Jones Vargas Welcomes New Associate
Benjamin Kennedy has joined Jones Vargas as an associate in their Reno office, where he will practice primarily in the real estate transactions department.

About Benjamin W. Kennedy
Prior to his status as an associate with Jones Vargas, Mr. Kennedy spent his first year of practice with a firm in Carson City, Nevada, during which he focused on real estate transactions and real estate litigation.

Before returning to Nevada, Mr. Kennedy attended law school in Montana where he was heavily involved in community service. His projects included assisting the residents of Lake County, Montana, in drafting and implementing a citizen initiated zoning district, and volunteering with Habitat for Humanity of Missoula.

A native Nevadan, Mr. Kennedy holds a Bachelor of Science degree in Biology from the University of Nevada Reno, and graduated, with honors, from the University of Montana School of Law in 2004.

Jones Vargas represents local, national, and international clients in business, litigation, government relations, gaming, corporate, municipal finance, real estate, bankruptcy, estate and probate, tax, zoning, health care and domestic matters. In certain areas of practice, such as complex financing transactions and multi-state or multi-district litigation, Jones Vargas is one of the most experienced firms in Nevada. Concentrating on commercial and real estate law, Michael Buckley represents a diverse group of clients, including high-rise condominium and master-planned community developments, buyers and sellers of land and commercial developments, and banks and commercial lenders. He has worked with developers in creating and financing projects and communities throughout Southern Nevada, and was a key player in transactions that led to the construction of the Las Vegas Monorail project.

A member of Jones Vargas since 1978, Buckley leads the firm's Business and Real Estate Transactions Practice Group. His years of experience in real estate have shown him the cyclical nature of the market, so he is not overly concerned about a real estate ""bubble"", even in the volatile high-rise market. ""In the mid-80s, I was working with Valley Bank, negotiating with builders and developers who had overextended themselves in the boom and got caught in the bust that followed,"" he recalled. ""I've seen the whole cycle - this is nothing new. If there is a good real estate deal, developers will overwhelm it, and that's what happened here. There's still a market for people who know what they're doing."" Buckley has worked with five successful high-rise projects that are either ongoing or completed, including Panorama Towers, Newport Lofts and juhl.

In 2003, Governor Guinn appointed him as one of the initial members of the Nevada Commission for Common-Interest Communities, where he presently serves as chair. He said laws have changed in recent years concerning common-interest communities, such as homeowners associations. ""These laws were set up to protect homeowners from developers,"" he explained, ""but these days they are being used more to protect homeowners from each other.""

Buckley has served as a part-time instructor in real estate law at the University of Nevada, Las Vegas, and is a frequent lecturer at continuing legal education programs. ""Law is how the real world works,"" he said. ""It challenges the brain, and there's always something new to learn.

Pace Law School Announces 2006 Recipient of the Outstanding Alumni Service Award
Pace Law School is proud to announce Mark Starkman ’94 as this year’s recipient of the Outstanding Alumni Service Award to be presented at the Annual Dutchess County Alumni Luncheon. The Honorable Christine A. Sproat, New York State Supreme Court Justice, will be presenting the award to Starkman on April 19, 2006, at the River Station Restaurant in Poughkeepsie, NY.

This annual luncheon celebrates Pace Law School alumni from Dutchess County who serve the community both inside and outside of the courtroom. Individuals who have been chosen for this award have exemplified such service, demonstrating excellent work in the courthouse and engaging in activities such as fund-raising for charities and involvement with bar associations and/or the Chamber of Commerce. Past honorees include Bernard Handel ‘82, Justice Christine Sproat ‘83, Judge Michael Tomkovitch ‘84, Judge Steven Kaufman ‘86, and Judge Marc Zylberberg ‘83.

An accomplished attorney with the law firm of Jacobowitz & Gubits, LLP, Starkman is also committed to community service. He is the immediate past chairman of the Poughkeepsie Area Chamber of Commerce Legislative Action Committee and the current chairman of the Chamber’s Long Range Planning Committee. He is also in his second term on the Chamber’s Board of Directors and also serves on the Hudson Valley Advisory Board for Lighthouse International, the Business/College Partnership Committee of the Dutchess Community College Foundation, and the Heart Walk Committee of the American Heart Association.

Starkman is an active member in the American Bar Association, the New York State Bar Association, the Dutchess County Bar Association, where he serves as an alternate delegate to the New York State Bar Association’s House of Delegates, the Orange County Bar Association, where he was recently honored for his pro bono service to 9-11 Victims, and the Mid-Hudson Bankruptcy Bar Association. In addition, he is a soccer coach certified by both the American Youth Soccer Organization and the National Youth Sports Coaches Association.

Steve Chappelear confirms that a new jury verdict for a medical malpractice suit is the highest yet in Franklin County and second highest in the state in, "Jury Awards $17.8 Million"
The Columbus Dispatch
A Franklin County jury awarded the family of a Columbus girl over $17.8 million because of a medical mistake that left her requiring round-the-clock care. Steve Chappelear, who has studied jury verdicts for the Columbus Bar Association confirmed this award is above the medical malpractice record of $12 million awarded by Franklin County in 1990.

Kishbaugh to Serve as Secretary of Health Law Section of The Florida Bar
The Health Law Section of The Florida Bar has elected Troy A. Kishbaugh, a shareholder with the law firm of GrayRobinson, P.A., to serve as Secretary of the Section. His one-year term commences July 1, 2006.

Kishbaugh concentrates his practice in the area of health care law, which includes, medical/health corporate law issues, Medicare/Medicaid fraud and abuse, false claims, billing and reimbursement, corporate compliance, HIPAA, EMTALA, Stark, self-disclosure and exclusions, and daily hospital operational issues.
