Foley New York Attorney Named “Super Lawyer”
Foley & Lardner LLP announced today that Peter N. Wang has been named a 2006 New York “Super Lawyer” in business litigation by Law & Politics Media, Inc.

To compile the annual list, Law & Politics surveyed more than 59,000 lawyers in Manhattan, asking them to vote for the best lawyers they have personally observed in action. The final list features the top five percent of Manhattan attorneys in more than 60 areas of practice.

Peter N. Wang is the managing partner of Foley's New York City office. He is a member of the General Commercial Litigation Practice and the Insurance Industry and Entertainment & Media Industry Teams. Wang is a member of the International Academy of Trial Lawyers and has spoken on the topic of litigation before the Federal Bar Council.

"Seven Poker Players File Antitrust Suit"
Litigation co-chair Jeffrey L. Kessler and Litigation partner David G. Feher were mentioned in an article regarding their representation of seven top professional poker players in an antitrust lawsuit against WPT Enterprises, Inc. The players contend that releases they are required to sign in order to participate in World Poker Tour events unlawfully force them to surrender extensive intellectual property rights.

Lee Ellis Honored as "Lawyer of the Year"
Partner Lee Ellis was honored as the 2006 Lawyer of the Year by the District of Columbia Defense Lawyers Association. Former Baker Hostetler partner Ralph Blasey presented the award, and former partners Judge Richard Leon, Henry Hoberman and Leonard Freiman along with former associates Greg Paw and Doug Lee provided comments about their long professional and personal association with Lee.

Said Ellis, ""Because all these lawyers did well at BH and after leaving BH, the words had special meaning to me and the audience. The Association has been around for a long time and is well-known to the Bench and Bar. Some very fine trial lawyers in Washington have received the award in the past. As you can imagine, I was surprised and pleased to receive the award for 2006.""

Remarks by Henry Hoberman:

""Lee Ellis."" Just mention those two words to anyone who ever came through the doors of Baker Hostetler and you are certain to evoke unabashed fondness and an earful about the virtues of this special man. Lee taught us so many lessons: that good, tough litigators could be gentlemen and gentlewomen also; that reaching the top of your profession doesn't mean you have the right to cart around an oversized ego; that the janitor deserves as much respect as the Managing Partner; that it really is possible to achieve a healthy balance between your family and professional lives; that the ethical choice is always the right one. I could go on, but I know I've probably embarrassed Lee enough already. So I'll sum it up this way. I frequently describe Lee Ellis as a ""moral compass."" Lee, you have no idea how grateful I am that I carry your many lessons and your compass with me today and everyday. Many thanks, and congratulations.

Lee Ellis set the standard for my professional career. Although I left Baker Hostetler 15 years ago, I can honestly say that not a day goes by when I don't ask myself how Lee would handle a given situation and try to guide myself by the answer. While Lee's intelligence, creativity and honesty are legendary to all who have come in contact with him, what I always appreciated in addition was his utter calmness under fire. As a young lawyer trying to learn the complex ropes of litigation, the ability to work with someone who had the patience of Job and never panicked regardless of the situation was a great example of how to handle oneself at every level of this difficult profession. But even more importantly, Lee has always conducted himself with a courtesy and personal warmth that can't help but make you smile every time you deal with him. And to use Lee's own words that he signs most of his letters with, with kindest personal regards to you Lee. You have so positively affected more lives than you can possibly ever know.

Remarks by Doug Lee:

As long as I've known Lee, his professional biography has started with the same six words: ""Lee Ellis is a trial lawyer."" As true as those words are, they fail to adequately describe the Lee Ellis I know. His superb trial skills pale in comparison to his unsurpassed ability to teach and inspire, to comfort and encourage, to care and then care even more. No one has had a more profound and positive influence on my life.

Remarks by Greg Paw: The biggest impact that Lee had on my career was the lesson that above anything else that happens, lawyers owe a duty to the tribunal to be fair and honest. I think of the issues we faced with the Maryland recount over 10 years ago, and the great ethical guidance that Lee gave all of us as a team in a very difficult situation. He not only did the right thing, but he did it as a total gentleman. That night's guidance has always stuck with me, and Lee was a great teacher through it all. In the process, he taught me an important lesson in leading the way for junior lawyers, too. And that has also stuck with me.

Scott Green of Weil, Gotshal & Manges Inducted into AICPA Hall of Fame
Weil, Gotshal & Manges announced today that Scott Green, Chief Administrative Officer for the firm, has been inducted into the American Institute of CPA’s (AICPA) Business and Industry Hall of Fame. Every year, only five individuals carefully selected from a pool of candidates from across the nation are inducted.

The AICPA, which is the premier national association for certified public accountants, acknowledges the contributions of individuals who demonstrate outstanding achievements in business and other respective industries. Green’s recognition by the AICPA resulted from his accomplishments in the areas of internal controls and corporate governance. Harold Gibson, Director of Business Management at Weil Gotshal says, “He has taken a critical and complex issue, explained it’s ramifications, pitfalls and opportunities in a practical, down-to-earth manner. His books give managers and board members in varied industries, templates and examples that are both pertinent and can be readily implemented.”

Some of the past AICPA Hall of Fame inductees include Cynthia Cooper, former vice president for WorldCom who assisted in discovering the financial reporting fraud at the company, and Joseph T. Wells, founder and chairman of the Association of Certified Fraud Examiners, in addition to a great deal of other C-level executives from some of the nation’s largest organizations.

Green, a certified public accountant, is responsible for support operations worldwide at Weil Gotshal. He is a graduate of the University of Idaho and the Harvard Business School. Green is nationally renowned as a leading figure and authority on management controls, with more than 15 years of experience in the sector. He is the author of Manager’s Guide To The Sarbanes-Oxley Act: Improving Internal Controls To Prevent Fraud and Sarbanes - Techniques and Best Practices for Corporate Governance.

The AICPA officially welcomed all honorees at their annual 2006 AICPA Controllers Conference in Las Vegas, NV on July 20.

Kurt Kappes Published in Executive Counsel
Kurt's article, "Trade Secrets Can Bite You Coming and Going," complements the editorial focus of the July/August issue of Executive Counsel: "New Complexities in Intellectual Property and IT Management." Kurt writes that the time when most companies take a hard look at what they have done to protect their trade secrets is after the trade secrets may have been compromised. Or, in other instances, when someone who has been hired has brought other potential trade secret information from their prior employer, and the company receives a demand letter. Once litigation has commenced, it is often the case that too little has been done, too late. What many companies are now doing in order to avoid these kinds of situations from arising are trade secret, or IP audits, that include a team that identifies sensitive issues and maintains an implementation program to protect the company's assets. The goal of a trade secret audit is to help employers develop and implement procedures that reduce the risk that an employer’s trade secrets will be improperly disclosed, provide evidentiary support should the need for obtaining legal relief for trade secret theft become necessary, and also limit the risk of a company’s exposure to claims of misappropriation by other companies. The benefits of having more formal procedures in place is that they can help a company protect its valuable trade secrets and prevent unnecessary loss, maintain its competitive edge in the marketplace, notify its employees and third parties of the employer’s interest in protecting proprietary information, educate your employees on what constitutes your confidential information and how to protect it, and the consequences of failing to do so. The idea is to foster a workplace culture where employees understand and appreciate that the employer takes its trade secrets very seriously.
