Carlton Fields Shareholder, Kelly A. Cruz-Brown, Admitted as a Member to the Federation of Regulatory Counsel
Carlton Fields Tallahassee Shareholder, Kelly A. Cruz-Brown, has recently been admitted as a member to The Federation of Regulatory Counsel (FORC).

The FORC is a professional association of insurance regulatory lawyers formed for the purpose of raising the standard of excellence in the practice of regulatory law and promoting the expertise and abilities of its members to their clients, the insurance industry, and other lawyers requiring their specialized skill. To become a member of FORC an attorney must have at least five years or more of insurance regulatory law experience. It is also required that for each of the five years prior to application the attorney's practice must consist of 50% professional billable time representing persons or entities licensed by and State of Federal insurance regulatory body.

Cruz-Brown concentrates her practice primarily in the areas of insurance regulation and administrative law. She represents individuals, insurers, and other entities regulated by the Florida Department of Financial Services and Office of Insurance Regulation concerning licensure and formation issues, agency investigations and examinations, disciplinary matters, and challenges to agency administrative rules. Cruz-Brown also represents individuals and business interests regarding licensure and disciplinary matters before the Department of Business and Professional Regulation, Department of Health, Agency for Health Care Administration, and other state agencies. She serves as the chair of the Firm's Women's Initiative Program. Cruz-Brown received a B. S. with honors, in 1989 from Florida State University, and a J.D., in 1992 from Florida State College of Law.

Ten attorneys from the firm's New York office were named to the "New York Super Lawyers"
Those lawyers were: Stewart Aaron (business litigation), Richard Anderson (tax), Michael Gerrard (environmental litigation), Robert Holton (securities and corporate finance), Mark Stumpf (international), Richard Swanson (securities and corporate finance), James Swire (intellectual property), Kent Yalowitz (general litigation), Peter Zimroth (general litigation), and Ramon Marks (international). The final selection was based on a point-based system which included a general survey of attorneys in New York via distribution of ballots; review by a blue-ribbon panel, broken into nearly 60 areas of practice, consisting of the top vote-getters; and independent research and interviews with lawyers throughout the region.

Rachel J. Drake Completes Leadership Tomorrow
Miller Nash LLP attorney Rachel J. Drake was among the 68 Seattle-area residents to graduate from this year's Leadership Tomorrow program. Leadership Tomorrow has been training emerging and existing Puget Sound leaders for nearly 25 years through a nine-month program that balances a combination of retreats, seminars, and small group action projects

Established through a unique collaboration with the Greater Seattle Chamber of Commerce and the United Way of King County, Leadership Tomorrow has served as a model for leadership programs in other cities throughout the United States and Canada.

Leadership Tomorrow's lasting legacy is its graduates–more than 1,050 alumni serve as policy-level community trustees for more than 1,000 different organizations, as elected and appointed officials, and as leaders in the private, public, and nonprofit sectors of the Puget Sound region.

Drake, who joined Miller Nash in 2001 and is an associate in the labor department, said she felt honored to have participated in the program.

""I think it says a lot about Miller Nash's commitment to the Seattle-area community that it gave me the time, resources, and encouragement to complete this kind of program,"" she said. ""Leadership Tomorrow definitely teaches the importance of firms’ viewing themselves as a part of the greater community. Miller Nash believes in that, as is evidenced by its participation in the program.""

Brian W. Esler, a partner of Miller Nash, will join the Leadership Tomorrow program for 2006-2007.

Dickens, Groshong, and Walerius Named "Super Lawyers"
Miller Nash LLP partners Jim Dickens, Geoff Groshong, and Bob Walerius have been chosen as ""Super Lawyers"" by Washington Law & Politics magazine. ""Super Lawyers"" lists Washington's top lawyers as chosen by their peers and through the independent research of the magazine.

Jim Dickens is a partner in Miller Nash's labor and employment litigation group, where he represents employers in employment discrimination and wrongful-discharge litigation, along with other employment-related matters. Dickens has written and lectured nationally on employment discrimination and wrongful-discharge issues and is active in various local, state, and American Bar Association committees on labor and employment law. He has argued employment cases before the Washington Court of Appeals, the Washington Supreme Court, the Alaska Supreme Court, the Ninth Circuit Court of Appeals, and the United States Supreme Court. Dickens is also a 2005-2006 selection for The Best Lawyers in America.

Geoff Groshong is a partner in Miller Nash's business department, where he focuses his practice on bankruptcy matters, insolvency, workouts, and restructuring. In Chapter 11 cases, he represents debtors-in-possession, creditors, creditors' committees, trustees, and examiners. He helps businesses arrange out-of-court workouts and turnarounds, and he represents companies and individuals who purchase assets out of bankruptcy estates. Groshong served as a Chapter 7 panel trustee for ten years, and he continues to serve as a Chapter 11 trustee. He is also cochair of the Public Companies and Claims Trading Committee of the American Bankruptcy Institute. Groshong was named one of Seattle's best attorneys by Seattle Magazine in 2001 and has been listed as a ""Super Lawyer"" for eight consecutive years.

Bob Walerius's practice emphasizes corporate, transactional, regulatory, and medical staff issues relating to health care. He has provided legal advice to health care and educational facilities and professionals for more than 25 years. Walerius is a member of the American Health Lawyers Association, the Washington State Society of Healthcare Attorneys, and the National Association of College and University Attorneys. He has been selected by his peers for inclusion in the publication The Best Lawyers in America for over ten years.

The 2006 list is based on surveys of more than 16,000 active lawyers across the state. The ""Super Lawyers"" list is published annually in the Summer issue of Washington Law & Politics.

Venable Adds Noted Internet Policy, Marketing, and Privacy Attorneys Alisa Bergman and Stuart Ingis
Reuniting a potent team of Internet, marketing, and privacy lobbyists and practitioners, Venable LLP has added Alisa Bergman and Stuart Ingis, two top attorneys who focus on privacy, marketing, and Internet law and policy for leading companies and associations.

In joining Venable as partners, Ms. Bergman and Mr. Ingis reunite with their former colleague Emilio (Milo) W. Cividanes and reconstitute one of the premiere privacy practices, adding further depth to Venable's legislative and government practices.

“Privacy compliance and data protection laws are unquestionably two of the major concerns affecting every business in the country, and the issues regarding customer, employee and corporate privacy are becoming as complicated as they are highly sensitive,” said Jeffrey D. Knowles, head of Venable’s Government Division. “Few people know the ins and outs of privacy and related Internet law as well as Stu, Alisa, and Milo, who have been at the center of key policy debates and passage of every federal privacy, marketing, and Internet law. Ms. Bergman and Mr. Ingis lobby and advocate for a cross-section of leading Internet, media, and information services companies on a host of federal and state privacy and Internet-related legislation and rulemaking proceedings. Among the major legislation and regulations that Ms. Bergman and Mr. Ingis have worked to shape are the Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM); the Telemarketing Sales Rule; the financial privacy provisions of the Gramm-Leach-Bliley Act; the Junk Fax Prevention Act; the Electronic Signatures Act (E-SIGN); the Children’s Online Privacy Protection Act; and the Department of Commerce’s Safe Harbor Program for compliance with the European Union’s Data Protection Directive. Mr. Ingis also has been involved in the Federal Communications Commission’s implementation of the landmark Telecommunications Act of 1996 as it applies to the Internet. Ms. Bergman and Mr. Ingis are very involved in legislation currently being considered to address data security breaches, spyware, and other privacy-related issues. In addition, they have advised numerous clients regarding security breach notification obligations in connection with state, federal and international requirements, several of which were high profile in nature, and worked with clients to develop incident response plans and strengthen security policies and procedures.

Ms. Bergman is widely regarded as a leading authority on children's privacy and marketing-related issues, most recently representing a cross-section of leading marketing and advertising associations, as well as major media companies in the FTC's review of the Children's Online Privacy Protection Act. Ms. Bergman also is very active in global and trans-border privacy issues for a number of notable international companies, conducting risk assessments, advising on global strategies, and developing legal solutions that harmonize businesses’ needs with emerging legal and self-regulatory requirements and standards.

Ms. Bergman has represented numerous Internet and e-commerce clients before the Federal Trade Commission, and has worked with them to develop and implement comprehensive strategies to address legal requirements and achieve their privacy protection, security, e-commerce, and marketing business objectives. She also has worked with clients to develop solutions to address the challenges raised by cross-border information flows, consistent with business needs and risks, advised on mitigation strategies, and assisted with government investigations.

In addition, Ms. Bergman has conducted major assessments of clients’ privacy and information practices to analyze compliance, and also has worked extensively with companies to develop programs that address industry self-regulatory guidelines and seal programs.

Mr. Ingis has led industry coalitions on the implementation of the CAN-SPAM Act and numerous other Internet-related issues. Co-author of Privacy Protection in the United States: A Survey, he has worked on Internet law since the inception of the commercial Web. Mr. Ingis was a primary draftsperson of the advertising and consumer protection section of the American Bar Association’s millennium plenary paper on Internet jurisdiction. He also worked with the Electronic Commerce and Consumer Protection Group, which is composed of many large companies that drafted a code of best consumer protection principles and an approach to jurisdiction online.

Mr. Ingis assisted the Direct Marketing Association in the drafting of its self-regulatory guidelines governing the use of health information. In addition, he helped draft the policies for the BBBOnLine Privacy Seal Program of the Council of Better Business Bureaus.

Mr. Ingis was formerly a fellow at the Villanova Center for Information Law in Philadelphia. In that capacity, he co-founded Project Bosnia, aimed at deploying the Internet and promoting the rule of law in Bosnia following the signing of the Dayton Accords.

Ms. Bergman received her J.D. from Georgetown University Law Center and her B.A. from University of California, Los Angeles. Mr. Ingis received his J.D. from Villanova University and his B.A. from Hamilton College.

T&K Attorney Named 'New York Super Lawyer'

Sidley Austin Elevates 2 to Partnership and 1 to Of Counsel in London, 37 New Partners For Global Firm
Two lawyers in the London office of Sidley Austin have been named partners and one lawyer has been named of Counsel.

With effect from 1st July, the new London partners are Leonard Ng, International Finance Group and Jonathan Wallace, Corporate and Securities Group. The new London counsel is Sheena McCaffrey, also from the Corporate and Securities Group.

“Leonard, Jonathan and Sheena are exceptional lawyers, and we are proud to have them represent the firm,” said Thomas A. Cole, chair of the firm’s Executive Committee.

“Leonard, Jonathan and Sheena have made a very substantial contribution to the London office as associates,” added Drew Scott, Managing Partner of the firm’s London office. “We are delighted that Leonard and Jonathan have accepted our invitation to join the partnership and that Sheena has accepted our offer of promotion to Counsel.”

Leonard Ng is a partner in the International Finance Group. His practice focuses on financial services regulation in the United Kingdom and the European Union generally. He advises banks, investment firms, hedge funds and other entities on a wide range of financial services regulatory issues.

Mr. Ng received a Master of Laws from The University of Chicago School of Law. He received his Bachelor of Laws from the National University of Singapore. Mr. Ng joined the London office in 1997 as an associate. Mr. Ng has also worked for some time in Sidley’s Singapore and New York offices.

Jonathan Wallace is a partner in the Corporate and Securities Group. His practice focuses on mergers and acquisitions and corporate finance.

Mr. Wallace received his Bachelor of Arts from Cambridge University.

Sheena McCaffrey focuses on pensions and employment matters, providing support to the corporate and restructuring practices in addition to her primary pensions and employment practice. In 2005, Sheena played a lead role in dealing with the deficit in the pension scheme as part of the anticipated exit from administration and Chapter 11 of T&N Limited and other English subsidiaries of Federal-Mogul Corporation.

Ms. McCaffrey received her Bachelor of Laws from the University of East Anglia.
