careers in Boston to African-American youths, which offer them the opportunity to explore the legal profession in Boston through mentoring, tutoring, teaching and employment programs. Programs include ""Law Day in the Schools,"" an annual luncheon for summer associates of color, and the BBA summer jobs program, of which Holland & Knight is a participant.

Fulbright’s Shauna Clark Named One of Top 25 Most Influential Women
Rolling Out Urban Style Weekly, a magazine that documents successes in the African-American community, has included Fulbright partner Shauna Clark in its list of the top 25 most influential women.

Clark joined Fulbright’s Houston office in 1994, where she represents all aspects of employment law matters including jury and non-jury trials, collective bargaining, mediation and arbitration. Clark also has significant experience in preparing affirmative action plans for government contractors.

Additionally, Clark conducts training seminars for supervisors, prepares and reviews personnel handbooks and policies and advises clients regarding employee retention and termination. Clarkis board certified in labor and employment law by the Texas Board of Legal Specialization.

Dykema’s Top-Ranked Pro Bono Program Wins Three Unique Cases
Attorneys from Dykema, a premier Midwest law firm, recently successfully represented three clients in pro bono cases. Attorneys Joe Doerr and Ryan Clarkson won a judgment in a pro bono wrongful lock-out case in Detroit. Clarkson also claimed victory in another case, convincing the judge to expunge his client’s criminal record. In the third instance, a team of Dykema attorneys successfully represented their client in a heart-wrenching international child-abduction case.

The firm was also included in the most recent American Lawyer 200 list of top pro bono firms. To develop their list, the publication looked at the average number of pro bono hours completed per attorney as well as the percentage of lawyers who performed more than 20 hours of pro bono work in 2005.

Jury Absolves Merck in N.J. Woman's Heart Attack
Merck & Co. won a crucial legal victory on Thursday, when jurors decided that the drugmaker's Vioxx painkiller, now the subject of at least 16,000 product liability lawsuits, did not cause a 68-year-old woman's heart attack. The case was the first in which jurors considered whether Merck failed to warn patients about the drug's cardiac risks, rather than just doctors as in prior trials. The jury found that Merck properly warned doctors but did not caution the woman of the cardiac hazards of the drug. The jury of five men and two women found that Vioxx was not a major factor in Elaine Doherty's 2004 heart attack, however. Merck will not have to pay compensatory or punitive damages in the case. The jury also found that Merck did not violate New Jersey's consumer fraud law, meaning it met standards of honesty and good faith in its marketing of Vioxx and did not conceal information about the drug's cardiovascular risks. Merck's lead attorney, Diane Sullivan, who successfully defended the company in both Doherty's case and another New Jersey suit last fall, said having a jury decide whether a patient -- not just a physician -- was warned about such side effects was unprecedented. She said her team was surprised the judge made it part of the jury's instructions, and would argue against including it in future Vioxx cases -- even though she said consumers were adequately warned. "Had we known this was going to be part of the case, we would have put on a defense to it," Sullivan said. "The duty to warn ... is really to the physician. You can't get Vioxx at the supermarket.
